Summary

The ongoing genocide in Gaza is a collective crime, sustained by the complicity of influential Third States that have enabled longstanding systemic violations of international law by Israel. Framed by colonial narratives that dehumanize the Palestinians, this live-streamed atrocity has been facilitated through Third States’ direct support, material aid, diplomatic protection and, in some cases, active participation. It has exposed an unprecedented chasm between peoples and their governments, betraying the trust on which global peace and security rest. The world now stands on a knife-edge between the collapse of the international rule of law and hope for renewal. Renewal is only possible if complicity is confronted, responsibilities are met and justice is upheld.

25. Certain non-Western States have turned to international courts to seek accountability and pressurize Israel to cease its actions. While only 13 States have supported South Africa before the ICJ, most Western States have persistently denied genocide. None have joined Nicaragua against Germany at the ICJ, or invoked domestic laws against complicit corporations or individuals. Only seven referred the situation to the ICC, many sought to undermine its arrest warrants, and at least 37 States were non-committal or critical, signalling intent to evade arrest obligations.

. Military Ties: providing the means of destruction

32. While UN resolutions have called for arms embargoes on Israel since 1976, many States have continued supplying it with military support and arms transfers. Israel is disproportionately dependent on weapons imports, with the proportion of their total trade more than double the OECD average, and over four times greater than that of the United States. This international supply has continued, even as the evidence of genocide has mounted, with the United States, Germany and Italy among the largest suppliers. Only a few Western States, notably Spain and Slovenia, have cancelled contracts and imposed embargoes.

The UN special rapporteur on the occupied Palestinian territories, Francesca Albanese, has accused major European powers, including the UK, Italy and Germany, of complicity in the genocide in Gaza and warned that their government officials should face legal consequences.

In an interview with the Expert Witness podcast on 3 November, Albanese discussed the findings of her latest report, titled Gaza Genocide: A Collective Crime, where she cited evidence of the alleged responsibility of 63 states for enabling Israeli breaches of international law.

Microsoft has terminated the Israeli army’s access to technology it was using to store vast troves of intelligence on Palestinian civilians in the West Bank and Gaza, the tech giant informed Israel’s Defense Ministry in a letter late last week, according to the Guardian.

The decision followed an exposé last month by +972 Magazine, Local Call, and the Guardian revealing how Unit 8200, the Israeli army’s elite cyber warfare agency, was housing intercepted recordings of millions of mobile phone calls by Palestinians on Microsoft’s cloud platform, Azure, creating one of the world’s most intrusive collections of surveillance data over a single population group. According to the joint investigation, this data has been used over the past two years to plan lethal airstrikes in Gaza, as well as to arrest Palestinians in the West Bank.

The decision to cut off Unit 8200’s ability to use some of its technology results directly from an investigation published by the Guardian last month. It revealed how Azure was being used to store and process the trove of Palestinian communications in a mass surveillance programme.

In a joint investigation with the Israeli-Palestinian publication +972 Magazine and the Hebrew-language outlet Local Call, the Guardian revealed how Microsoft and Unit 8200 had worked together on a plan to move large volumes of sensitive intelligence material into Azure.

“The direct US participation in military operations with Israeli forces means that as a matter of international law, the United States has been and currently is a party to the armed conflict in Gaza,” said Sarah Yager, Washington director at Human Rights Watch. “US military and intelligence personnel and contractors assisting Israeli forces who commit war crimes may at some point find themselves facing criminal prosecution for atrocities in Gaza.”

Under international humanitarian law, the ongoing hostilities between Israel and Palestinian armed groups in Gaza is a non-international armed conflict. International law does not set out specific criteria for determining when a country assisting another country in a non-international armed conflict itself becomes a party to that conflict, though direct participation in combat operations is a clear example.

Microsoft storing Israeli intelligence trove used to attack Palestinians

Unit 8200, roughly equivalent in function to the U.S. National Security Agency (NSA), has transferred audio files of millions of calls by Palestinians in the occupied territories onto Microsoft’s cloud computing platform, Azure, operationalizing what is likely one of the world’s largest and most intrusive collections of surveillance data over a single population group. This is according to interviews with 11 Microsoft and Israeli intelligence sources in addition to a cache of leaked internal Microsoft documents obtained by the Guardian.

In a meeting at Microsoft’s headquarters in Seattle in late 2021, the then-head of Unit 8200, Yossi Sariel, won the support of the tech giant’s CEO, Satya Nadella, to develop a customized and segregated area within Azure that has facilitated the army’s mass surveillance project. According to the sources, Sariel approached Microsoft because the scope of Israel’s intelligence on millions of Palestinians in the West Bank and Gaza is so vast that it cannot be stored on military servers alone.

‘Black Year for ICC’ – Le Monde Reveals Unprecedented Pressures on High Court‘

British lawyer Andrew Cayley, who was tasked with leading the ICC’s file on Palestine (ICC-01/18), said the months he spent working on the case in The Hague were the most difficult of his life.

“I went through the worst months of my life in The Hague,” Cayley told Le Monde.

He described receiving direct threats, including being told he was “an enemy of Israel” and warned to “watch his back.” He resigned in March 2024.

Le Monde also cited a July 17, 2024, intelligence memo from Dutch authorities warning that the ICC had become a “prime target for espionage and subversive influence” by states whose officials were at risk of prosecution.

DER TERRORKRIEG: Seine Dynamik des Schreckens

Das Wort „terror“ ist lateinisch und bedeutet ins Deutsche übersetzt „Schrecken“. Der vom Präsidenten der Vereinigten Staaten von Amerika, George Bush Junior, am 20. September 2001 vor dem Kongress ausgerufene weltweite und zeitlich unbegrenzte „war on terror“ ist somit in seiner Begrifflichkeit bereits aus zwei Sprachen zusammengesetzt und vielfältig übersetzbar – z.B. durch „Krieg mit Schrecken“ (entsprechend „on purpose“, „mit Absicht“).

Da Krieg aber unzweifelhaft selbst Schrecken verursacht, ergibt sich bereits in dieser Begriffsstruktur des heute vierzehnjährigen Krieges eine perpuitive, sich selbst erzeugende und multiplizierende Dynamik, in der „Schrecken gegen Schrecken“ kämpft und so alle (para)militärischen Erfolge und Misserfolge irrelevant werden, da es jedesmal den gleichen Gewinner gibt. Vergleichbar wäre dies mit einer Kreislaufbewegung in einer Art „Dynamo des Schreckens“, mit Krieg und Terror als den beiden Polen des gleichen Magneten.

Dabei kann diese Kreislaufbewegung nie zu einem Ende führen. Denn auch wenn man nun „Terror“ bzw „Terrorismus“ entsprechend der heute allgemein adaptierten Auffassung als asymmetrische Kriegführung definiert, gelangt man zur Definition des „war on terror“ als einem „Krieg gegen asymmetrische Kriegführung“, also einem „Krieg gegen Krieg“, der sogar im Falle von Niederlagen als Sieger hervorgeht, weil er gegen sich selbst geführt wird und so nie endgültig gewonnen oder verloren, sondern nur ewig weiter geführt werden kann.

In die konkrete Realität (mindestens) seit 2001 übertragen, ergibt sich die Kreislaufbewegung wie folgt: Attentate (bzw Terror / asymmetrische Kriegführung, im Hinterland oder anvisierten Zielgebiet) > Krieg (Einmarsch, Invasion, Intervention) > Attentate (Massaker in den Besatzungszonen, oder im Hinterland der kriegführenden Staaten) > Krieg (ggf. Besatzungskrieg, Drohnenkrieg, etc) > Attentate > Krieg > Attentate > Krieg > Attentate > Krieg > … usw, usw.

Auslösendes Moment bzw Trigger-Event für diesen Dynamo des Schreckens: die quasi „kinetische Energie“ der Attentate des 11. Septembers, um den ganzen Kreislauf überhaupt in Gang zu setzen.

Grundbedingung für die Aufrechterhaltung dieser Dynamik: die unbedingte Unterwerfung unter die Kriegslogik (nach Attentaten bestimmen klandestine Gruppen wie Attentäter und / oder Spione und deren Insitutionen die Realität und Tathergang. Wer widerspricht ist „Verschwörungstheoretiker“ und damit Nazi, Islamist, Spinner und / oder Sympatisant und wird nach Zugriffsmöglichkeit der jeweiligen Behörden entsprechend gesellschaftlich stigmatisiert oder physisch neutralisiert bzw unter „Überwachung“ gestellt).

מ‘ ול‘ נעצרו באוקטובר 2024 בא-תוואני בדרום הר חברון, בזמן שליוו את משפחת הורני באדמתם הפרטית. הם ביקשו להישאר בעילום שם, למען ביטחונם ומחשש להשלכות משפטיות בגרמניה. אחרי מעצרם הם נחקרו על ידי היחידה שהקים בן גביר לטיפול בפעילי סולידריות. הם בילו כמה ימים במעצר ואז אולצו לחצות את הגבול לירדן.

לפני שחצו את הגבול שוטרים צילמו אותם, וזמן קצר אחרי שגורשו, השר בן גביר פרסם את הצילום עם טשטוש פנים, וכתב: „2 אנרכיסטים תומכי טרור בעלי אזרחות גרמנית – נכנסו בערב ראש השנה ליישוב חוות מעון בדרום הר חברון הפריעו והתעמתו עם חיילים. צוות מיוחד שהקמתי במשטרת ישראל מיד עם פרוץ המלחמה, פעל בנחישות ובמהירות לעצור ולגרש אותם דרך מעבר אלנבי, ולפעול שלא יוכלו להיכנס לשטח ישראל בשנית. רק ככה זה עובד!“.

ל‘ מספרת: „הכל התחיל כשחייל-מתנחל ניגש אלינו וביקש את הדרכונים שלנו. לא מסרנו אותם מיד. שאלנו אותו – ‚מי אתה בכלל? אתה חייל? יש לך סמכות לעשות את זה?‘ הוא חזר על הבקשה, ואז פשוט התחיל לקרוא לאנשים. הגיעו חיילים, לקחו את הדרכונים שלנו, החזירו אותם ונראה כאילו הכל בסדר. אבל אז הגיע מתנחל שהיו לנו כבר מפגשים איתו, ואמר להם משהו על רמאללה. הוא המשיך להתעקש, וגם רצה לראות שוב את הדרכונים שלנו. הרגשנו שהוא מסית אותם“.

מ‘ ממשיך: „בסופו של דבר האשימו אותנו ב‘הפצת תוכן תומך טרור‘ ברשתות החברתיות או משהו כזה, וזה היה קשור לצילום שלנו בהפגנה ברמאללה. זו היתה התמונה שהמתנחל זיהה, והיא כנראה נלקחה מסרטון שפורסם בפייסבוק של הבחור שנאם שם. הוא העלה תמונה של כל האנשים שעמדו שם בעמוד הפייסבוק הפרטי שלו, שלא היו לו הרבה עוקבים או לייקים, והם איכשהו מצאו את זה והשתמשו בזה כהוכחה נגדנו.

I feel like it‘s obviously meant to intimidate, to target individuals, to show that ‘we see you, internationals.’ And especially with this entire police apparatus, the goal is for us to be on their radar and to be hunted down.”

Jerusalem Post Targets MintPress After Exposé on Israeli Spies in US Media

In December, The Jerusalem Post published an investigation from Nicholas Potter, a “counter-extremism expert,” who falsely accused MintPress News of being part of a network of far-left, foreign government-funded outlets that push conspiracy theories and anti-Semitic extremism. The claims are untrue and are particularly ironic, considering the calls for the extermination and expulsion of Palestinians and Arab peoples the newspaper has published and because Potter is a German national whose job at the Post is directly funded by the German government.

The Jerusalem Post article attacked a series of MintPress investigations published late last year exploring the deep connections between U.S. media, the pro-Israel lobby, and the Israeli intelligence services. In this series, MintPress revealed that hundreds of former Israel lobbyists now work in top jobs in American corporate media, including for MSNBC, Fox News, CNN, and The New York Times. We also showed how former employees of an Israeli spying agency, Unit 8200, are trusted to write America’s news, including about Israel/Palestine – an enormous conflict of interest.
