Since the start of the war on terror, the Bush administration has singlemindedly advanced the view that, in time of war, the president is the law, and no statute, no constitutional barrier, no coordinate branch of the U.S. government can stand in the president’s way when, by his lights, he is acting to preserve national security. Bush administration officials have argued

– that the president has the inherent constitutional authority to designate American citizens suspected of terrorist activity as “enemy combatants,” strip them of any constitutional protection, and hold them for the duration of the war on terror;
– that the president has the power to ignore validly enacted statutes prohibiting war crimes if he believes those statutes impede his prosecution of the war on terror; and
– that the president has the power to launch invasions of other countries at his discretion, without so much as a by-yourleave to Congress.

In a 1977 interview with David Frost, Richard Nixon described his view of the president’s national security authority: “Well, when the President does it, that means it is not illegal.” In the arguments it has advanced, both publicly and privately, for untrammeled executive power, the Bush administration comes perilously close to that view.

Riyadh has been very clear on the kind of nuclear partnership it expects, and it is no secret that its favored option is cooperation with South Korea, similar under a 123 agreement (a nuclear cooperation document that establishes the legal basis and prerequisites for nuclear deals with the United States) allowing it to enrich uranium domestically. The problem, however, lies in the last bit of the sentence. The United States currently insists on an agreement that requires the Saudis forgo enrichment and reprocessing capabilities—two pathways to building a bomb. The reelection of Trump might be the Saudis’ chance to tip the balance in their favor.

During the presidency of Barack Obama, the United States began providing Saudi Arabia with critical support to „sustain“ the Saudi Arabian–led intervention in the Yemeni Civil War,[1] later expanded during the presidency of Donald Trump.[2] This support included logistical and intelligence aid. Trump vetoed a bipartisan bill in 2019 aimed at stopping U.S. support for the Saudi-led coalition in Yemen. In 1988, the Central Intelligence Agency did discover that Riyadh bought SS-2 medium-range missiles from China but only after the deal was sealed. In 2003, when China exported DF-21 ballistic missiles to the Kingdom, the CIA again found out and was even allowed to verify the missiles were not nuclear-capable, but only after the missiles were delivered.

Several years later, when intelligence finally leaked out that China secretly built missile factories for the Saudis, the Trump administration was mum on whether there was an intelligence failure and allowed speculation that it had blessed the transaction. Then, in 2020, when US intelligence confirmed China was helping the Kingdom mill uranium domestically, it did so, again only after the mining and milling were well underway.

This track record of studied inadvertence, then, brings us to the next worry: MBS wants Washington to green-light the Kingdom enriching uranium…

In an interview yesterday on Fox, Trump divulged that the Iranian ‚revenge strikes‘ against the US airbase in northern Iraq 4 years ago were ‚arranged‘ with Iran such that no US troops would be killed, AND that the plan to whack General Soleimani was entirely Netanyahu‘s but that he ‚pulled Israel out‘ of actively participating in the assassination just 2 days beforehand.

Such is modern warfare. It‘s all ‚your proxy force against mine‘, and theatrical ‚force-posturing‘ because, if any real war were to break out between countries with sizable arsenals, the global economy would be wrecked.

Relevant transcript, on Iran telling the US exactly where and when they would strike the US base in northern Iraq:

„I had Iran in check. We hit them very hard [via the assassination of Soleimani], and they had to hit back, I understand that.

Do you know they called me to tell me they‘re going to hit a certain location [at al-Asad airbase], it‘s gonna be outside the perimeter.

They let us know. We had 16 missiles [targeting the base]. They said ‚don‘t move, we‘re going to have to hit you back‘.

Psychologically, they had to do that because we hit them. So they aimed those missiles [outside the base] and said ‚please don‘t attack us, we‘re not gonna hit you‘.“

And, on Israel backing out of the plot:

„When we took out Soleimani, you know, Israel was supposed to do it with us. Two days before the takeout, they said, ‚We can‘t do it, we can‘t do it.‘

I said, ‚What? We can‘t do it?‘

Then I had a certain general, who‘s great, and I said, ‚So, General, do we do it ourselves?‘

He said, ‚We can, sir, it‘s up to you.‘ I said, ‚We‘ll do it.‘

Die genau zu diesem Zweck exekutierte psychologische Kriegführung gegen die Bevölkerung setzt sich bis heute praktisch ohne Widerstand politisch links stehender Kräfte fort. Die Logik des Terrorkrieges (Behauptungen von Behörden / Autoritäten darf nicht widersprochen und muss alles abgekauft werden) wird von den Betreffenden weiter willig geschluckt.

Weder hinsichtlich der Tanker-Explosionen im Golf von Oman, nach der bereits das U.S.-Imperium einen “globalen Konsens” gegen den Iran beanspruchte, noch nach dem Abschuss einer U.S.-Spionage-Drohne an der Straße von Hormuz, welcher offensichtlich nach einer absichtlichen Luftraumverletzung des Iran und mehrfachen direkten Vorwarnungen durch das iranische Militär erfolgte und in dem das U.S.-Zentralkommando – nach glaubwürdigen Angaben des iranischen Militärs, mit Details zum Flugzeugtyp (eine Boeing P8 Poseidon) und sogar zur Anzahl der Insassen – auch das Leben von 35 Militärangehörigen an Bord eines begleitenden Kampfflugzeuges gezielt und bewusst als Bauernopfer für die angestrebte Eskalation anbot, erfolgte irgendeine nennenswerte Reaktion in Deutschland; nicht aus dem angeblich oder tatsächlich pazifistischen, sozialdemokratischen oder linken Spektrum, noch aus irgendeinem zuständigen parlamentarischen Gremium.

The United States and the Kingdom of Saudi Arabia (KSA) have for over a decade negotiated without success the terms of an agreement for peaceful nuclear cooperation. These negotiations have intensified recently in the context of US efforts to broker a normalisation agreement between the KSA and Israel, which have included discussions about how the US could solidify its own support for Saudi Arabia. On the 7th of October 2023, Hamas terrorists appeared to drive a stake through the heart of the US effort to broker Israel-KSA normalisation. This has sent shockwaves through the region, and the full implications remain uncertain. However, it seems likely that in the longer run, rationales for normalisation and for US nuclear engagement with Riyadh will remain, reflecting the fact that the Hamas attacks underscored that a future nuclear-armed Iran would be a yet more formidable adversary for both Israel and the KSA.

However, the inaccuracy of those missiles means that they are only suitable for large targets such as cities and would be ineffective with anything less than a nuclear warhead.

Als vor dreieinhalb Jahren Pazifisten, Sozialdemokraten und politische Linke in Deutschland der Entsendung der staatlichen Luftwaffe in die Kriege im Irak und Syrien tatenlos zusahen, warnten wir bereits vor deren moralisch-politischem Zusammenbruch und Kapitulation. Die genau zu diesem Zweck exekutierte psychologische Kriegführung gegen die Bevölkerung setzt sich bis heute praktisch ohne Widerstand politisch links stehender Kräfte fort. Die Logik des Terrorkrieges (Behauptungen von Behörden / Autoritäten darf nicht widersprochen und muss alles abgekauft werden) wird von den Betreffenden weiter willig geschluckt.

Weder hinsichtlich der Tanker-Explosionen im Golf von Oman, nach der bereits das U.S.-Imperium einen “globalen Konsens” gegen den Iran beanspruchte, noch nach dem Abschuss einer U.S.-Spionage-Drohne an der Straße von Hormuz, welcher offensichtlich nach einer absichtlichen Luftraumverletzung des Iran und mehrfachen direkten Vorwarnungen durch das iranische Militär erfolgte und in dem das U.S.-Zentralkommando – nach glaubwürdigen Angaben des iranischen Militärs, mit Details zum Flugzeugtyp (eine Boeing P8 Poseidon) und sogar zur Anzahl der Insassen – auch das Leben von 35 Militärangehörigen an Bord eines begleitenden Kampfflugzeuges gezielt und bewusst als Bauernopfer für die angestrebte Eskalation anbot, erfolgte irgendeine nennenswerte Reaktion in Deutschland; nicht aus dem angeblich oder tatsächlich pazifistischen, sozialdemokratischen oder linken Spektrum, noch aus irgendeinem zuständigen parlamentarischen Gremium.

More terrible than any of that is the blindingly obvious danger that providing nuclear expertise to Riyadh will push Iran, their sworn enemy and regional rival, into developing its own nuclear capabilities. Supposedly the whole point of Trump’s campaign of threats and sanctions is to deter Tehran from doing just that. To provoke Iran in this fashion is astonishingly stupid – and hypocritical.

It is simply not good enough to say that two planned Saudi reactors, for which multibillion dollar tenders will be sought next year, are intended for civilian, not military use. So far at least, Riyadh has reportedly refused to offer standard guarantees that it will eschew uranium enrichment and plutonium reprocessing, two well-worn pathways to nuclear weapons, or accept independent inspections.

The Donald Trump administration has granted permission to unspecified US companies to sell nuclear technology to Saudi Arabia and provide technical assistance, US Energy Secretary Rick Perry told the Senate Armed Services Committee on Thursday.

The companies have asked the administration to keep the approvals secret.

The oil-rich kingdom is set to build at least two nuclear power plants, with several countries, including the US, South Korea, and Russia, all vying for the project. However, Crown Prince Mohammed bin Salman has also stated that his country would also seek to develop nuclear weapons if its Iranian rivals obtained it.

In it, more than 2.8 million people are described as having security clearance as of October 2017 – more than 1.6 million have access to either Confidential or Secret information and nearly 1.2 million are described as having access to Top Secret information.

Das Heimatschutz-Ministerium hat Verträge mit 318 Konzernen, von denen allein 19 sich ausschließlich mit der Rekrutierung neuer Vertragsnehmer beschäftigen.

– 56 Firmen im Spionage-Komplex sind nur damit beschäftigt, ständig neue Linguisten, Sprachwissenschaftler und Dolmetscher zu rekrutieren. – Bei der CIA sind von (offiziell) 30.000 Personalstand 10.000 Personen externe, nichtstaatliche Vertragsnehmer aus sage und schreibe 114 Firmen. Viele von ihnen sind nur für zeitlich begrenzte Jobs oder Operationen an Bord und kommen aus der Militärspionage.

Die CIA ist das Beispiel für eine Regierungsagentur, welche nicht mehr ohne dieses kommerzielle Hilfspersonal auskommt, obwohl gerade sie Operationen durchführt, die keiner anderen Behörde gesetzlich erlaubt ist.

It is also a system in which contractors are playing an ever more important role. The Post estimates that out of 854,000 people with top-secret clearances, 265,000 are contractors. There is no better example of the government‘s dependency on them than at the CIA, the one place in government that exists to do things overseas that no other U.S. agency is allowed to do.

The 2001 Authorization for Use of Military Force: A Comprehensive Look at Where and How it Has Been Used

Just days after the 9/11 attacks on the United States, the U.S. Congress passed the 2001 Authorization for Use of Military Force (AUMF). Section 2(a) of the 2001 AUMF authorizes the President “to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States.” Under this AUMF, Congress relinquished its constitutionally assigned war powers in the fight against “terrorism,” ceding to the president its responsibility to decide whether, when, and where the United States chooses war. The 2001 AUMF is still in effect today.

The president must report to Congress within 48 hours a situation in which U.S. forces are introduced into “hostilities” or “imminent hostilities.”3 This is mandated by the 1973 War Powers Resolution, established by Congress in the final stages of the Vietnam War to forestall any president from taking the country to war without congressional authorization or awareness. Since the passing of the 2001 AUMF, the Bush, Obama, Trump, and Biden administrations have referenced this authorization in their reporting to Congress on U.S. military hostilities in a growing number of countries to fight a growing
number of militant groups, including Al Qaeda and other groups that government officials subsequently identified as arising from it, including the Islamic State of Iraq and Syria (ISIS) and al-Shabaab in Somalia. All four administrations have cited the 2001 AUMF while using vague language to describe the locations of operations, failing to accurately describe the full scope of activities in many places, and in some cases simply failing to report on counterterrorism hostilities.

– den versuchten Aufbau einer “Totalen Informationskenntnis” (“Total Information Awareness”) über alle Menschen, Gruppen, Strömungen und Organisationen im Macht- bzw Einflussbereich der U.S.A. (also dem, was die Gesellschaft heute als “Totalüberwachung” versteht),

– die folgende Erschaffung eines informationstechnologischen, Privatleben fressenden Frankensteins, eines weltweit vernetzten Golem der “Nationalen Sicherheit AG” bzw dem “sicherheitsindustriellen Komplex”, der allein 800.000 Personen (Stand: 2010) Zugang zu “streng geheimen” Informationen und damit Zugang zu praktisch allen u.a. aus Telekommunikationssystemen wie dem Internet gesammelten bzw geraubten Daten von Bürgerinnen und Bürgern in ungezählten Datenbanken und Tauschbörsen der Spione, Militärs und (Geheim)Polizeien und Behörden allein in den U.S.A. gibt, samt einer bis heute nicht verifizierten Zahl assoziierter Kräfte und Stellen, z.B. in der Republik Deutschland,

– die Errichtung des Lagers Guantanamo, sowie einer unbekannten Zahl geheimer Folterkammern und Kerker auf eigenem Territorium, in Besatzungszonen und / oder in kollaborierenden Staaten, in denen Menschen willkürlich eingesperrt, gequält oder ermordet wurden,

sowie weitere offene oder klandestine Maßnahmen, wie z.B. die “Uminterpretation” von geltendem Recht zu faktischem geheimen Kriegsrecht in ungezählten Staaten, ist ein am 14. September 2001 bei alleiniger Gegenstimme von Barbara Lee durch den Kongress gejagter und, zumindest in der Geschichte der Vereinigten Staaten von Amerika, präzedenzloser Gesetzestext: die “Authorization for Use of Military Force”.

Die “Authorization For Use of Military Force” vom 14. September 2001 im Wortlaut

Hier dessen gerade einmal 60 Worte und keinerlei zeitliche oder räumliche Einschränkung enthaltende Wirkungstext, beschlossen am 14.09.2001 von beiden Kammern des Kongresses, Repräsentantenhaus und Senat:

„Dass der Präsident autorisiert ist, alle notwendige und geeignete Gewalt gegen diejenigen Nationen, Organisationen, oder Personen anzuwenden, die er bestimmt als diejenigen, welche die terroristischen Angriffe, die sich am 11. September ereigneten, geplant, autorisiert, begangen, oder unterstützt haben, oder solche Organisationen oder Personen beherbergt haben, um jede zukünftigen Akte von internationalen Terrorismus gegen die Vereinigten Staaten durch solche Nationen, Organisationen oder Personen zu verhindern.“

Im Original:

„That the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.

Analyse und Anmerkungen:

Auch wenn z.B. für die Eroberung des Irak eine eigene Kriegsvollmacht, eine „Authorization for Use of Military Force“ in 2002 erlassen wurde, war die A.U.M.F. vom 14.09.2001 auch im Irak-Krieg, als einem durch die U.S.-Regierung selbst so formulierten Sieg im „war on terror“, Kern von dessen Legitimation.

Wie jeder lesen kann, tauchen in der A.U.M.F. vom 14. September 2001 die Begriffe „Al Kaida“ (al qaida, Al Qaeda, etc, etc) und „Osama Bin Laden“ nicht auf. Deren Verantwortung für die Attentate vom 11. September erklärte der damalige Präsident George Bush Junior erst am 20. September in seiner Rede vor dem Kongress. (DIE CHRONIKEN VON KUNDUZ (II): “…und die Nacht fiel auf eine andere Welt”)

Nach Einschätzung einer ganzen Reihe hochrangiger Terrorexperten gab es zu diesem Zeitpunkt keine internationale Organisation „Al Kaida“. Eine kriminelle Organisation dieses Namens hatte das Federal Bureau of Investigation (F.B.I.) unter Direktor Robert Mueller erst im Frühjahr 2001 in einem Gerichtsverfahren attestieren lassen, unter Berufung auf Aussagen des U.S.-Informanten und Betrügers Jamal al-Fadl (Dschamal al-Fadl), der dafür von den U.S.-Behörden eine enorme Summe Geld kassierte.

Die A.U.M.F. vom 14. September 2001 gab und gibt dem Präsidenten der Vereinigten Staaten die Ermächtigung selbst zu bestimmen, wer für die Attentate des 11. Septembers direkt oder indirekt verantwortlich und entsprechend militärischer Gewalt der U.S.-Streitkräfte ausgesetzt werden soll.

Es handelt sich bei der A.U.M.F aus 2001 also um eine Ermächtigung zur perpetuierten Kriegführung bzw eines perpetuierten Krieges ohne festgelegten, bzw nach Ermessen des Präsidenten wechselnden und / oder austauschbaren Gegner.

Barack Obama selbst verwendete den Schlüsselbegriff “perpetual war” sowohl am 23. Mai 2013 in Fort McNair, als er ein Ende des Terrorkrieges in Aussicht stellte (“Dieser Krieg, wie alle Kriege, muss enden”), als auch bei seiner von Niemand verstandenen Rede am 19. Juni 2013 in Berlin.

Initially enacted as a provisional authority in 2004 and subsequently codified in 2016, § 127e allows U.S. forces to “provide support” to foreign militaries, paramilitaries, and private individuals that are “supporting” U.S. counterterrorism operations.

The kinds of support that U.S. forces may give and receive are not defined in § 127e. But the Department of Defense sought § 127e from Congress so that U.S. forces would have the ability to recruit, train, equip, and pay the salaries of foreign militaries, paramilitaries, and private individuals that would assist the United States in combating terrorism. According to Maj. Gen. J. Marcus Hicks, the former head of Special Operations Command Africa, putting these partners on payroll would give U.S. forces “full incentive authority” over them and enable U.S. forces to “command and control” them on missions.
