Verordnung zur Änderung der Verordnung über erforderliche Maßnahmen zur Eindämmung der Ausbreitung des neuartigen Coronavirus SARS-CoV-2 in Berlin
(SARS-CoV-2-Eindämmungsmaßnahmenverordnung – SARS-CoV-2-EindmaßnV)

Aufgrund des § 32 Abs. 1 des Infektionsschutzgesetzes vom 20. Juli 2000 (BGBl. I S. 1045), das zuletzt durch Artikel 3 des Gesetzes vom 27. März 2020 (BGBl. I S. 587) geändert worden ist, verordnet der Senat:
Artikel 1 – Änderung der SARS-CoV-2-Eindämmungsmaßnahmenverordnung

Die SARS-CoV-2-Eindämmungsmaßnahmenverordnung vom 22. März 2020, verkündet am 22. März 2020 nach § 2 Absatz 1 des Gesetzes über die Verkündung von Gesetzen und Rechtsverordnungen vom 29. Januar 1953 (GVBl. S. 106), das zuletzt durch Gesetz vom 9. November 1995 (GVBl. S. 764) geändert worden ist, berichtigt am 24. März 2020 (GVBl. S. 224), wird wie folgt neu gefasst:
1. Teil Bestimmungen für Veranstaltungen und Einrichtungen des gesellschaftlichen Lebens
§ 1 Veranstaltungen, Versammlungen, Zusammenkünfte und Ansammlungen

(1) Öffentliche und nichtöffentliche Veranstaltungen, Versammlungen, Zusammenkünfte und Ansammlungen dürfen nicht stattfinden.

(2) Vom Verbot des Absatzes 1 ausgenommen sind Veranstaltungen und Zusammenkünfte, einschließlich Sitzungen des Deutschen Bundestages und seiner Ausschüsse, des Bundesrates und seiner Ausschüsse, des Abgeordnetenhauses und seiner Ausschüsse, der Bundesregierung, des Senats von Berlin, des Verfassungsgerichtshofes von Berlin, der Bezirksverordnetenversammlungen und ihrer Ausschüsse sowie der Auslandsvertretungen, der Gerichte, der Gremien und Behörden von Bund und Ländern sowie anderer Stellen und Einrichtungen, die öffentlich-rechtliche Aufgaben wahrnehmen.

(3) Ebenso ausgenommen sind Veranstaltungen und Zusammenkünfte, die der Aufrechterhaltung der öffentlichen Sicherheit und Ordnung, der öffentlich-rechtlichen Leistungserbringung, der Versorgung und der Gesundheitsfürsorge der Bevölkerung, der Aufrechterhaltung des Betriebs von Wirtschaftsunternehmen, der Erfüllung von personalvertretungsrechtlichen Aufgaben oder der Arbeit von Betriebsräten dienen.

(4) Nicht erfasst von dem Verbot des Absatzes 1 ist der außerhäusliche Aufenthalt mehrerer Personen im Sinne von § 14 Absatz 3 Buchstabe i. Ausgenommen vom Verbot von Absatz 1 sind zudem Veranstaltungen und Zusammenkünfte im privaten oder familiären Bereich von bis zu 10 Personen, sofern diese aus zwingenden Gründen erforderlich sind. Hiervon erfasst sind insbesondere die Begleitung Sterbender und Trauerfeiern.

(5) Unvermeidbare Zusammenkünfte und Ansammlungen anlässlich der nach dieser Verordnung zugelassenen Tätigkeiten, insbesondere bei der Nutzung des öffentlichen Personennahverkehrs, sind ebenfalls vom Verbot des Absatzes 1 ausgenommen.

(6) Bei den nach Absatz 4 vom Verbot ausgenommenen Veranstaltungen und Zusammenkünften sind die anwesenden Personen in einer Anwesenheitsliste zu erfassen, die mindestens die folgenden Angaben enthalten muss: Vor- und Familienname, vollständige Anschrift und Telefonnummer. Die Anwesenheitsliste ist für die Dauer von vier Wochen nach Ende der Veranstaltung aufzubewahren und der zuständigen Behörde auf Verlangen vollständig auszuhändigen

(7) Für Versammlungen unter freiem Himmel von bis zu 20 Teilnehmenden kann die Versammlungsbehörde in besonders gelagerten Einzelfällen auf Antrag Ausnahmen vom Verbot des Absatz 1 zulassen, sofern dies im Einzelfall aus infektionsschutzrechtlicher Sicht vertretbar ist. Das zuständige Gesundheitsamt ist fachlich an der Entscheidung nach Satz 1 zu beteiligen.

The Department of Health and Human Services said Sunday hydroxychloroquine and chloroquine products can be distributed and prescribed by doctors through the Strategic National Stockpile “to hospitalized teen and adult patients with COVID-19, as appropriate, when a clinical trial is not available or feasible.”

HHS said Germany’s Sandoz has already given 30 million doses of hydroxychloroquine to the Strategic National Stockpile, the federal government’s inventory of medical supplies for public health emergencies, while Bayer has donated a million doses of chloroquine.
