Re: Urgent Request for Access to and Information Regarding Immigrants Transferred from the United States and Detained at Guantánamo Bay

Dear Secretary Noem, Secretary Hegseth, and Secretary Rubio:
We write on behalf of the undersigned immigrants‘ rights and civil rights organizations to request immediate access to the noncitizens transferred from immigration detention facilities in the United States and currently detained at the U.S. Naval Base at Guantánamo Bay, Cuba.

Since February 4, 2025, the government has transferred nearly two dozen noncitizens to Guantánamo, without providing any information about their circumstances or the government’s legal authority for these unprecedented actions. The government has also announced that it is planning to send tens of thousands of additional immigration detainees to Guantánamo in the near future.

The Constitution, and federal and international law prohibit the government from using Guantánamo as a legal black hole. We therefore request that the government provide our organizations access to the noncitizens detained at Guantánamo so that those individuals will have access to legal counsel, and so advocates and the public can understand the conditions
under which the government is detaining them. We also request basic information that the public has a right to know regarding the noncitizens being sent to Guantánamo and the government’s plans for them.

In the last 21 days, more than a dozen lawsuits have been filed alleging that the administration’s actions violate the rule of law and are contrary to the Constitution or laws of the United States. The list grows longer every day.

These actions have forced affected parties to seek relief in the courts, which stand as a bulwark against these violations. We support our courts who are treating these cases with the urgency they require. Americans know there is a right way and a wrong way to proceed. What is being done is not the right way to pursue the change that is sought in our system of government.

These actions do not make America stronger. They make us weaker.

Petition to the UN General Assembly: unseating Israel is the only way to preserve the integrity of the international legal system.

Israel systematically infringes its duties towards the UN repeatedly violating the protections afforded to UN bodies such as the UNRWA and UNIFIL. This includes causing the death of UN workers, and bombing UN facilities. Furthermore, it resolutely refuses to engage with UN Mechanisms by not allowing visits from the UN Secretary-General, UN Special Rapporteurs, and the UN Independent Commission of Inquiry, among others. Within the halls of the UN, Israel also repeatedly issues defamatory statements against the organisation. These actions reflect a complete disregard for UN systems and are in breach of international law.

Israel’s systematic denial of the Palestinian people’s right to self-determination and relentless appropriation of Palestinian land have led to a critical, historical juncture in which the Israeli state is pursuing genocide and ethnic cleansing against the Palestinians with ruthless, unprecedented force and determination. The very existence of the Palestinian people hinges on ending Israeli impunity and, at long last, realizing their right to control their own political, social, and economic destiny. Additionally, the gravity of the illegalities caused by Israel has raised serious questions about the legitimacy of the international legal system as a whole, threatening its continued integrity.

The General Assembly and its Member States can and must take meaningful action on both fronts —the right of the Palestinian people to self-determination and the integrity of the international legal system—without delay by unseating the Israeli government from the Assembly, in accordance with the Assembly’s authority to approve the credentials of Member State delegations.

Unseating a state government’s delegation is an exceptional action, but , in this case, it is grounded in precedent—specifically, the unseating of South Africa’s apartheid government from the General Assembly in 1974—and in law. Fifty years ago, the General Assembly exercised its authority under the credentialing rules to unseat South Africa’s delegation, concluding that the government was unrepresentative and therefore illegitimate due to its failure to provide representation to its indigenous Black population. Even though South Africa’s apartheid practices were central to this decision, the removal of the South African delegation was also implicitly grounded in the right of self-determination, which was denied to the country’s Black population by the very nature of apartheid.

As demonstrated by the ICJ’s July 19, 2024 advisory opinion on the legal consequences of Israel’s policies and practices in the OPT, the case for unseating Israel’s government for lack of representativeness is just as strong as it was in the case of South Africa, if not stronger.

Accountability Now: Palestinians Sue German Government officials for Enabling the Genocide in Gaza

Today, a group of German lawyers – representing families of two Gazans – is filing a criminal complaint against German Government officials[1], for the crime of aiding and abetting genocide against the Palestinian people in Gaza by providing Israel with weapons and issuing related export permissions. They are supported by civil society organisations ELSC (European Legal Support Center), PIPD (Palestine Institute for Public Diplomacy) and Law for Palestine under the Justice and Accountability for Palestine Initiative. The charges are being filed at the Office of the Federal Prosecutor in Karlsruhe (‘Generalbundesanwaltschaft’).

In a historic ruling on 26 January 2024 in the case filed by South Africa against Israel for the crime of Genocide, the International Court of Justice (ICJ) ordered provisional measures against the “serious risk” of genocide and stated that the latter is “plausibly taking place”.

Hamouri, a lawyer and a field researcher with the Addameer Prisoners’ Support and Human Rights Association, spent more than eight years in Israeli prisons, starting when he was abducted in 2001 and was sentenced to five months in prison. In 2004 he spent four months under arbitrary Administrative Detention orders without charges, then was abducted again in the year 2005 and was imprisoned for seven years, and then in the year 2017, he was abducted yet another time and spent 13 months under Administrative Detention orders, and upon his release, he received an order barring him from entering the rest of the West Bank for two years.

On June 6, 2022, Salah received another three-month Administrative Detention order just hours before his scheduled release after being imprisoned for three months under a similar order. The decision to revoke his residency was made in October of last year, 2021, after accusing him of “breeching loyalty to the state” for his human rights and legal work in defending Palestinian political prisoners.

Hamouri was born to a Palestinian father from Jerusalem where he grew up and lived, and his mother is a French national. Several years earlier, Israel deported his French wife, Elsa Lefort, to her country after detaining her at the airport in Tel Aviv for three days when she returned to Jerusalem. The lawyer and his wife have two children.

Palestinians born in occupied Jerusalem are only granted “residency status” and not citizenship of Israel despite Israel’s constant claims of “unified Jerusalem as its capital.”

The Defense Department has cited two sources of authority for engaging in combat through and with 127e proxies: the 2001 Authorization for Use of Military Force, or AUMF—the authority for the United States’s endless “war on terror”—and the president’s constitutional prerogative to engage in “self-defense,” defined expansively by executive branch lawyers.

The Defense Department could cite similar authorities for the use of 1202 proxies. Although no AUMF was designed to counter Iran, North Korea, Russia, or China, the executive branch believes it has the authority to engage these countries militarily.

The Group’s April 2022 complaint details the systematic targeting of Palestinian journalists on behalf of four named victims – Ahmed Abu Hussein, Yaser Murtaja, Muath Amarneh and Nedal Eshtayeh – who were also killed or maimed by Israeli snipers while covering demonstrations in Gaza. All were wearing clearly marked PRESS vests at the time they were shot. The complaint also details the targeting of media infrastructure including the bombing of the Al-Shorouk and Al-Jawhara Towers in Gaza City in May 2021.

Armas: Liberum ist als Antwort auf die Gesundheitsdiktatur entstanden, wie wir die aktuelle Situation interpretieren. Im Justizwesen liegt einiges im Argen. Das spüren mittlerweile selbst jene Bürger, die vor 2020 mit der Justiz kaum in Berührung kamen. Volksbegehren

In den nächsten Tagen werden wir ein Volksbegehren initiieren, bei dem die Gesellschaft die Möglichkeit hat, sich aktiv gegen die angedrohte Impfpflicht auszusprechen. Hier geht es nicht nur um die Rechte jener, die noch nicht geimpft sind, sondern auch um die Rechte der Genesenen, die dieser Impfpflicht ebenso unterworfen werden, wie auch die Geimpften deren Impfschutz in absehbarer Zeit wieder abnehmen wird.

Es ist ein Volksbegehren mit dem Zweck der Vereinigung der durch die Politik bewusst gespaltenen Gesellschaft und ist ein starkes Zeichen für die Selbstbestimmung des Einzelnen.

5. Dabei übersieht Karlsruhe die historischen Erfahrungen, die 1949 dazu führten, derartige Ausgangssperren zu verbieten.

6. Karlsruhe setzt keine „roten Linien“. Es wird aus der gesamten Entscheidung nicht erkennbar, wie weit denn der Gesetzgeber bei der Corona-Politik gehen darf. Ein Freifahrtschein für die Regierenden.
