12 suspended Columbia students reinstated just days after anti-Israel protest, as lawyer vows to take ‘fascist’ school to NY Supreme Court

“Speech, no matter how unpopular it may be, is the essence of academia. Protest against Zionism in Israel is pure protected speech. … If Jewish students are made uncomfortable by it, f— them!” Cohen, who was raised in an Orthodox Jewish home, told the Village Sun.

“Speech is supposed to make you uncomfortable. This is not lighting candles and kumbaya. … All speech is protected unless the imminent intent is to commit violence — like shouting ‘Fire!’ in a crowded movie theater,” he added. (…)

“I got f—ing suspended from Columbia 50 years ago. I got thrown out of Columbia after a week for anti-war protesting,” he lamented.

“Columbia is fascist,” he said.

South Africa to Sue US and UK as Complicit in Gaza Genocide

(January 15, 2024)

The United States must now be held accountable for the crimes it committed,‘ says Van Rensburg, who is leading the 47-lawyers team.

“We intend to bring legal proceedings against the U.S. Government based on overwhelming evidence that the U.S. Government has, and is, aiding, abetting and supporting, encouraging or providing material assistance and means to Israel and the Israeli Defense Forces. This conduct by the U.S. Government has enabled and continues to enable Israel to engage in international crimes against the Palestinian people,” the South African lawyers said in a letter sent to US President Joe Biden on January 2.

In the early 1990s, the U.S. government sanctioned Bigio, his wife, son and others for their support of a military coup that ousted Haiti’s first democratically elected president. Years later, a member of a Haitian militia ‒ or private army ‒ accused Bigio and another businessman of paying for the 1993 assassination of a prominent democracy activist, according to Jeb Sprauge, author and University of California Riverside research associate. Authorities in Haiti did not charge Bigio with or accuse him of wrongdoing.

Accountability Now: Palestinians Sue German Government officials for Enabling the Genocide in Gaza

Berlin – 23 February 2024

Today, a group of German lawyers – representing families of two Gazans – is filing a criminal complaint against German Government officials[1], for the crime of aiding and abetting genocide against the Palestinian people in Gaza by providing Israel with weapons and issuing related export permissions. They are supported by civil society organisations ELSC (European Legal Support Center), PIPD (Palestine Institute for Public Diplomacy) and Law for Palestine under the Justice and Accountability for Palestine Initiative. The charges are being filed at the Office of the Federal Prosecutor in Karlsruhe (‘Generalbundesanwaltschaft’).

In a historic ruling on 26 January 2024 in the case filed by South Africa against Israel for the crime of Genocide, the International Court of Justice (ICJ) ordered provisional measures against the “serious risk” of genocide and stated that the latter is “plausibly taking place”.

German lawyers file genocide complicity case against German Chancellor Olaf Scholz

German lawyers representing Gaza Palestinian families have filed a criminal complaint against German officials – including Chancellor Olaf Scholz – for supplying Israel with weapons that they say aid and abet Israel‘s ongoing genocide in their homeland.

Prosecutors from the Federal Prosecutor‘s office in Karlsruhe will examine the case, and if it goes ahead will open an investigation and question government officials including Chancellor Olaf Scholz, Vice Chancellor Robert Habeck, and Federal Minister for Foreign Affairs Annalena Baerbock, Minister of Finance Christian Lindner, and members of the Bundessicherheitsrat, the government body that authorizes Germany‘s arms export licenses.

33. The only State besides Fiji to defend Israel is the United States. This is not surprising. Whatever offences against international law Israel commits, the United States comes forward to shield it from accountability. Here, the United States attempts to defend Israel, not by arguing that the occupation is lawful, but that it is neither lawful nor unlawful. To reach this conclusion, the United States argues that belligerent occupation is governed exclusively by international humanitarian law and not by the United Nations Charter or general international law. In its own words: “Although international humanitarian law imposes obligations on belligerents in their conduct of an occupation, it does not provide for the legal status of an occupation to be lawful or unlawful.“

Palestinian Lawyer Salah Hamouri is to be Deported to France on Sunday

(01.12.2022)

Hamouri, a lawyer and a field researcher with the Addameer Prisoners’ Support and Human Rights Association, spent more than eight years in Israeli prisons, starting when he was abducted in 2001 and was sentenced to five months in prison. In 2004 he spent four months under arbitrary Administrative Detention orders without charges, then was abducted again in the year 2005 and was imprisoned for seven years, and then in the year 2017, he was abducted yet another time and spent 13 months under Administrative Detention orders, and upon his release, he received an order barring him from entering the rest of the West Bank for two years.

On June 6, 2022, Salah received another three-month Administrative Detention order just hours before his scheduled release after being imprisoned for three months under a similar order. The decision to revoke his residency was made in October of last year, 2021, after accusing him of “breeching loyalty to the state” for his human rights and legal work in defending Palestinian political prisoners.

Hamouri was born to a Palestinian father from Jerusalem where he grew up and lived, and his mother is a French national. Several years earlier, Israel deported his French wife, Elsa Lefort, to her country after detaining her at the airport in Tel Aviv for three days when she returned to Jerusalem. The lawyer and his wife have two children.

Palestinians born in occupied Jerusalem are only granted “residency status” and not citizenship of Israel despite Israel’s constant claims of “unified Jerusalem as its capital.”

House’s ‘Irregular Warfare’ Provision Risks Unintended War

Under both 127e and 1202, the use of proxy forces must support “authorized” U.S. military operations. The Defense Department has cited two sources of authority for engaging in combat through and with 127e proxies: the 2001 Authorization for Use of Military Force, or AUMF—the authority for the United States’s endless “war on terror”—and the president’s constitutional prerogative to engage in “self-defense,” defined expansively by executive branch lawyers.

The Defense Department could cite similar authorities for the use of 1202 proxies. Although no AUMF was designed to counter Iran, North Korea, Russia, or China, the executive branch believes it has the authority to engage these countries militarily.
