US officials raise concerns over Israeli intelligence after Hamas attacks

(October 7, 2023)

Other US officials familiar with the matter said if the US did have intelligence suggesting an upcoming attack, it would have undoubtedly shared that information with Israel.

The Israelis historically have had dominant capabilities to monitor communications in Gaza. The Israelis also have some of the best capabilities to break into encrypted communications, US officials say.

That’s partly the reason why US officials were shocked that preparation for Saturday’s attacks weren’t detected.

U.S. Used Front Company to Buy Israeli NSO’s Spyware, Report Says

The Times’ investigation, published early Monday, revealed that five days after the Biden administration announced the blacklisting of NSO for activities contrary to the United States’ national security or foreign policy interests, the U.S. purchased a different software from NSO via a front company.

The software is known as “Landmark,” a geolocation system that reveals the exact location of a person by inputting their phone number.

The report comes one week after U.S. President Joe Biden signed an executive order banning the use of commercial spyware by the American government.

Schon vor zwei Jahren wurde bekannt, dass US-Diplomaten auf der Zielliste von Pegasus standen.

Was die Anordnung Bidens nicht verbietet: All die Hacking-Tools, die US-Behörden selbst entwickeln. Und Staatstrojaner von Herstellern, die noch nicht in autoritären Regimen gefunden wurden und die die USA als vertrauenswürdig einstufen.

„Die Akte Pegasus“ der beiden Forbidden-Stories-Journalist:innen ist spannend wie ein Krimi. Und zugleich ein großartiges Plädoyer für die Kraft des investigativen Journalismus. Detailliert beschreiben sie ihre Herangehensweise an eine Recherche, die zum Schluss dutzende Medien in zahlreichen Staaten zusammenschließt und viele Opfer unter den Telefonnummern identifiziert.

Dabei ist das keine herkömmliche Recherche. Es gibt am Anfang nur Telefonnummern aus vielen Staaten und die Personen dahinter müssen identifiziert werden. Gleichzeitig ist stets zu befürchten, dass die Opfer immer noch über ihre Kommunikationswege überwacht werden. Zum Schluss decken sie auf, dass zahlreiche Politiker:innen unter den Opfern sind, aber noch viel mehr Journalist:innen.

Die beiden Autor:innen geben eindrucksvolle Einblicke in die Schicksale vieler betroffener Medienschaffender und ihre jeweiligen individuellen Situationen in ihren Ländern, wo sie wegen ihrer Arbeit mit Repression zu kämpfen haben und gleichzeitig totalüberwacht werden.

In ´t Velds Wut richtet sich auch auf die EU-Kommission, der sie Doppelmoral und Untätigkeit unterstellt. Wenn es um die Bedrohung der Demokratie in den USA geht, wie jüngst nach der Twitter-Übernahme durch Elon Musk, nehme die Kommission kein Blatt vor dem Mund, sagt sie mit Verweis auf die Äußerungen des Binnenkommissars Thierry Breton. Doch gehe es um Angriffe von innen, gelte die Verteidigung der Demokratie plötzlich als Angelegenheit der Staaten. „Der Kommissar zeigt Musk seine Muskeln, aber fasst Mitgliedstaaten mit Samthandschuhen an, die Spionagesoftware gegen ihre Bürger:innen einsetzen.“

Sophie in ’t Veld, Berichterstatterin im Ausschuss, war bei ihrem Auftritt sichtlich verärgert. Der Ausschuss sei sich bewusst, dass so gut wie alle EU-Mitgliedstaaten Staatstrojaner einsetzten. In einigen Staaten geschehe das jedoch nicht, um die Sicherheit der Bürger:innen zu schützen, sondern richte sich gegen die eigenen Bürger:innen. Spionagesoftware sei hier zu einem Werkzeug autoritärer Regierungen geworden.

„Ich habe den Eindruck, die nationale Sicherheit ist eine Tür zu einem Raum der Gesetzlosigkeit geworden“, sagte in ’t Veld, „in dem nationale Regierungen sagen können: Ab hier gelten eure Regeln nicht mehr und die EU hat nichts mehr zu sagen.“ Sie forderte von der EU-Kommission, in solchen Fällen härter durchzugreifen. Gleiches gelte für Europol: Wenn Mitgliedstaaten die Behörde nicht von sich aus zur Mithilfe bei Ermittlungen rund um den Skandal bitten, müsste sich diese selbst einmischen.

Israeli-made Spyware Was Used to Hack Phone of Greek Ex-minister

Intellexa is run by a former Israeli military intelligence official Tal Dilian. The company was based in Cyprus until a year and a half ago, when it moved to Greece.

Predator is very similar to the infamous Pegasus spyware made by the competing and more famous cyber firm NSO Group. Like Pegasus, it allows the operator to access the entire contents of the target’s phone, as well as secretly activating its camera and phone and recording.

There seems to be a huge market for commercial spyware, and EU governments are very eager buyers. But they are very quiet about it, keeping it from the public eye.”

On 10 March 2022, the European Parliament decided to set up the PEGA Committee to investigate alleged infringement or maladministration in application of EU law in relation to the use of Pegasus and equivalent spyware surveillance software. In particular, the PEGA Committee is asked to gather information on the extent to which Member States or third countries are using intrusive surveillance to the extent that it violates the rights and freedoms enshrined in the Charter of Fundamental Rights of the EU.

During its twelve-month mandate our Committee, with its 38 Members and 38 substitute Members, will make use of various methods to investigate the alleged violations: it will hold hearings with experts, victims and other persons, request studies and briefings and undertake fact-finding missions when needed. The investigations shall be concluded with the submission of a final report.

Predator von Cytrox: Rücktritte nach Trojaner-Skandal in Griechenland

Der Netzwerk von Investigativjournalist:innen Reporters United hatte zuvor berichtet, wie ein Firmengeflecht unter Beteiligung von Dimitriadis an staatlichen Einsätzen des Trojaners mitverdient. Daran beteiligt ist die Firma Intellexa, die Predator in Griechenland vertreibt.

Weitere Brisanz erhält die Enthüllung auch dadurch, dass Dimitriadis und Mitsotakis verwandt sind: Der Generalsekretär ist der Neffe des Ministerpräsidenten, dem wiederum der Geheimdienst als Nutzer von Predator direkt untersteht.

Hersteller von Predator ist die von israelischen und ungarischen Staatsangehörigen als Aktiengesellschaft in Nordmazedonien gegründete Firma Cytrox. Sie soll in beiden Ländern Büros zur Herstellung der Cyberwaffen unterhalten. Cytrox gehört inzwischen zu einer Gesellschaft in Ungarn, als Eigentümer gilt der 70-jährige Luftwaffenveteran Meir Shamir aus Israel.

FinFisher-Vertrag: Wir haben das BKA verklagt – und gewonnen

Das BKA hat FinFisher zwar schon 2013 gekauft. Der Hersteller musste das Produkt jedoch fünf Jahre lang überarbeiten, um geltende Gesetze einzuhalten. Das BKA durfte FinFisher erst 2018 einsetzen. Im selben Jahr wurde FinFisher in der Türkei gefunden, wenige Monate danach wurde der Vertrag wieder gekündigt. Mittlerweile ist FinFisher insolvent und wird aufgelöst.

Unsere gewonnene Klage bleibt trotzdem wichtig. Letzte Woche haben wir beim BKA den Vertrag über den Staatstrojaner „Pegasus“ des israelischen Unternehmens NSO Group angefragt – und die bisherigen Gerichtsurteile direkt in der Anfrage referenziert. Wir hoffen, dass sich das BKA diesmal von Anfang an an Recht und Gesetz hält.

European Lawmaker Targeted With Israeli-made Predator Spyware

In wake of the Project Pegasus investigation, the European Parliament began checking lawmakers devices – the head of the Greek socialist party’s phone had Predator, which is produced by a firm called Cytrox, is almost identical to the infamous Pegasus spyware made by the competing and more famous cyber firm NSO Group. Predator is similar to Pegasus in terms of its capabilities, but differs in the way it infects a device: It requires the victim to click on a link, while some versions of Pegasus do not.

Cytrox is owned by a firm called Intellexa which, though currently based in Greece, is run by a former Israeli military intelligence official Tal Dilian. Though the firm is registered abroad, sources say many of its workers are Israelis and the company may even have staff in Israel. The U.S. had also moved to acquire Pegasus, The Times found. The F.B.I., in a deal never previously reported, bought the spyware in 2019, despite multiple reports that it had been used against activists and political opponents in other countries. It also spent two years discussing whether to deploy a newer product, called Phantom, inside the United States.

Israel police accused of using Pegasus spyware to hack phones of activists and civilians. An investigative report published Jan. 18 by the financial Calcalist newspaper claims that the police purchased the software in 2013, under then-Police Commissioner Yohanan Danino, and actually started using it in 2015, when former Shin Bet senior Roni Alsheikh served as police commissioner. The software allegedly served the secret police cyber brigade named Signet. The report further claims that police used Pegasus to hack phones not only of criminals but also of activists and other civilians, without court authorization or the control of a judge.
