A/80/4922 Report of the Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967, Francesca Albanese – Gaza Genocide: a collective crime

(October 20, 2025)

Summary

The ongoing genocide in Gaza is a collective crime, sustained by the complicity of influential Third States that have enabled longstanding systemic violations of international law by Israel. Framed by colonial narratives that dehumanize the Palestinians, this live-streamed atrocity has been facilitated through Third States’ direct support, material aid, diplomatic protection and, in some cases, active participation. It has exposed an unprecedented chasm between peoples and their governments, betraying the trust on which global peace and security rest. The world now stands on a knife-edge between the collapse of the international rule of law and hope for renewal. Renewal is only possible if complicity is confronted, responsibilities are met and justice is upheld.

(…)

25. Certain non-Western States have turned to international courts to seek accountability and pressurize Israel to cease its actions. While only 13 States have supported South Africa before the ICJ, most Western States have persistently denied genocide. None have joined Nicaragua against Germany at the ICJ, or invoked domestic laws against complicit corporations or individuals. Only seven referred the situation to the ICC, many sought to undermine its arrest warrants, and at least 37 States were non-committal or critical, signalling intent to evade arrest obligations.

(…)

. Military Ties: providing the means of destruction

32. While UN resolutions have called for arms embargoes on Israel since 1976, many States have continued supplying it with military support and arms transfers. Israel is disproportionately dependent on weapons imports, with the proportion of their total trade more than double the OECD average, and over four times greater than that of the United States. This international supply has continued, even as the evidence of genocide has mounted, with the United States, Germany and Italy among the largest suppliers. Only a few Western States, notably Spain and Slovenia, have cancelled contracts and imposed embargoes.

Francesca Albanese: Why I‘m accusing 63 nations of complicity in the Gaza genocide

The UN special rapporteur on the occupied Palestinian territories, Francesca Albanese, has accused major European powers, including the UK, Italy and Germany, of complicity in the genocide in Gaza and warned that their government officials should face legal consequences.

In an interview with the Expert Witness podcast on 3 November, Albanese discussed the findings of her latest report, titled Gaza Genocide: A Collective Crime, where she cited evidence of the alleged responsibility of 63 states for enabling Israeli breaches of international law.

Egypt wants US troops in Gaza as part of peacekeeping mission, officials say

Senior Egyptian officials told their US counterparts that they want the International Stabilization Force outlined in Trump’s 20-point peace plan to be modeled on the Multinational Force and Observers (MFO) that deployed to Sinai after the peninsula was returned to Egypt from Israel in 1982.

The US has led the MFO since its inception, supplying hundreds of troops as a buffer and reassurance force.

US and UK ‚immensely let down‘ families of detained Gaza flotilla activists

The families of British and American Global Sumud Flotilla activists illegally detained by Israel have told Middle East Eye that the US and UK governments have failed to properly represent their citizens.

Clare Azzougarh, the daughter of Malcolm Ducker, a 72-year-old British air force veteran who captained a boat on the flotilla and is being held in Ketziot prison, said her family feels “immensely let down by the British government in so many ways”.

Laura Adler, the sister of David Adler, a Jewish-American member of the flotilla and co-general coordinator of the Progressive International, told MEE the response of the US government had made her realise that “not everyone is deemed to be equally American”.

“I didn’t realise how non-responsive and passive the US government would be,” Laura Adler said.

UN Failed Rwanda

(December 16, 1999)

In a statement, Annan acknowledged the systematic failure of the United Nations and expressed his „deep remorse“ on behalf of the organization. Annan, who was head of UN peacekeeping operations during the genocide, commissioned the report to find out the truth about the UN role in the massacre and to learn from the mistakes. He appointed a three-man team to conduct the 6-month-long analysis, and turned over UN files, cables and archives as well as UN personnel for testimony.
(…)
The report faulted the United Nations in several key areas leading up to that date, including its failure to act on a now-famous cable sent by the force commander, Canadian Lt. Gen. Romeo Dallaire on Jan. 11, 1994 warning of the risk of genocide. The cable was received by Annan and wasn‘t shared with the Security Council and didn‘t receive the follow-up such an important piece of evidence deserved, the report said. In addition, the United Nations and Security Council virtually ignored a groundbreaking assessment by the UN human rights investigator for Rwanda who raised the possibility in August 1993 that a genocide might occur.

But the report points most of its criticism at how the United Nations – and in particular its Security Council members – reacted to the killings once they started. There was little political will within the council, particularly from the United States, to authorize a robust peacekeeping force in the months after the failed Somalia mission, that left 18 Americans dead. After rampaging killers in Rwanda killed 10 Belgian peacekeepers at the beginning of the genocide, there was little will to keep the peacekeepers in place, much less strengthen their mandate.

The departure of peacekeepers from a school where thousands of civilians had massed hoping for protection was cited by the report as one of the main reasons for the enduring bitterness Rwandans feel Thursday toward the United Nations because of the ensuing massacre there. „The manner in which the troops left, including attempts to pretend to the refugees that they were not in fact leaving, was disgraceful,“ the report said.

Belgian Charged in Rwanda Deaths of 10 Peacekeepers

(December 30, 1995)

The Belgian paratroopers were guarding Rwandan Prime Minister Agathe Uwilingiyimana, who was also killed by rampaging Hutu soldiers.

Families of the troopers have charged that Marchal and other officers placed the lightly armed peacekeepers in a position of excessive danger and failed to launch a rescue mission after their capture.

Prosecutor Bernard Dejemeppe said the investigation found that Marchal could have done much more to prevent the deaths, including using other U.N. forces present, seeking the advice of other officers and better assessing the risks his men faced.

The European Union Is Complicit in Genocide

(August 11, 2025)

The EU presents itself as a global champion of moral and legal leadership, grounded in the principles of human rights, international law, democracy, and humanitarianism. Yet its failure to uphold these values in the case of Palestine severely undermines its credibility. As Israel’s largest trading partner and second-largest arms supplier, the EU possesses considerable leverage; its refusal to use this influence to hold Israel accountable or protect Palestinian lives signals not powerlessness but a conscious choice of complicity. Moreover, given its member states’ historical entanglement in the colonial partitioning of the Middle East, the EU bears a deeper responsibility to act with justice. Its failure to do so today echoes the very dynamics of domination and double standards it claims to have left behind.

In the face of Israel‘s genocide in Gaza, ongoing silence and inaction is complicity

For nearly two years, we have witnessed a live-streamed genocide. War crimes have been well-documented by journalists, rights groups, doctors and civilians. There’s enough evidence to sift through for decades to come.

Activists and celebrities have reminded the western world of their vow to “never again” allow something like this to happen. Countless social media campaigns have pleaded with the public to keep “all eyes on Rafah” and on Gaza.

But still the genocide persists. Israel’s actions in Gaza and the occupied West Bank have become more brazen and violent than ever.

Why is this happening? It’s not because Israel is a small beacon of democracy in the Middle East surrounded by enemies. Rather, it’s because Israel is a rogue state surrounded by capitulators who have allowed this to unfold.

We, the signatories listed below, come together with a simple, urgent message: the war in Gaza must end now.

The suffering of civilians in Gaza has reached new depths. The Israeli government’s aid delivery model is dangerous, fuels instability and deprives Gazans of human dignity. We condemn the drip feeding of aid and the inhumane killing of civilians, including children, seeking to meet their most basic needs of water and food. It is horrifying that over 800 Palestinians have been killed while seeking aid. The Israeli Government’s denial of essential humanitarian assistance to the civilian population is unacceptable. Israel must comply with its obligations under international humanitarian law.

Gaza is a mirror reflecting the world‘s absolute shame: Opinion

Never in recent history has a civilian population been locked into a fenced strip of land – denied food, water, and fuel – while being bombed from air, land, and sea.

This is not siege. It is the world’s first televised extermination.

A concentration camp under constant aerial assault.

(…)

What is happening in Gaza does more than violate law – it obliterates it.

It tears through every principle of humanity, every treaty that claims to uphold it.

The world did not merely fail Gaza. It abandoned her. And in doing so, it exposed itself.

Gaza is not just a killing field.

She is a mirror – and in her reflection, we see our absolute, unvarnished shame.

Terror and chaos for Gaza’s people now entering the ‘death phase’

In an alert, the UN agency for Palestine refugees, UNRWA, relayed desperate testimonies from its colleagues who are also struggling to survive in the war-torn enclave.

“We’re in the death phase,” one UNRWA worker said. “Everything around people at the moment is death, whether it’s bombs or strikes, children wasting away in front of their eyes from malnourishment, from dehydration, and dying.”

Doctors and nurses who continue to work in the UN agency’s clinics and medical centres “are watching children disappear and die in front of their eyes, and there‘s absolutely nothing that they can do about it,” the worker continued.
Civilians ‘faced sniper and tank-fire’

The development comes after desperate Gazans seeking aid came under fire at the weekend “from Israeli tanks, snipers and other gunfire”, according to the UN World Food Programme (WFP).

In a detailed statement after the incident on Sunday 20 July, it explained that a 25-truck lorry convoy crossed the Zikim border point in northern Gaza “destined for starving communities”.

Shortly after passing the final checkpoint after the Zikim crossing point, the convoy encountered large crowds of civilians waiting to access food supplies. This was when the shooting began, leaving “countless” Gazans dead, WFP said, echoing reports by the health authorities.

Condemning the incident, WFP noted that the victims “were simply trying to access food to feed themselves and their families on the brink of starvation”. ….

Israel no longer hides its genocidal aims in Gaza. Will the world keep looking away?

Under international law, the prohibition of genocide is a jus cogens norm — binding on all states without exception. There is a universal obligation to prevent genocide and to ensure accountability. In January 2024, the ICJ found that Israel was at risk of perpetrating a genocide and must take provisional measures to avoid committing the crime. With its subsequent actions, Israel has made a mockery of that order.

In July 2024, the ICJ ruled in a separate case that Israel’s occupation of the Palestinian territories was illegal and must end. In November, the International Criminal Court (ICC) issued arrest warrants for Netanyahu and former Defense Minister Yoav Gallant on charges related to war crimes and crimes against humanity.

Yet the response from the international community has been negligible. While some countries like Colombia and South Africa have taken steps to cut relations and hold Israel accountable, most — including Arab states with formal ties to Israel — have done little beyond issue meaningless condemnations.

“You can consume anything you want. There are 25 different kinds of fried chicken which you can buy in most Arab capitals and that’s fine. That’s what the governments want is to have people spend their time, money, and thoughts on consumption. But anything that has to do with political power, public policy, and allocation of economic gains have to be controlled by the government,” he added.

Die Zombie-Linke

(January 20, 2020)
