Der Bundestag hat am Donnerstag, 16. Oktober 2025, den Bundeswehreinsatz im Roten Meer um ein Jahr verlĂ€ngert. Dazu lag ein Antrag der Bundesregierung fĂŒr die fortgesetzte Beteiligung der Bundeswehr an der EU-gefĂŒhrten Operation Eunavfor Aspides zur Abwehr von Angriffen der Huthi-Milizen auf die Schifffahrt im Roten Meer vor (21/1372(Dokument, öffnet ein neues Fenster)). In namentlicher Abstimmung wurde der Antrag auf Empfehlung des AuswĂ€rtigen Ausschusses mit 435 Ja-Stimmen bei 69 Gegenstimmen und 77 Enthaltungen angenommen.

Bundestag gibt grĂŒnes Licht fĂŒr FortfĂŒhrung des Irak-Einsatzes der Bundeswehr

Die Bundeswehr beteiligt sich seit 2015 am internationalen Anti-IS-Einsatz. Die Mission wird von einer breiten Koalition aus mehr als 70 LĂ€ndern getragen â darunter auch Deutschland.
Die Personalobergrenze von 500 deutschen Soldatinnen und Soldaten wird unverÀndert beibehalten.
Das aktuelle Mandat ist bis zum 31. Januar 2027 verlÀngert worden.

Section 5(c) of the 1973 War Powers Act states that âat any time that United States Armed Forces are engaged in hostilities outside the territory of the United States, its possessions and territories without a declaration of war or specific statutory authorization, such forces shall be removed by the President if the Congress so directs by concurrent resolution.â

The Court Gutted Congressâs War Power. Itâs Time to Give It Back.
The War Powers Resolution of 1973 was designed to restore the constitutional balance in decisions to commit the United States to armed conflict. Its central provision â a legislative veto enabling Congress to direct the withdrawal of American forces by concurrent resolution â was cast into legal doubt by the Supreme Courtâs 1983 decision in INS v. Chadha. But Chadha was wrongly decided, its reasoning is exceptionally weak, and the Courtâs subsequent embrace of functionalism in separation-of-powers cases has left it incoherent as precedent. As the United States drifts deeply into a congressionally unauthorized war with Iran, the case for overruling Chadha, or at minimum limiting it to its facts, has never been stronger.

Mit seinen BeschlĂŒssen 2 BvE 5/15 (verkĂŒndet am 14.10.2016, aber schon vom 20.09.2016) und 2 BvE 2/15 (verkĂŒndet am 15.11.2016, aber schon vom 13.10.2016) gab das Bundesverfassungsgericht das unauffĂ€llige Startsignal fĂŒr den Beschluss des neuen B.N.D.-Gesetzes am 21.10.2016 im Bundestag.
Die Absegnung des B.N.D.-Gesetzes durch ihre Ăber-Dreiviertel-Mehrheit im Parlament, gegen die es laut Karlsruhe nun keine Opposition mehr im Sinne von Artikel 44 des Grundgesetzes gab, hatte die Regierung bis zu den Freifahrtscheinen der Verfassungsrichter taktisch verzögert.
Am 12. Dezember 1970 hatte das âAbhörteilâ (BVerfGE 30, 1) vom Verfassungsgericht Westdeutschlands die Aufhebung der Gewaltenteilung beim Brief-, Post- und Fernmeldegeheimnis durch die VerfassungsĂ€nderungen der âNotstandsgesetzeâ als verfassungsgemÀà beurteilt. Das damalige Urteil war gegen schwerste Bedenken und vorausschauende Warnungen der Verfassungsrichter Geller, Dr. v.Schlabrendorff und Dr. Rupp mit 5 zu 3 Stimmen entschieden worden.
Im Jahre 2016 nun ĂŒbertrugen Andreas VoĂkuhle, Peter M. Huber, Monika Hermanns, Sibylle Kessal-Wulf, Peter MĂŒller, Doris König und Ulrich Maidowski die MachtfĂŒlle der in 1968 unter Besatzungsrecht geschaffenen âNotstandsgesetzeâ der damaligen âgroĂen Koalitionâ auf deren heutige Nachfolger.
Und in Deutschland, wie es heute ist, eskalierten die Verfassungsrichter selbst die damalige antidemokratische und antiparlamentarische Auslegung des Grundgesetzes ein weiteres Mal…

In addition to Alito, Chief Justice John Roberts has joined the attack.
In a 1984 memo entitled âWar Powers Problem,â Roberts â then an associate in Ronald Reaganâs White House counselâs office â advised the Reagan administration to oppose legislation extending tax benefits to veterans who served in Reaganâs unauthorized military deployment to Lebanon. Roberts argued that the administration should oppose the bill simply because it mentioned Congressâs constitutional power to declare war.

Justice Brett Kavanaugh has seemingly come down on both sides of the issue regarding limiting presidential war power. In a 2015 Appeals Court ruling, the conservative judge wrote that âin justiciable cases, courts should not hesitate to enforce constitutional and statutory constraints on wartime activities.â

Additionally, Justice Clarence Thomas has also questioned whether Congress has the power to rein in presidential power related to national security. In a dissenting opinion for a 2004 Supreme Court case, Thomas wrote that the Constitution gives the president âprimary responsibilityâ over national security and foreign policy.
Libyen-Krieg: Neue Sitzung der SchwachmÀchte im UNO-Sicherheitsrat

Am 19.MĂ€rz, dem Tag des Angriffs von Frankreich, GroĂbritannien, Kanada, Italien und den USA auf Libyen, wurde in Moskau eine der erbĂ€rmlichsten ErklĂ€rungen in der russischen Geschichte veröffentlicht (Angriffskrieg gegen Libyen beginnt: Ticker). Das russische AuĂenministerium von Sergei Lawrow:
âIn Moskau bedauern wir diese bewaffnete Intervention im Rahmen der UN Resolution 1973, die hastig beschlossen wurde.â
Die Weltöffentlichkeit konstatiert: Russlands StaatsfĂŒhrung ist ein Haufen Tölpel, dem – wenn er schon nicht lesen kann und deshalb nicht weiss was vor sich geht – selbst das Wort „Veto“ mit einem einfachen Armhochhalten schon zu viel ist. Das Gleiche gilt fĂŒr die Atomschwachmacht China, deren leseunkundige kommunistische Staatspartei immerhin 1.3 Milliarden Menschen herumkommandiert. In der Parteizeitung „PeopleÂŽs Daily“ redete man sich heute nun selbst in ein Gewissen, was man nicht hat (1):
„Die blutgetrĂ€nkten Gewitter, denen Irak seit acht Jahren unterzogen wurde und das unaussprechliche Leiden seines Volkes sind ein Spiegel und eine Warnung. Die militĂ€rischen Attacken auf Libyen, folgend den Kriegen in Afghanisten und Irak, sind das das dritte Mal, dass einige LĂ€nder bewaffnete Aktionen gegen souverĂ€ne Staaten gestartet haben. Es sollte augenscheinlich sein, dass jedes Mal, wenn militĂ€rische Mittel benutzt werden um Krisen zu begegnen, dies ein Schlag gegen die Charta der Vereinten Nationen und die Regeln der internationalen Beziehungen sind.“
Die Weltöffentlichkeit versteht: frĂŒher hiess es in China „Bombardiert das Hauptquartier“, letzten Freitag hiess es „Bombardiert Libyen“ und heute wieder anders herum. Mal sehen, zu was sich Chinas StaatsfĂŒhrung am Donnerstag entscheidet. Vielleicht der Einfachheit halber zu „Bombardiert irgendwas“.

Warum das Atomabkommen fĂŒr den Iran von Anfang an wertlos war

D.h., das Atomabkommen gilt faktisch nur fĂŒr die Vertragsparteien ohne Vetomacht im U.N.-Sicherheitsrat: den Iran, Deutschland und die EuropĂ€ische Union.
Es ist anzunehmen, dass sich jetzt wieder einmal alle beteiligen Regierungen auf die UnfÀhigkeit herausreden ihren eigenen Betrug zu verstehen.
Eine U.N.-Resolution ist Teil des am 14. Juli 2015 unterschriebenen internationalen Iranabkommen / Atomabkommen (Joint Comprehensive Plan of Action, J.C.P.O.A.).
Bereits Monate vorher warnte Radio Utopie ausdrĂŒcklich vor genau dieser kommenden U.N.-Resolution und der damit zusammenhĂ€ngenden Frage der Sanktionen. (4. April 2015, Das Iran-Abkommen: Wende oder Hebel)
Und schon zuvor warnten wir im MĂ€rz 2015 davor, dass diese kommende U.N.-Resolution sich ausgerechnet auf Kapitel VII der nach dem Zweiten Weltkrieg beschlossenen Charta der Vereinten Nationen berufen solle
Genau das tut die am am 20. Juli 2015 im U.N.-Sicherheitsrat beschlossene Resolution 2231 (2015), indem sie sich in ihren entscheidenen Abschnitten (âdecidesâ) auf Artikel 41 (und damit Kapitel VII) der Charta der Vereinten Nationen beruft.
Das Iran-Abkommen: Wende oder Hebel

Am 23. MĂ€rz meldete der britische âTelegraphâ, dass sich in der iranischen Zeitung Kayhan Abgeordnete des iranischen Majlis ĂŒber die Verhandlungsstrategie von AuĂenminister Zarif beschwerten und bezĂŒglich einer von Zarif angestrebten Resolution nach Kapitel VII der U.N.-Charta als einer âFalleâ sprachen. Auch der eine oder andere Generalissimus, wie ĂŒberall ReprĂ€sentant der örtlichen Hochkultur, befand â gerade noch rechtzeitig â es sei vielleicht doch keine so gute Idee sich mit der Zustimmung zu einer Kapitel VII-Resolution auch noch selbst als GefĂ€hrdung des Weltfriedens zu bezeichnen, nur weil man Atomkraftwerke und medizinische Anlagen samt Forschung dazu betreibt.
Im nun vorgestern am 2. April in Lausanne von den Regierungen der Vereinigten Staaten von Amerika, des Vereinigten Königreichs, der Russischen Föderation, von China, Frankreich und Deutschland gemeinsam mit Iran beschlossenen und veröffentlichten Abkommen ist von einer âneuen Resolution des Sicherheitsratesâ die Rede, die das Abkommen bzw dessen âJoint Comprehensive Plan of Actionâ (JCPOA) âunterstĂŒtzenâ und auf dessen vollstĂ€ndige Umsetzung âdrĂ€ngenâ soll.
Frage: Nach Kapitel VII U.N.-Charta? Bei âernsthaften Konsequenzenâ fĂŒr den Iran, wegen erklĂ€rter GefĂ€hrdung von âinternationalen Frieden und Sicherheit,â wegen behaupteter oder tatsĂ€chlicher Vertragsverletzungen?

Die durch die VerfassungsĂ€nderungen der âNotstandsgesetzeâ und das nachfolgende erste Artikel 10-Gesetz vom 13. August 1968 geschaffene G 10-Kommission, als einziges parlamentarisches Gremium bevollmĂ€chtigt Inlandsspionage der Behörden zu verbieten, hatte dies siebenundvierzig Jahre effektiv nicht getan und lediglich als Feigenblatt der Regierungsmacht gedient.
Als die G 10-Kommission schlieĂlich Mitte 2015 zum ersten Mal in ihrer Geschichte gegen die Regierung revoltierte und Einblick in die sogenannte âN.S.A.-Selektorenlisteâ verlangte â eine Liste mit Spionagezielen, die der Bundesnachrichtendienst abgelehnt hatte, nicht etwa einer Liste mit tatsĂ€chlich anvisierten Zielen â verweigerte die Regierung selbst diesem Gremium die Einsichtnahme. Als die G 10-Kommission dann im Dezember 2015 endlich Verfassungsklage einreichte, stellte sie keinen Eilantrag.
Am 14. Oktober 2016 weigerte sich dann das Bundesverfassungsgericht im (wie erwÀhnt bereits am 20. September 2016 getroffenen) Beschluss 2 BvE 5/15, die Verfassungsklage der G 10-Kommission auch nur anzunehmen.
BegrĂŒndung der Karlsruher Richter: Ihrer Interpretation des Grundgesetzes nach, sei die vom Parlamentarischen Kontrollgremium des Bundestages gewĂ€hlte G 10-Kommission kein âHilfsorganâ (Wortlaut Artikel 10 Grundgesetz) des Bundestages, weil sie in dessen GeschĂ€ftsordnung (!) nicht âmit eigenen Rechten ausgestattetâ sei.
Abseits dieser bizarr anmutenden BegrĂŒndung hatte das Urteil einen verheerenden, tatsĂ€chlichen Kern: eben den Bezug auf die Legitimierung der âNotstandsgesetzeâ Westdeutschlands durch das âAbhörurteilâ BVerfGE 30, 1, von 1970. In einem in der Tat historischen Schritt bestĂ€tigten die Verfassungsrichter nicht nur die seitdem als verfassungsgemÀà geltende selektive AuĂerkraftsetzung der Gewaltenteilung, sondern vollzogen in deren letzter Konsequenz selbst die Erniedrigung der parlamentarischen G 10-Kommission und entblöĂten diese als Placebo, als jahrzehntelanges, lediglich im Falle von Folgsamkeit geduldetes Feigenblatt exekutiver WillkĂŒrmacht.
Bundesnachrichtendienst: Bald ein echter Geheimdienst?

Die Entscheidungen des Bundesverfassungsgerichts der vergangenen Jahre, die bei der Ăberarbeitung des neuen Gesetzes berĂŒcksichtigt werden, haben die Arbeit des BND nicht einfacher gemacht. Die Vorschriften zur DatenĂŒbermittlung etwa sind bereits jetzt sehr streng.

Der BND hackte sich vor einigen Jahren in die Chatkommunikation der russischen Wagner-Söldner und las dort mit. Aber das Programm aktiv stören oder abschalten, das ist bislang ebenso wenig erlaubt wie IT-Strukturen anzugreifen und unschÀdlich zu machen, von denen gegnerische Hackerangriffe ausgehen.

Forsa befragte fĂŒr die Erhebung Ende Juli dazu 1001 Menschen in Deutschland.

Commenting on the letter, Secretary General Dr Wajid Akhter said:
âWe are at a watershed moment as events in Gaza intensify, with more innocent lives lost each day. British Muslim communities, alongside countless others across the country, are simply calling for a foreign policy rooted in justice, humanity, and international law.
âWe have rightly mobilised a coalition of the willing to oppose Russiaâs illegal occupation of Ukraine, yet the illegal occupation of Palestine and the mass killing of Palestinian civilians is met with silence. We urge Prime Minister Keir Starmer to show moral leadership and act swiftly.“
Hundreds of Muslim groups demand UK recognition of Palestinian state
The Muslim Council of Britain (MCB) has deliver a letter signed by over 300 Muslim groups to 10 Downing Street urging Prime Minister Keir Starmer to show âmoral leadershipâ and swiftly recognise the Palestinian State.
