OBLIGATIONS OF ISRAEL IN RELATION TO THE PRESENCE AND ACTIVITIES OF THE UNITED NATIONS, OTHER INTERNATIONAL ORGANIZATIONS AND THIRD STATES IN AND IN RELATION TO THEOCCUPIED PALESTINIAN TERRITORY

164. The Court recalls that, on 29 November 1948, referring to General Assembly resolution 181 (II) on the future government of Palestine, Israel applied for admission to membership of the United Nations, formally declaring that it “hereby unreservedly accepts the obligations of the United Nations Charter and undertakes to honour them from the day when it becomes a Member of the United Nations” (letter dated 29 November 1948 from Israel’s Foreign Minister to the United Nations Secretary-General concerning Israel’s Application for Admission to Membership of the United Nations and Declaration Accepting Obligations under the Charter, UN doc. S/1093). On 11 May 1949, the General Assembly took note of this declaration when it admitted Israel as a Member of the United Nations (General Assembly resolution 273 (III)).

165. For the purpose of responding to the question posed by the General Assembly, the Court will not examine all the obligations that Israel has undertaken as a Member of the United Nations under the Charter with regard to the question of Palestine. It will limit its analysis to those obligations concerning the presence and activities of the United Nations, including its entities, in and in relation to the Occupied Palestinian Territory.

223. For these reasons,

THE COURT ,

(1) Unanimously,
Finds that it has jurisdiction to give the advisory opinion requested;

(2) Unanimously,
Decides to comply with the request for an advisory opinion;

(3) Is of the opinion that the State of Israel, as an occupying Power, is required to fulfil its obligations under international humanitarian law. These obligations include the following:

(a) Unanimously,
to ensure that the population of the Occupied Palestinian Territory has the essential supplies of daily life, including food, water, clothing, bedding, shelter, fuel, medical supplies and services;

(b) By ten votes to one,
to agree to and facilitate by all means at its disposal relief schemes on behalf of the population of the Occupied Palestinian Territory so long as that population is inadequately supplied, as has been the case in the Gaza Strip, including relief provided by the United Nations and its entities, in particular the United Nations Relief and Works Agency for Palestine Refugees in the Near East, other international organizations and third States, and not to impede such relief;
IN FAVOUR: President Iwasawa; Judges Tomka, Abraham, Xue, Nolte, Charlesworth, Brant,
Gómez Robledo, Cleveland, Tladi;
AGAINST: Vice-President Sebutinde;

(c) Unanimously,
to respect and protect all relief and medical personnel and facilities;

(d) Unanimously,
to respect the prohibition on forcible transfer and deportation in the Occupied Palestinian Territory;

(e) Unanimously,
to respect the right of protected persons from the Occupied Palestinian Territory who are detained by the State of Israel to be visited by the International Committee of the Red Cross; and

(f) Unanimously,
to respect the prohibition on the use of starvation of civilians as a method of warfare;

(4) By ten votes to one,
Is of the opinion that, as an occupying Power, the State of Israel has an obligation under
international human rights law to respect, protect and fulfil the human rights of the population of the Occupied Palestinian Territory, including through the presence and activities of the United Nations, other international organizations and third States, in and in relation to the Occupied Palestinian Territory;

Is of the opinion that the State of Israel has an obligation under Article 105 of the Charter of the United Nations to ensure full respect for the privileges and immunities accorded to the United Nations, including its agencies and bodies, and its officials, in and in relation to the Occupied Palestinian Territory;

SECTION 3. The premises of the United Nations shall be inviolable. The property and assets of the United Nations, wherever located and by whom soever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

All differences arising out of the interpretation or application of the present convention shall be referred to the International Court of Justice, unless in any case it is agreed by the parties to have recourse to another mode of settlement. If a difference arises between the United Nations on the one hand and a Member on the other hand, a request shall be made for an advisory opinion on any legal question involved in accordance with Article 96 of the Charter and Article 65 of the Statute of the Court. The opinion given by the Court shall be accepted as decisive by the parties.

There’s a standard; there’s an ethos; there’s a belief that we are above so many things are enemies or others would do.”

We are writing to request expeditious declassification and public release of the Department of Justice Office of Legal Counsel’s written opinion, dated September 5, 2025, concerning the domestic and international legal basis for recent military strikes of certain vessels near South America and the Caribbean, with appropriate redactions necessary to protect military personnel and sensitive intelligence matters.

Significant and noteworthy precedent exists for the public release of OLC opinions related to overseas military action. After the United States carried out military strikes in Libya in 2011 and in Syria in 2018, the Department of Justice released the applicable OLC opinion justifying each operation.

Few decisions are more consequential for a democracy than the use of lethal force. We therefore believe that the declassification and public release of this important document would enhance transparency in the use of deadly force by our Nation’s military and is necessary to ensure Congress and the American people are fully informed of the legal justification supporting these strikes.

As Barbara Lee presciently warned her colleagues before she cast her lone dissenting vote in 2001, we have “become the evil we deplore.” But these wars have not been accompanied by fearsome military parades (not yet) or speeches about conquering the world. Instead they have been politically justified by “information warfare” to demonize enemies and fabricate crises, and then waged in a “disguised, quiet, media free” way, to hide their cost in human blood from the American public and the world.

After 16 years of war, about 6 million violent deaths, 6 countries utterly destroyed and many more destabilized, it is urgent that the American public come to terms with the true human cost of our country’s wars and how we have been manipulated and misled into turning a blind eye to them – before they go on even longer, destroy more countries, further undermine the rule of international law and kill millions more of our fellow human beings.

Als das Bundesverfassungsgericht Deutschland zur elektronischen Kolonie erklärte

Mit seinen Beschlüssen 2 BvE 5/15 (verkündet am 14.10.2016, aber schon vom 20.09.2016) und 2 BvE 2/15 (verkündet am 15.11.2016, aber schon vom 13.10.2016) gab das Bundesverfassungsgericht das unauffällige Startsignal für den Beschluss des neuen B.N.D.-Gesetzes am 21.10.2016 im Bundestag.

Die Absegnung des B.N.D.-Gesetzes durch ihre Über-Dreiviertel-Mehrheit im Parlament, gegen die es laut Karlsruhe nun keine Opposition mehr im Sinne von Artikel 44 des Grundgesetzes gab, hatte die Regierung bis zu den Freifahrtscheinen der Verfassungsrichter taktisch verzögert.

Am 12. Dezember 1970 hatte das „Abhörteil“ (BVerfGE 30, 1) vom Verfassungsgericht Westdeutschlands die Aufhebung der Gewaltenteilung beim Brief-, Post- und Fernmeldegeheimnis durch die Verfassungsänderungen der „Notstandsgesetze“ als verfassungsgemäß beurteilt. Das damalige Urteil war gegen schwerste Bedenken und vorausschauende Warnungen der Verfassungsrichter Geller, Dr. v.Schlabrendorff und Dr. Rupp mit 5 zu 3 Stimmen entschieden worden.

Im Jahre 2016 nun übertrugen Andreas Voßkuhle, Peter M. Huber, Monika Hermanns, Sibylle Kessal-Wulf, Peter Müller, Doris König und Ulrich Maidowski die Machtfülle der in 1968 unter Besatzungsrecht geschaffenen „Notstandsgesetze“ der damaligen „großen Koalition“ auf deren heutige Nachfolger.

Und in Deutschland, wie es heute ist, eskalierten die Verfassungsrichter selbst die damalige antidemokratische und antiparlamentarische Auslegung des Grundgesetzes ein weiteres Mal.

Die durch die Verfassungsänderungen der „Notstandsgesetze“ und das nachfolgende erste Artikel 10-Gesetz vom 13. August 1968 geschaffene G 10-Kommission, als einziges parlamentarisches Gremium bevollmächtigt Inlandsspionage der Behörden zu verbieten, hatte dies siebenundvierzig Jahre effektiv nicht getan und lediglich als Feigenblatt der Regierungsmacht gedient.

Als die G 10-Kommission schließlich Mitte 2015 zum ersten Mal in ihrer Geschichte gegen die Regierung revoltierte und Einblick in die sogenannte „N.S.A.-Selektorenliste“ verlangte – eine Liste mit Spionagezielen, die der Bundesnachrichtendienst abgelehnt hatte, nicht etwa einer Liste mit tatsächlich anvisierten Zielen – verweigerte die Regierung selbst diesem Gremium die Einsichtnahme. Als die G 10-Kommission dann im Dezember 2015 endlich Verfassungsklage einreichte, stellte sie keinen Eilantrag.

Am 14. Oktober 2016 weigerte sich dann das Bundesverfassungsgericht im (wie erwähnt bereits am 20. September 2016 getroffenen) Beschluss 2 BvE 5/15, die Verfassungsklage der G 10-Kommission auch nur anzunehmen.

Begründung der Karlsruher Richter: Ihrer Interpretation des Grundgesetzes nach, sei die vom Parlamentarischen Kontrollgremium des Bundestages gewählte G 10-Kommission kein „Hilfsorgan“ (Wortlaut Artikel 10 Grundgesetz) des Bundestages, weil sie in dessen Geschäftsordnung (!) nicht „mit eigenen Rechten ausgestattet“ sei.

Abseits dieser bizarr anmutenden Begründung hatte das Urteil einen verheerenden, tatsächlichen Kern: eben den Bezug auf die Legitimierung der „Notstandsgesetze“ Westdeutschlands durch das „Abhörurteil“ BVerfGE 30, 1, von 1970. In einem in der Tat historischen Schritt bestätigten die Verfassungsrichter nicht nur die seitdem als verfassungsgemäß geltende selektive Außerkraftsetzung der Gewaltenteilung, sondern vollzogen in deren letzter Konsequenz selbst die Erniedrigung der parlamentarischen G 10-Kommission und entblößten diese als Placebo, als jahrzehntelanges, lediglich im Falle von Folgsamkeit geduldetes Feigenblatt exekutiver Willkürmacht.

Magnetic effect on CO 2 solubility in seawater: A possible link between geomagnetic field variations and climate

Correlations between geomagnetic-field and climate parameters have been suggested repeatedly, but possible links are controversially discussed. Here we test if weak (Earth-strength) magnetic fields can affect climatically relevant properties of seawater. We found the solubility of air in seawater to be by 15% lower under reduced magneticfield (20 mT) compared to normal field conditions (50 mT). The magnetic-field effect on CO2 solubility is twice as large, from which we surmise that geomagnetic field variations modulate the carbon exchange between atmosphere and ocean. A 1% reduction in magnetic dipole moment may release up to ten times more CO2 from the surface ocean than is emitted by subaerial volcanism.

The fact that the MF effect is similar among the molecular gases suggests that effects seen with air are not due to the paramagnetic susceptibility of O 2, which is too small to explain the observed magnetic-field effects in terms of magnetization effects.

New evidence regarding the torture of Palestinian prisoners whose mutilated bodies were returned by Israel was presented at the International Criminal Court by a legal team representing the victims of the genocide in Gaza.

Al Jazeera Arabic reported that evidence regarding the targeting of journalists was added to the ongoing series of legal efforts to prosecute Israel in the International court since 2008.

According to the report, documented medical evidence was presented by doctors and forensic experts through detailed reports, photos, videos, and family testimonies.

Arrest of top whistleblower shows extent of Israeli impunity over torture of Palestinian detainees

The arrest of Tomer-Yerushalmi, who was, until her resignation last week, Israel’s military advocate general, is the latest development in a dramatic scandal that has been unfolding since February 2024.

It started with a complaint filed by a doctor who had served in the medical facility next to the Sde Teiman detention camp in the Negev desert in southern Israel. Professor Yoel Donchin reported that a detainee appeared to have been a victim of a severe assault. The detainee arrived at the hospital showing signs of beating and possible brutal sexual assault.

Israeli military‘s top lawyer resigns over leak of video allegedly showing abuse of Palestinian detainee

After her resignation was accepted by the chief of staff of the Israel Defense Forces (IDF), Katz put out a statement welcoming the decision.

„Anyone who spreads blood libels against IDF troops is unfit to wear the army‘s uniform,“ he said.

The leaked video was broadcast on the Israeli Channel 12 news in August 2024.

The footage shows soldiers at Sde Teiman taking aside a detainee, then surrounding him with riot shields to block visibility while he was stabbed in the rectum with a sharp object. The detainee was treated for severe injuries.

Clear evidence of brutal torture: Condition of Palestinian bodies released from Israeli prisons demands urgent int’l investigation

Euro-Med Monitor’s field team monitored the Israeli authorities’ handover of the bodies of 120 Palestinians from the Gaza Strip through the International Committee of the Red Cross (ICRC), delivered in three consecutive batches: 45 on Tuesday, 45 on Wednesday, and 30 on Thursday, including dozens of unidentified remains.

Medical examinations, forensic reports, and observations by the field team revealed conclusive evidence that many victims were killed after being detained. Their bodies bore clear marks of hanging, rope imprints around their necks, injuries from close-range gunfire, bound hands and feet with plastic restraints, and blindfolds. Some bodies were crushed under tank tracks, while others showed severe signs of physical torture, fractures, burns, and deep wounds.

Karl Liebknecht proklamiert am 09.11.1918 die Sozialistische Republik Deutschland (Auszug)

»Der Tag der Revolution ist gekommen. Wir haben den Frieden erzwungen. Der Friede ist in diesem Augenblick geschlossen. Das Alte ist nicht mehr. Die Herrschaft der Hohenzollern, die in diesem Schloß jahrhundertelang gewohnt haben, ist vorüber. In dieser Stunde proklamieren wir die freie sozialistische Republik Deutschland. Wir grüßen unsere russischen Brüder, die vor vier Tagen schmählich davongejagt worden sind.« Liebknecht wies dann auf das Hauptportal des Schlosses und rief mit erhobener Stimme: »Durch dieses Tor wird die neue sozialistische Freiheit der Arbeiter und Soldaten einziehen. Wir wollen an der Stelle, wo die Kaiserstandarte wehte, die rote Fahne der freien Republik Deutschland hissen!«

Die Soldaten der Schloßwache, die auf dem Dach sichtbar waren, schwenkten die Helme und grüßten zur Menge herab, die auf das Tor zudrängte. Es wurde langsam geöffnet, um dem Automobil Liebknechts Einlaß zu gewähren. Die Menge wurde davon zurückgehalten, zu folgen. Nach einigen Minuten erschienen, von der Menge stürmisch begrüßt, die Soldaten der Schloßwache ohne Waffen und Gepäck. Kurze Zeit darauf zeigte sich Liebknecht mit Gefolgschaft auf dem Balkon, von dessen Grau sich eine breite rote Decke abhob.

»Parteigenossen«, begann Liebknecht, »der Tag der Freiheit ist angebrochen. Nie wieder wird ein Hohenzoller diesen Platz betreten. Vor 70 Jahren stand hier am selben Ort Friedrich Wilhelm IV. und mußte vor dem Zug der auf den Barrikaden Berlins für die Sache der Freiheit Gefallenen, vor den fünfzig blutüberströmten Leichnamen seine Mütze abnehmen. Ein anderer Zug bewegt sich heute hier vorüber. Es sind die Geister der Millionen, die für die heilige Sache des Proletariats ihr Leben gelassen haben. Mit zerspaltenem Schädel, in Blut gebadet wanken diese Opfer der Gewaltherrschaft vorüber, und ihnen folgen die Geister von Millionen von Frauen und Kindern, die für die Sache des Proletariats in Kummer und Elend verkommen sind. Und Abermillionen von Blutopfern dieses Weltkrieges ziehen ihnen nach. Heute steht eine unübersehbare Menge begeisterter Proletarier an demselben Ort, um der neuen Freiheit zu huldigen. Parteigenossen, ich proklamiere die freie sozialistische Republik Deutschland, die alle Stämme umfassen soll, in der es keine Knechte mehr geben wird, in der jeder ehrliche Arbeiter den ehrlichen Lohn seiner Arbeit finden wird. Die Herrschaft des Kapitalismus, der Europa in ein Leichenfeld verwandelt hat, ist gebrochen. Wir rufen unsere russischen Brüder zurück. Sie haben bei ihrem Abschied zu uns gesagt: >Habt Ihr in einem Monat nicht das erreicht, was wir erreicht haben, so wenden wir uns von Euch ab.< Und nun hat es kaum vier Tage gedauert.« »Wenn auch das Alte niedergerissen ist«, fuhr Liebknecht fort, »dürfen wir doch nicht glauben, daß unsere Aufgabe getan sei. Wir müssen alle Kräfte anspannen, um die Regierung der Arbeiter und Soldaten aufzubauen und eine neue staatliche Ordnung des Proletariats zu schaffen, eine Ordnung des Friedens, des Glücks und der Freiheit unserer deutschen Brüder und unserer Brüder in der ganzen Welt. Wir reichen ihnen die Hände und rufen sie zur Vollendung der Weltrevolution auf. Wer von euch die freie sozialistische Republik Deutschland und die Weltrevolution erfüllt sehen will, erhebe seine Hand zum Schwur (alle Hände erheben sich und Rufe ertönen: Hoch die Republik!). Nachdem der Beifall verrauscht war, ruft ein neben Liebknecht stehender Soldat und schwenkt die rote Fahne, die er in den Händen trägt: »Hoch lebe ihr erster Präsident Liebknecht!« Liebknecht schloß: »Soweit sind wir noch nicht. Ob Präsident oder nicht, wir müssen alle zusammenstehen, um das Ideal der Republik zu verwirklichen. Hoch die Freiheit und das Glück und der Frieden!«

Bald darauf wurde an dem Mast der Kaiserstandarte die rote Fahne gehißt.

CIA Document 1035-960 – Concerning Criticism of the Warren Report

Presumably as a result of the increasing challenge to the Warren Commission‘s report, a public opinion poll recently indicated that 46% of the American public did not think that Oswald acted alone, while more than half of those polled thought that the Commission had left some questions unresolved. Doubtless polls abroad would show similar, or possibly more adverse results.

Innuendo of such seriousness affects not only the individual concerned, but also the whole reputation of the American government. Our organization itself is directly involved: among other facts, we contributed information to the investigation. Conspiracy theories have frequently thrown suspicion on our organization, for example by falsely alleging that Lee Harvey Oswald worked for us. The aim of this dispatch is to provide material countering and discrediting the claims of the conspiracy theorists, so as to inhibit the circulation of such claims in other countries. Background information is supplied in a classified section and in a number of unclassified attachments.

3. Action. We do not recommend that discussion of the assassination question be initiated where it is not already taking place. Where discussion is active, however, addresses are requested:

a. To discuss the publicity problem with liaison and friendly elite contacts (especially politicians and editors), pointing out that the Warren Commission made as thorough an investigation as humanly possible, that the charges of the critics are without serious foundation, and that further speculative discussion only plays into the hands of the opposition. Point out also that parts of the conspiracy talk appear to be deliberately generated by Communist propagandists. Urge them to use their influence to discourage unfounded and irresponsible speculation.

b. To employ propaganda assets to answer and refute the attacks of the critics. Book reviews and feature articles are particularly appropriate for this purpose. The unclassified attachments to this guidance should provide useful background material for passing to assets. Our ploy should point out, as applicable, that the critics are (I) wedded to theories adopted before the evidence was in, (I) politically interested, (III) financially interested, (IV) hasty and inaccurate in their research, or (V) infatuated with their own theories.

4. In private to media discussions not directed at any particular writer, or in attacking publications which may be yet forthcoming, the following arguments should be useful:

a. No significant new evidence has emerged which the Commission did not consider. The assassination is sometimes compared (e.g., by Joachim Joesten and Bertrand Russell) with the Dreyfus case; however, unlike that case, the attack on the Warren Commission have produced no new evidence, no new culprits have been convincingly identified, and there is no agreement among the critics. (A better parallel, though an imperfect one, might be with the Reichstag fire of 1933, which some competent historians (Fritz Tobias, AJ.P. Taylor, D.C. Watt) now believe was set by Vander Lubbe on his own initiative, without acting for either Nazis or Communists; the Nazis tried to pin the blame on the Communists, but the latter have been more successful in convincing the world that the Nazis were to blame.)
