Etwa 20 Senatorinnen und Senatoren hatten Klage eingereicht, da sie der Ansicht waren, der Präsident habe das Recht des Kongresses auf politische Kontrolle verletzt. Duque hätte beim Senat die verfassungsmäßig vorgeschriebene Anhörung beantragen müssen, die für den Einsatz ausländischer Truppen in Kolumbien erforderlich ist.
