Im Gegensatz zur Präsidentenwahl: In einem beispiellosen Schritt sagte der Oberste Gerichtshof die Stichwahl ab und annullierte die erste Wahlrunde – ohne Beweise für eine „russische Wahleinmischung“. Donald Trump called Robert F. Kennedy Jr. the “most radical left person running for office” in a late-night Truth Social post.
As noted on the Archives website: “The House of Representatives elects the President from the three (3) Presidential candidates who received the most electoral votes …”
Now, we come back to that magic number: 34.
If Kennedy were to get 34 percent of the vote, there would be a great deal of pressure on the House of Representatives to “do the right thing.”

I give you Donald J. Trump being elected our 45th president in 2016 as evidence as to why such a scenario is entirely possible.

Last Wednesday, for the second time this election season, an intruder entered Robert F. Kennedy Jr.‘s home in Los Angeles. He had written hundreds of emails to the campaign, which were included in its application for Secret Service protection, one of which made mention of a „bullet in [Mr. Kennedy‘s] brain.“ A month earlier, a man had showed up to one of Mr. Kennedy‘s campaign events carrying loaded weapons and posing as a U.S. Marshal.
In both cases, the individuals were apprehended by Mr. Kennedy‘s private security detail and turned over to the police. But the incidents demonstrate the necessity for Secret Service protection for Mr. Kennedy. Withholding protection puts him and members of the public who attend campaign events at risk. Furthermore, it would be incredibly destabilizing for our nation if another Kennedy came to harm in the course of Presidential politics.

After the abolishment of the reasonableness clause last week, the High Court did not issue an interim injunction to freeze the amendment to the law. Attempting to imagine an escape route which also includes Prime Minister Benjamin Netanyahu‘s acquittal of criminal charges, is a result of the painful realization that the hawkish factions on both sides – even though one can‘t compare the governmental sadism led by Justice Minister Yariv Levin and the most rigid and militant anti-overhaul protesters – ignore the will of the majority and charge onward, almost with lust, to the very dangerous disagreement known as a constitutional crisis.
This hope, however, whether you want to surrender to it or to resist it in disgust, is in no way realistic. For now. According to knowledgeable sources, Netanyahu is simply not interested: not in stopping the judicial overhaul nor in a unity government.

In 2021, the court outlined very narrow circumstances under which a Basic Law can be annulled. A number of petitions were filed challenging the constitutionality of the Nation State Law. While the court did not strike down the law, Supreme Court President Esther Hayut said that “there is one restriction, exceedingly narrow, which is incumbent on the Knesset in its function as the constituent authority, that it is unable to revoke Israel’s essence as a Jewish and democratic state through a Basic Law.”
The court could strike down a Basic Law if it endangers democratic principles such as those that deal “a mortal blow to free and fair elections, core human rights, the separation of powers, the rule of law, and an independent judiciary,” Hayut said.
“If the court dismisses the petitions, that could deflate the protests” against judicial overhaul, said Adam Shinar, a law professor at Reichman University in Herzliya, Israel. “But if the court acts against the government, that will inflame its critics. So you have all these strategic political considerations.”
“There is nothing to talk about with someone who decided to turn himself into [Russian President Vladimir] Putin and Israel into a dictatorship,” the protest statement continues, “we will fight Netanyahu to the end so that Israel remains a liberal democracy.”
In practice, constitutions can: achieve near-unalterable status, as in the United States; be frequently rewritten, as in many other countries in the Western hemisphere; be used to justify authoritarian forms of rule; or come to be entirely disregarded.
Israel, Britain and New Zealand are outliers, as they do not have constitutions, said Hanna Lerner, the author of “Making Constitutions in Deeply Divided Societies.” The United Kingdom and New Zealand rely on common law, bodies of legal thinking and precedent developed over centuries, which serve a de facto constitutional role.

The left is no longer capable of overcoming the toxic ultra-nationalism that has evolved here, the kind whose European strain almost wiped out a majority of the Jewish people. The interviews Haaretz’s Ravit Hecht held with Smotrich and Zohar (December 3, 2016 and October 28, 2017) should be widely disseminated on all media outlets in Israel and throughout the Jewish world. In both of them we see not just a growing Israeli fascism but racism akin to Nazism in its early stages.

Moreover, since their inception demonstrations have had a place in the political imagination of democracy. We will make sure that the Covid-era suspension of the right to assembly, trial by jury, and freedom of worship will never happen again. The same for the right to property. During Covid, 3.4 million business were forced to close. Many of them, including 60% of Black-owned businesses, will never reopen.
A Kennedy administration will respect American citizens and stop treating them like suspects and schoolchildren. We will stop manipulating the public with propaganda and targeted leaks. We will never weaponize the law against political opponents, nor hold our own officials above the law. We will return the intelligence agencies to their proper role as protectors not violators of liberty.

Dabei frisst der Linkskörper nicht nur sich selbst. Er frisst auch alle Ideen und Errungenschaften, die er angeblich vertritt. In Wirklichkeit dienen den betreffenden etablierten Apparaten – ob Parteien, Gewerkschaften, „Nichtregierungsorganisationen“, assoziierte Presse und die Myraden von Schnattergruppen – diese Ideen und Errungenschaften nicht als Rechtfertigung, sondern als Nahrung.

The constitution is the guiding force behind the US. The president, federal officers and all members of the military swear to defend it.
Though written at the end of the 18th century, many of the lessons from the debate over its adoption are of interest to us in modern-day Israel: namely the maintenance of equality between the three branches of government, the preservation of checks and balances, the need to maintain a strong judiciary but also the need to retain a path to override Supreme Court decisions, the importance of harnessing the talents of high-level visionaries and the need to maintain a broad consensus before initiating reform.

“After 75 years, it’s time for a constitution for the State of Israel,” which would fix Israel’s government system, protect human rights and enshrine the Declaration of Independence, MQG head Eliad Shraga said during a press conference at the group’s judicial reform protest tent in front of the Supreme Court in Jerusalem. The movement presented the proposal to President Isaac Herzog on Wednesday night, he said.
Lapid said that while “judicial activism” should be limited, “a democratic state cannot exist without a strong and independent court.”
In addition, the Yesh Atid leader said that the judicial appointment committee would have its composition changed so that the Supreme Court is “diverse in its composition and opinions, but will ensure that politicians — from any side — will not have control over the selection of judges.”
On his Facebook page, the former prime minister argued that this constitution should begin with the first paragraph of Israel‘s 1948 Declaration of Independence, which states that the land of Israel is the cradle of the Jewish people.
According to Lapid, this constitution should be composed of three fundamental laws: the first would be a declaration of the superiority of the fundamental laws of the country, and would subject all authorities to restrictions established by law.

THE STATE OF ISRAEL will be open for Jewish immigration and for the Ingathering of the Exiles; it will foster the development of the country for the benefit of all its inhabitants; it will be based on freedom, justice and peace as envisaged by the prophets of Israel; it will ensure complete equality of social and political rights to all its inhabitants irrespective of religion, race or sex; it will guarantee freedom of religion, conscience, language, education and culture; it will safeguard the Holy Places of all religions; and it will be faithful to the principles of the Charter of the United Nations.
