The Solicitor General does not dispute that OSHA is limited to regulating “work-related dangers.” Response Brief for OSHA in No. 21A244 etc., p. 45 (OSHA Response). She instead argues that the risk of contracting COVID–19 qualifies as such a danger. We cannot agree. Although COVID–19 is a risk that occurs in many workplaces, it is not an occupational hazard in most. COVID–19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases. Permitting OSHA to regulate the hazards of daily life—simply because most Americans have jobs and face those same risks while on the clock—would significantly expand OSHA’s regulatory authority without clear congressional authorization.

On June 22, 2001, a group of well-known U.S. officials and a handful of senior policymakers gathered at Andrews Air Force Base in Maryland for a senior-level exercise that simulated a biological weapons attack—an outbreak of deadly smallpox—on the United States. Designed by the Johns Hopkins Center for Civilian Biodefense Strategies (now called the Center for Health Security) and the Washington-based Center for Strategic and International Studies (CSIS), the day-and-a-half-long “Dark Winter” simulation was conducted to gauge how senior leaders would respond to such an attack and included such high-level participants as Sen. Sam Nunn (who played the president), former White House advisor David Gergen (the national security advisor), and the retired career diplomat Frank Wisner (the secretary of state). But Dark Winter has since become legendary in senior policymaking circles in Washington for a different reason: It has regularly been cited by its designers and participants as the clearest exhibit of the spiraling stresses, and potential social collapse, that could be sparked by a public health crisis.

Administrative agencies are creatures of statute. They accordingly possess only the authority that Congress has provided. The Secretary has ordered 84 million Americans to either obtain a COVID–19 vaccine or undergo weekly medical testing at their own expense. This is no “everyday exercise of federal power.” In re MCP No. 165, 20 F. 4th, at 272 (Sutton, C. J., dissenting). It is instead a significant encroachment into the lives—and health—of a vast number of employees. “We expect Congress to speak clearly when authorizing an agency to exercise powers of vast economic and political significance.” Alabama Assn. of Realtors v. U. S. ___, ___ (2021) (per curiam) (slip op., at 6) (internal quotation marks omitted). There can be little doubt that OSHA’s mandate qualifies as an exercise of such authority. The question, then, is whether the Act plainly authorizes the Secretary’s mandate. It does not. The Act empowers the Secretary to set workplace safety standards, not broad public health measures.

The Solicitor General does not dispute that OSHA is limited to regulating “work-related dangers.” Response Brief for OSHA in No. 21A244 etc., p. 45 (OSHA Response). She instead argues that the risk of contracting COVID–19 qualifies as such a danger. We cannot agree. Although COVID–19 is a risk that occurs in many workplaces, it is not an occupational hazard in most. COVID–19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases. Permitting OSHA to regulate the hazards of daily life—simply because most Americans have jobs and face those same risks while on the clock—would significantly expand OSHA’s regulatory authority without clear congressional authorization.

As we have stated for months, the federal government doesn’t get to be your nanny, and it shouldn’t get to be your doctor. It has used this COVID-19 emergency to commandeer too many liberties that are solely afforded to sovereign states and free Americans. History has taught us that once a government takes rights from its citizens, they are almost never recovered. States must be vigilant and always ready to challenge a federal government that is growing too fast and too powerful.

China scraps inbound quarantine rules in decisive break with zero-Covid regime

China will remove quarantine requirements for inbound travellers from January 8 as the country dismantles the remnants of a zero-Covid regime that closed it off from the rest of the world for almost three years.

The National Health Commission on Monday unveiled the move as part of a wider announcement that downgraded the country’s management of Covid-19 and definitively abandoned a host of other preventive measures.

Palestinian Lawyer Salah Hamouri is to be Deported to France on Sunday

Hamouri, a lawyer and a field researcher with the Addameer Prisoners’ Support and Human Rights Association, spent more than eight years in Israeli prisons, starting when he was abducted in 2001 and was sentenced to five months in prison. In 2004 he spent four months under arbitrary Administrative Detention orders without charges, then was abducted again in the year 2005 and was imprisoned for seven years, and then in the year 2017, he was abducted yet another time and spent 13 months under Administrative Detention orders, and upon his release, he received an order barring him from entering the rest of the West Bank for two years.

On June 6, 2022, Salah received another three-month Administrative Detention order just hours before his scheduled release after being imprisoned for three months under a similar order. The decision to revoke his residency was made in October of last year, 2021, after accusing him of “breeching loyalty to the state” for his human rights and legal work in defending Palestinian political prisoners.

Hamouri was born to a Palestinian father from Jerusalem where he grew up and lived, and his mother is a French national. Several years earlier, Israel deported his French wife, Elsa Lefort, to her country after detaining her at the airport in Tel Aviv for three days when she returned to Jerusalem. The lawyer and his wife have two children.

Palestinians born in occupied Jerusalem are only granted “residency status” and not citizenship of Israel despite Israel’s constant claims of “unified Jerusalem as its capital.”

France condemned Israel’s decision to deport Palestinian lawyer Salah Hammouri, who holds French citizenship, on Sunday morning by order of Interior Minister Ayelet Shaked, following a years-long effort by Israeli authorities to revoke his residency status.

“Today, we condemn the illegal decision of the Israeli authorities to deport Mr. Salah Hammouri to France,” the statement read.
