Michael Flynn case places both FBI integrity and civil liberty on the line

More than a year ago I wrote a series of columns that made the point that former national security adviser Michael Flynn had been set up by the FBI and may have committed no crime. I repeated my legal arguments in several interviews. This led the professional Trump-bashers — who care more about “getting” Trump than about protecting civil liberties — to attack me for “inventing” legal principles that help the Trump team.

Explosive Revelations in the Flynn Case

(27.04.2020)

As I’ve noted several times over the years, it has long been speculated that Flynn — though he did not believe he was guilty (and though the agents who interviewed him also did not believe he had intentionally misled them) — nevertheless pled guilty to false-statements charges because prosecutors from Special Counsel Robert Mueller’s staff threatened him. Specifically, Flynn is said to have been warned that, if he refused to plead guilty, prosecutors would charge his son with a felony for failing to register with the Justice Department as a foreign agent. Such a so-called FARA violation (Foreign Agent Registration Act) is a crime that the DOJ almost never charged before the Mueller investigation, and it had dubious application to Flynn’s son (who worked for Flynn’s private-intelligence firm).

The Republican Senate just rebuked Trump using the War Powers Act — for the third time. That’s remarkable.

Such votes are rare in part because, for the past two decades, presidents have relied on the 2001 Authorization for Use of Military Force (AUMF), which Congress passed after the Sept. 11, 2001, terrorist attacks. But nearly 20 years later, presidents increasingly must resort to contorted interpretations of the law to argue that it covers new conflicts. It took three days for Iowa Democratic Party volunteers to check all the caucus results worksheets that arrived by email. One results page didn’t reach Des Moines until Thursday — it had been sent through the Postal Service.

Iowa Democrats need new state chair–and new attorney

A February 6 written statement from Price acknowledged that the reporting problems on caucus night “were unacceptable.” What he went on to say raised red flags (emphasis added):

“Should any presidential campaign in compliance with the Iowa Delegate Selection Plan request a recanvass, the IDP is prepared. In such a circumstance, the IDP will audit the paper records of report, as provided by the precinct chairs and signed by representatives of presidential campaigns. This is the official record of the Iowa Democratic caucus, and we are committed to ensuring the results accurately reflect the preference of Iowans.”

What about those dozens of precincts where the official record submitted by the precinct chair did not accurately reflect the preference of caucus-goers in the room, because one candidate received too many or not enough delegates?

IDP leaders decided to stick with the flawed official record.

Democrats scramble to rein in Trump’s Iran war powers

Lawmakers looking to limit Trump’s ability to take military action against Iran face a tight time frame with little room for error after House Speaker Nancy Pelosi (D-Calif.) announced she will send the articles of impeachment to the Senate this week. Once the trial begins, all legislation is expected to be delayed for weeks.

But a resolution from Sen. Tim Kaine (D-Va.) can come to the Senate floor as soon as Tuesday morning, and he has been trying to win over the four GOP votes needed, in addition to every Democratic senator, to get to 51 votes.

He got a major break Wednesday when Republican Sens. Mike Lee (Utah) and Rand Paul (Ky.) told reporters they’d back his effort. Since then, Kaine said, he has spoken with eight or nine more senators from the 53-member GOP caucus, with more meetings planned.

He needs 51 votes for the resolution to pass. A vote could come as soon as Tuesday. Kaine said he has agreed to remove references to President Trump from the resolution — it would, of course, apply to all presidents — and to make other technical changes.

As Knesset Speaker, Yuli Edelstein has the authority to block the Knesset Arrangements Committee from meeting, thereby blocking the convening of the House Committee and preventing it from discussing the immunity request.

This is Edelstein’s most important test as an elected official: Will he be faithful to his position as Knesset speaker, or will he be faithful to the man who has decided to hold the country hostage?

Requesting Immunity, Master Manipulator Netanyahu Gave One of the Worst Performances of His Life

By requesting immunity Netanyahu hopes to postpone all of this until after the March 2 election. But he knows from all the incessant polling he has carried out that this is a hard sell, even among his right-wing base. In recent days, he tried to float his “immunity is a cornerstone of democracy” canard, but it didn’t fly.

Netanyahu Announces He Is Requesting Immunity From Prosecution in Three Criminal Cases

According to Israeli law, the Knesset House Committee is to discuss his request and should it be approved, the request will need to pass a vote by the Knesset plenum.

However, since the House Committee has not been appointed since the April general election, and is not expected to be assembled before the upcoming March election, the discussion will only take place in several months. Until the committee makes a decision, an indictment against Netanyahu can’t be handed officially to the court.

For a decade, Netanyahu dominated Israel like few others since founding prime minister David Ben-Gurion, leaving a huge imprint on every sphere: diplomatic, economic, military.

But in 2019 – Netanyahu’s own annus horribilis, as Queen Elizabeth II referred to her own “horrible year” in 1992 – his utter dominance began to fade.

Israel’s Attorney General and Other Cowards in the Face of Netanyahu

We’re in this situation because of the cowards – people like Mendelblit, who had no problem accepting a role as a gatekeeper without growing the requisite backbone. We’re here because for months after the recommendations by the police and the prosecution, the attorney general continued to drag his feet.

And after deciding to file indictments, he didn’t intervene as Netanyahu dragged us into yet another election while using all the power of his status to vilify the legal system that the attorney general is supposed to defend.

Israeli Patriots and Justice Seekers Should Look to the Hague With Hope

Israel has done everything to reach The Hague. That’s what happens when the prosecution is a cemetery for war crimes, the High Court whitewashes them and the media hides them and covers for them. That’s the way it is when international law is disparaged for decades. There’s probably no other country that thumbs its nose at international law this way and pays no price for it.
