In a resolution (A/HRC/55/L.30) on the Human rights situation in the occupied Palestinian territory, including East Jerusalem, and the obligation to ensure accountability and justice, adopted by a vote of 28 in favour, 6 against and 13 abstentions (as orally revised), the Council demands that Israel, the occupying power, end its occupation of the Palestinian territory occupied since 1967, including East Jerusalem; also demands that Israel immediately lift its blockade on the Gaza Strip and all other forms of collective punishment; calls for an immediate ceasefire in Gaza, for immediate emergency humanitarian access and assistance, and for the urgent restoration of basic necessities to the Palestinian population in Gaza; calls upon all States to take immediate action to prevent the continued forcible transfer of Palestinians within or from Gaza; calls upon all States to cease the sale, transfer and diversion of arms, munitions and other military equipment to Israel; urges all States to continue to provide emergency assistance to the Palestinian people and calls upon all States to ensure that the United Nations Relief and Works Agency for Palestine Refugees in the Near East receives predictable sustained and sufficient funding to fulfil its mandate; invites the General Assembly to recommend that the Government of Switzerland promptly convene the Conference of High Contracting Parties to the Fourth Convention on measures to enforce the Convention in the occupied Palestinian territory, including East Jerusalem; requests the Independent International Commission of Inquiry on the occupied Palestinian territory, including East Jerusalem, and Israel to report on both the direct and indirect transfer or sale of arms, munitions, parts, components and dual use items to Israel, the occupying power, and to analyse the legal consequences of these transfers, and to present its report to the Council at its fifty-ninth session; requests the Secretary-General to ensure the availability of all additional resources, including through voluntary resources, necessary to enable the Commission of Inquiry to carry out its mandate; requests the Office of the High Commissioner to deploy the additional necessary personnel, expertise and logistics to the occupied Palestinian territory country office to document and pursue accountability for violations of international human rights law and international humanitarian law committed in the occupied Palestinian territory, including East Jerusalem; and requests the High Commissioner for Human Rights to report on the implementation of the present resolution to the Council at its fifty-eighth session, to be followed by an interactive dialogue; and decides to remain seized of the matter.

On October 17, the Misgav Institute for National Security & Zionist Strategy published a position paper advocating for the “relocation and final settlement of the entire Gaza population.” The report advocates exploiting the current moment to accomplish a long-held Zionist goal of moving Palestinians off the land of historic Palestine. The report’s subtitle makes it clear: “There is at the moment a unique and rare opportunity to evacuate the whole Gaza Strip in coordination with the Egyptian government.”

The Misgav Institute is headed by former Netanyahu National Security Advisor Meir Ben Shabbat, who remains influential in Israeli security circles. 9. In recent years, a number of reputable scholars and organizations have concluded that systemic and widespread discriminatory Israeli policies and practices against the Palestinians amount to the crime of apartheid under international law. While the international community has not fully acted upon it, the concept that Israeli occupation meets the legal threshold of apartheid is gaining traction. This may help overcome a certain tendency to scrutinize Israeli violations, often individual and
decontextualized, under specific bodies of international law rather than the very system through which Israel rules over the Palestinians.

10. At the same time, if considered alone and not as part of a holistic examination of the experience of the Palestinian people as a whole, the apartheid framework presents some limitations:

(a) First, with few exceptions, the scope of recent reports on Israeli apartheid is primarily “territorial” and excludes the experience of Palestinian refugees. The recognition of Israeli apartheid must address the experience of the Palestinian people in its entirety and in their unity as a people, including those who were displaced, denationalized and dispossessed in 1947–1949 (many of whom live in the occupied Palestinian territory);

(b) Second, a focus on Israeli apartheid alone misses the inherent illegality of the Israeli occupation of the Palestinian territory, including East Jerusalem. The Israeli occupation is illegal because it has proven not to be temporary, is deliberately administered against the best interests of the occupied population and has resulted in the annexation of occupied territory, breaching most obligations imposed on the occupying Power. Its illegality also stems from its systematic violation of at least three peremptory norms of international law: the prohibition on the acquisition of territory through the use of force; the prohibition on imposing regimes of alien subjugation, domination and exploitation, including racial discrimination and apartheid; and the obligation of States to respect the right of peoples to self-determination. By the same token, Israeli occupation constitutes an unjustified use of force and an act of aggression.9 Such an occupation is unequivocally prohibited under international law and contrary to the values, purposes and principles of the United Nations as enshrined in its Charter;

(c) Third, the apartheid framework does not address the “root causes” of the web of racially discriminatory laws, orders and policies that have regulated daily life in the occupied Palestinian territory since 1967 and Israeli animus (intention) in seizing land while subjugating and displacing its indigenous people and replacing them with its nationals. This is the hallmark of settler-colonialism, and a war crime
under the Rome Statute.

11. In essence, the limitations of the apartheid framework as currently applied bypass the critical issue of the recognition of the Palestinian people’s fundamental right to determine their political, social and economic status and develop as a people, free from foreign occupation, rule and exploitation. Dismantling the Israeli apartheid in the occupied Palestinian territory in particular, while necessary, will not
automatically address the question of Israeli domination over the Palestinians, restore permanent sovereignty over the lands Israel occupies and the natural resources therein, nor, on its own, fulfil Palestinian political aspirations.

B‘Tselem welcomes Amnesty International‘s new report, calling the Israeli regime what it is: apartheid.

This is an essential step in the struggle to change this reality, towards a future where all people living here will enjoy justice, equality and respect for their human rights.

The panic sounded by Israeli Minister of Foreign Affairs Yair Lapid, as well as the false claims made by various Israeli “Hasbara” organizations, as if the report is an attempt to deny the State of Israel’s right to exist, reveal their stance – that a regime of Jewish supremacy is justifiable, and should be perpetuated. Yet, the demand for equality and for the protection of human rights for all, threatens only those opposed to these values. The claim that this demand causes them harm makes it abundantly clear which side they have chosen.

Israel’s apartheid against Palestinians: a cruel system of domination and a crime against humanity

Israeli authorities must be held accountable for committing the crime of apartheid against Palestinians, Amnesty International said today in a damning new report. The investigation details how Israel enforces a system of oppression and domination against the Palestinian people wherever it has control over their rights. This includes Palestinians living in Israel and the Occupied Palestinian Territories (OPT), as well as displaced refugees in other countries.

The comprehensive report, Israel’s Apartheid against Palestinians: Cruel System of Domination and Crime against Humanity, sets out how massive seizures of Palestinian land and property, unlawful killings, forcible transfer, drastic movement restrictions, and the denial of nationality and citizenship to Palestinians are all components of a system which amounts to apartheid under international law. This system is maintained by violations which Amnesty International found to constitute apartheid as a crime against humanity, as defined in the Rome Statute and Apartheid Convention.

“Change” Gov’t Approves 31 New Projects in Occupied West Bank

On Friday, June 25, the United Nations accused Israel of blatantly violating international law and called on it to halt the illegal expansions in settlements. According to Al-Ittihad, Antonio Guterres, UN Secretary-General and Tor Wennesland, UN Mideast envoy, cited Security Council resolution 2334 from December 2016 that declared the occupation’s settlements as having “no legal validity.”

“I again underscore, in no uncertain terms, that Israeli settlements constitute a flagrant violation of United Nations resolutions and international law,” Wennesland said. “They are a major obstacle to the achievement of a two-state solution and a just, long lasting and comprehensive peace. The advancement of all settlement activity must cease immediately.

Zwangsweise Einzel- oder Massenumsiedlungen sowie Deportationen von geschützten Personen aus besetztem Gebiet nach dem Gebiet der Besetzungsmacht oder dem irgendeines anderen besetzten oder unbesetzten Staates sind ohne Rücksicht auf ihren Beweggrund verboten.

Solche Evakuierungen dürfen nicht die Umsiedlungen von geschützten Personen in Gebiete ausserhalb der Grenzen des besetzten Gebietes zur Folge haben, es sei denn, eine solche Umsiedlung liesse sich aus materiellen Gründen nicht vermeiden. Unmittelbar nach Beendigung der Feindseligkeiten in dem in Frage stehenden Gebiet soll die so evakuierte Bevölkerung in ihre Heimstätten zurückgeführt werden.

Die Besetzungsmacht hat bei der Durchführung derartiger Umsiedlungen oder Evakuierungen im Rahmen des Möglichen dafür zu sorgen, dass angemessene Unterkunft für die Aufnahme der geschützten Personen vorgesehen wird, dass die Umsiedlung in bezug auf Sauberkeit, Hygiene, Sicherheit und Verpflegung unter befriedigenden Bedingungen durchgeführt wird und Mitglieder derselben Familie nicht voneinander getrennt werden.

Die Schutzmacht soll von allen Umsiedlungen und Evakuierungen verständigt werden, sobald sie stattgefunden haben.

Die Besetzungsmacht darf geschützte Personen nicht einer in besonders den Kriegsgefahren ausgesetzten Gegend zurückhalten, sofern nicht die Sicherheit der Bevölkerung oder zwingende militärische Gründe dies erfordern.

Die Besetzungsmacht darf nicht Teile ihrer eigenen Zivilbevölkerung in das von ihr besetzte Gebiet deportieren oder umsiedeln.

Art. 49. Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive.

Nevertheless, the Occupying Power may undertake total or partial evacuation of a given area if the security of the population or imperative military reasons so demand. Such evacuations may not involve the displacement of protected persons outside the bounds of the occupied territory except when for material reasons it is impossible to avoid such displacement. Persons thus evacuated shall be transferred back to their homes as soon as hostilities in the area in question have ceased.

The Occupying Power undertaking such transfers or evacuations shall ensure, to the greatest practicable extent, that proper accommodation is provided to receive the protected persons, that the removals are effected in satisfactory conditions of hygiene, health, safety and nutrition, and that members of the same family are not separated.

The Protecting Power shall be informed of any transfers and evacuations as soon as they have taken place.

The Occupying Power shall not detain protected persons in an area particularly exposed to the dangers of war unless the security of the population or imperative military reasons so demand.

The Occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies.
