Accountability Now: Palestinians Sue German Government officials for Enabling the Genocide in Gaza

Berlin – 23 February 2024

Today, a group of German lawyers – representing families of two Gazans – is filing a criminal complaint against German Government officials[1], for the crime of aiding and abetting genocide against the Palestinian people in Gaza by providing Israel with weapons and issuing related export permissions. They are supported by civil society organisations ELSC (European Legal Support Center), PIPD (Palestine Institute for Public Diplomacy) and Law for Palestine under the Justice and Accountability for Palestine Initiative. The charges are being filed at the Office of the Federal Prosecutor in Karlsruhe (‘Generalbundesanwaltschaft’).

In a historic ruling on 26 January 2024 in the case filed by South Africa against Israel for the crime of Genocide, the International Court of Justice (ICJ) ordered provisional measures against the “serious risk” of genocide and stated that the latter is “plausibly taking place”.

Humanitarian leaders unite in urgent plea for Gaza

For that, they stressed the need for 10 indispensable elements: an immediate ceasefire; protection of civilians and civilian infrastructure; immediate release of hostages; reliable entry points for aid; security assurances and unimpeded access; a functioning humanitarian notification system; roads cleared of explosive ordnance; and a stable communication network.

In addition, they called for the UN agency assisting Palestine refugees (UNRWA) to receive the resources it needs to provide life-saving assistance as well as a halt to campaigns seeking to discredit the UN and NGOs doing their best to save lives.

Wenn ich diesen Wunsch nach einem globalen Netzwerk im Mastodon-Umfeld äußere, sind die Reaktionen oft ablehnend bis aggressiv. Ich bekomme Dinge wie „Geh doch zu Twitter“ an den Kopf geworfen. Oder: „Ihr mit euren kurzfristigen, journalistischen Bedürfnissen!“, „Ihr wollt doch nur Aufmerksamkeit“, „Ihr mit Eurer Twitter-Kultur“, „Wir machen das hier aber anders und ihr müsst euch anpassen“.

Das macht mich wütend.

Biden regularly begs Israel to let in more trucks, paid for by the U.S. At the same time the Biden administration exercises veto power on the U.N. Security Council blocking a cease-fire, truce, or negotiations toward a permanent two-state resolution. A cease-fire would at least allow aid to reach the besieged.

Civil unrest, legal appeals and military disobedience: What Israel may face after Supreme Court law change

In 2021, the court outlined very narrow circumstances under which a Basic Law can be annulled. A number of petitions were filed challenging the constitutionality of the Nation State Law. While the court did not strike down the law, Supreme Court President Esther Hayut said that “there is one restriction, exceedingly narrow, which is incumbent on the Knesset in its function as the constituent authority, that it is unable to revoke Israel’s essence as a Jewish and democratic state through a Basic Law.”

The court could strike down a Basic Law if it endangers democratic principles such as those that deal “a mortal blow to free and fair elections, core human rights, the separation of powers, the rule of law, and an independent judiciary,” Hayut said.

Votel, steil aufgestiegen vom Leiter des Kommdos für Sonderoperationen (S.O.C.O.M.) zum Leiter des Zentralkommandos, hatte sich im Mai unter Begleitung von diverser U.S.-Presse zu einem Besuch in den eroberten Teil Syriens begeben – wir fragten diesbezüglich, ob zu “geheimer Vorbereitung für einen bevorstehenden Coup”.

Wohlgemerkt: die nun von Votel gestern im Aspen Think Tank vorgetragenen “Besorgnisse” hat die U.S.-Militär- und Kriegslobby schon in der Nacht zum 16. Juli, als sich das Scheitern des Putsches abzeichnet. Die “Washington Post” ändert ihre diesbezügliche Schlagzeile (vorher / nachher).

Gerade auf Votels nun fast zwei Wochen später gezielt gestartete Provokation antwortet Tayyip Erdogan, der in der Nacht des Putsches gerade noch dem Schicksal von Ägyptens demokratisch gewählten Präsident Mohammed Mursi entging, in bislang ungekannter Deutlichkeit: Zentralkommando-Leiter Votel stelle sich damit auf die Seite der Putschisten. Wer dieser General Votel überhaupt sei, was er sich einbilde.

Nicht nur für N.A.T.O.-Verhältnisse ein Präzedenzfall.

Open Letter to the British Government on the Online Safety Bill

Global providers of end-to-end encrypted products and services cannot weaken the security of their products and services to suit individual governments. There cannot be a “British internet,” or a version of end-to-end encryption that is specific to the UK.

The UK Government must urgently rethink the Bill, revising it to encourage companies to offer more privacy and security to its residents, not less. Weakening encryption, undermining privacy, and introducing the mass surveillance of people’s private communications is not the way forward.

Offener Brief an Bundeskanzler Scholz

Wir teilen das Urteil über die russische Aggression als Bruch der Grundnorm des Völkerrechts. Wir teilen auch die Überzeugung, dass es eine prinzipielle politisch-moralische Pflicht gibt, vor aggressiver Gewalt nicht ohne Gegenwehr zurückzuweichen. Doch alles, was sich daraus ableiten lässt, hat Grenzen in anderen Geboten der politischen Ethik.

Zwei solche Grenzlinien sind nach unserer Überzeugung jetzt erreicht: Erstens das kategorische Verbot, ein manifestes Risiko der Eskalation dieses Krieges zu einem atomaren Konflikt in Kauf zu nehmen. Die Lieferung großer Mengen schwerer Waffen allerdings könnte Deutschland selbst zur Kriegspartei machen. Und ein russischer Gegenschlag könnte so dann den Beistandsfall nach dem NATO-Vertrag und damit die unmittelbare Gefahr eines Weltkriegs auslösen. Die zweite Grenzlinie ist das Maß an Zerstörung und menschlichem Leid unter der ukrainischen Zivilbevölkerung. Selbst der berechtigte Widerstand gegen einen Aggressor steht dazu irgendwann in einem unerträglichen Missverhältnis.
