Congress requires the President to “mak[e] public proclamation” of his intention to invoke the Alien Enemies Act. §21. President Trump did just the opposite. In what can be understood only as covert preparation to skirt both the requirements of the Act and the Constitution’s guarantee of due process, the Department of Homeland Security (DHS) began moving Venezuelan migrants from Immigration and Customs Enforcement detention centers across the country to the El Valle Detention Facility in South Texas before the President had even signed the Proclamation. ___ F. The transferred detainees, most of whom denied past or present affiliation with any gang, did not know the reason for their transfer until the evening of Friday, March 14, when they were apparently “pulled from their cells and told that they would be deported the next day to an unknown destination.”

Suspecting that the President had covertly signed a Proclamation invoking the Alien Enemies Act, several lawyers anticipated their clients’ imminent deportation and filed a putative class action in the District of Columbia. App. to Brief in Opposition To Application To Vacate 9a (App. to BIO). They contested that Tren de Aragua had committed or attempted the kind of “ ‘invasion’ ” or “ ‘predatory incursion’ ” required to invoke the Alien Enemies Act. Ibid. They also asserted that it would violate the Due Process Clause to deport their clients before they had any chance to challenge the Government’s allegations of gang membership. Id., at 26a. The plaintiffs did not seek release from custody, but asked the court only to restrain the Government’s planned deportations under the Proclamation. Id., at 9a, 29a.

In the early morning of March 15, the District Court informed the Government of the lawsuit and scheduled an emergency hearing. Despite knowing of plaintiffs’ claim
that it would be unlawful to remove them under the Proclamation, the Government ushered the named plaintiffs onto planes along with dozens of other detainees, all without any opportunity to contact their lawyers, much less notice or opportunity to be heard.

Supreme Court requires noncitizens to challenge detention and removal in Texas

Justice Sonia Sotomayor penned a 17-page dissent joined in full by Justices Elena Kagan and Ketanji Brown Jackson and in part by Justice Amy Coney Barrett. She contended that her colleagues’ “decision to intervene in this litigation is as inexplicable as it is dangerous.”

Jackson wrote her own two-page dissent in which she lamented that the majority’s “fly-by-night approach to the work of the Supreme Court is not only misguided. It is also dangerous.”

The 1798 law at the center of the case is the Alien Enemies Act, which allows the president to detain or deport citizens of an enemy nation without a hearing or any other review by a court if either of two things occurs: Congress declares war, or there is an “invasion” or “predatory incursion.” The law has been invoked only three times – during the War of 1812, World War I, and World War II.

Netanyahu’s Govt’ Wishes to Silence Anyone Who Exposes Its Crimes

Several anti-democratic bills passed on preliminary vote in the Knesset plenum on Wednesday, February 19. First, a bill proposal to heavily tax donations by foreign countries to NGOs in Israel. According to the proposal, authored by Likud MK Ariel Kallner, donations to NGOs from a “foreign state entity” will be taxed at 80%, but the finance minister, with the approval of the Knesset Finance Committee, can award a tax exemption in “special circumstances.” In addition, the law says the court system will not hear cases filed by NGOs whose “main funding” is from foreign state entities and who do not receive Israeli state funding.

Also, the Knesset advanced a bill on Wednesday that bans Israeli citizens, authorities, and public bodies from “cooperating with the International Criminal Court (ICC) in The Hague.

The laws passed yesterday in a preliminary vote sanction people who cooperate with the ICC and limit the ability of human rights groups to petition the Supreme Court. They are withholding access to the court for the most vulnerable groups and leaving it open just for supporters of the regime. Netanyahu’s government is waging war on civil society and wishes to silence anyone who exposes its crimes. We will not be quiet.”

ICJ president ‚plagiarised 32 percent of pro-Israel dissenting opinion‘

In July, a 15-judge panel found that Israel‘s decades-long occupation of the Palestinian territories was „unlawful“ and that its „near-complete separation“ of people in the occupied West Bank breached international laws concerning „racial segregation“ and „apartheid“.

While most judges agreed with the advisory opinion, Sebutinde rejected the findings.

Dieser zeigte dann sein wahres, korruptes Gesicht in aller Schäbigkeit: Wo auch immer es Gelegenheit gab für Gates’ weltweiten Impf-Scam zu werben: Die Schwachmaten-Truppe aus Hamburg war ganz vorne mit dabei, sprach u.a. von Geiselhaft durch Ungeimpfte (wer hat wen eingesperrt?) und davon, dass die ganze Republik mit dem Finger auf Corona-Kritiker zeigen möge (ein bis heute ungesühnter Aufruf zur Volksverhetzung).

The law’s deliberate vagueness, and the fact that it only addresses “incitement to terrorism”—which is used almost exclusively to target Palestinians—while excluding incitement to violence or racism, highlights its discriminatory purpose. By granting broad, unchecked powers to political and administrative authorities, the law enables punitive actions to be taken against Palestinian educators for expressing views that fall outside the mainstream consensus, thereby severely undermining their basic right to freedom of expression. Adalah further argued that the law breaches the principle of the separation of powers, as it grants the Education Ministry the authority to infringe on teachers’ rights to freedom of expression and occupation, effectively requiring a determination of whether they have committed a criminal offense, even if no charges have been filed against them.

These bills seek to silence any remaining voices resisting the government’s policies of occupation and war. On past week, the Knesset plenum, in a preliminary reading, passed a proposed law that would amend the Students Rights Law, allowing most Israeli higher education institutions to implement gender separation. MK Son Har-Melech proposed the law, which 55 members of the Knesset (MKs) supported and 45 MKs opposed.

Only hours after the cabinet voted unanimously on Sunday to support a boycott of the left-wing Haaretz daily, the Ministerial Committee on Legislation gave its backing to a bill mandating the privatization of the Israeli Public Broadcasting Corporation within two years, effectively closing down the public broadcaster.

The private member’s bill, sponsored by Likud MK Tally Gotliv, would require the government to issue a tender for the purchase of the television and radio networks controlled by the IPBC, which operates the Kan public broadcaster and Reshet Bet radio, among others.

يُذكر أن السلطات المصرية ما زالت تحتجز عدداً كبيراً من المواطنين الذين تم اعتقالهم في أكتوبر من العام الماضي، أثناء المظاهرات التي اندلعت في القاهرة والإسكندرية في نهاية الشهر ذاته، بناءً على دعوة الرئيس عبد الفتاح السيسي، حيث تم اعتقال العشرات وحبسهم احتياطياً حتى الآن.
تدين الشبكة المصرية لحقوق الإنسان اعتقال المواطنين الذين يعبرون سلمياً عن دعمهم للأشقاء في فلسطين المحتلة ولبنان، ورفضهم للحرب على البلدين، وتطالب بسرعة الإفراج عنهم.

Egypt detains pro-Palestine protesters on 7 October anniversary, says rights group

According to the London-based Egyptian Network for Human Rights, a small group of young people held a protest on the Nile Corniche in Cairo on Monday, carrying Palestinian and Lebanese flags and banners condemning the deadly Israeli onslaught on Gaza and Lebanon.

Citing eyewitness accounts, the rights group said several participants were detained by security forces, but the exact number and names have yet to be confirmed.

“The Egyptian Network for Human Rights condemns the arrest of citizens peacefully expressing their support for their brothers and sisters in occupied Palestine and Lebanon and their opposition to the war on both countries, and calls for their immediate release,” the group said in a statement shared with Middle East Eye.

Israel deports two German citizens: Ben Gvir

Israeli National Security Minister Itamar Ben Gvir said that two „terrorist-supporting anarchists with German citizenship“ who allegedly entered an Israeli settlement in the occupied West Bank and „disturbed and clashed with soldiers“ have been deported.

“A special team that I established in the Israel police as soon as the war broke out acted with determination and speed to arrest and deport them,” the far-right minister wrote in a post on X.

“That’s the only way it works.”

Zur geplanten Resolution zum Schutz jüdischen Lebens in Deutschland – Ein Appell

Die öffentlich gewordene Fassung der geplanten Resolution „Nie wieder ist jetzt: Jüdisches Leben in Deutschland schützen, bewahren und stärken“ erfüllt uns jedoch mit großer Sorge. Nach ersten juristischen Einschätzungen kollidiert sie mit dem Grundgesetz, bringt eine mannigfaltige Rechtsunsicherheit, zweifelhafte Praktikabilität und die Gefahr der Diskriminierung mit sich. Durch die autoritative Verwendung der sehr weitreichenden und gleichzeitig unscharfen IHRA-Arbeitsdefinition als Regulierungsinstrument, sowie durch die unklare Frage faktischer Bindung einer Bundestags-Resolution, droht sie enorme Verunsicherung mit sich zu bringen und zum Verstummen jener Stimmen zu führen, die durch entsprechende Ansätze geschützt werden sollen. Ein immenser Schaden für unsere Demokratie wäre die Folge. Doch der Bekämpfung von Antisemitismus gebührt eine Resolution, die mit der demokratisch freiheitlichen Grundordnung in Einklang steht.

Civil society groups, artists and academics, myself included, have criticised the draft resolution in an open letter. We are particularly worried about the threat it presents to freedom of speech, alongside academic and artistic freedoms, while failing to achieve the goal it rightly sets itself.

The draft resolution recommends adopting the International Holocaust Remembrance Alliance (IHRA)’s definition of antisemitism as the standard for evaluating state funding requests and determining whether a project is antisemitic.

Ein „Bürgerrat“ für „Maßnahmen gegen Desinformation“ hat die „Prüfung einer strafrechtlichen Verfolgung und/oder Sanktionierung der Verbreitung von Desinformation“ empfohlen, außerdem solle ein freiwilliges Gütesiegel für „qualitativen Journalismus“ eingeführt werden, wie Medien berichten. Lebanon mourns the loss of leading novelist Elias Khoury

“Never in my life have I felt that life gives you more than you deserve more than at that moment, where literature transforms into reality,” Khoury said in an interview at the time.

Khoury’s well-known love for Palestine meant even more to Itani when he was falsely accused of collaborating with Israel in Lebanon in 2017.

Following SAG-AFTRA’s statement in sympathy with Israel regarding October 7, many SAG-AFTRA and sister guild members have watched in horror as the Israeli government wages a war of collective punishment on the civilian population of Gaza — killing over 40,000 Palestinians, injuring over 90,000 more, forcibly displacing 2 million people, and openly targeting members of the press and their families. As the IDF continues its assault on “safe zones,” schools, and hospitals, and as civilians in Gaza die from starvation, dehydration, and lack of medical supplies and fuel, major human rights groups have labeled these acts as war crimes, human rights atrocities, and even genocide. The UN has described Gaza as a “graveyard for children” — and estimate that by mid-July “half of the population — more than a million people — could face death and starvation.” As of now, there is no end in sight — only escalation, death, and destruction.
