US charges Hamas leader, other militants in connection with Oct. 7 massacre in Israel

WASHINGTON (AP) — The Justice Department announced criminal charges Tuesday against Hamas leader Yahya Sinwar and other senior militants in connection with the Oct. 7, 2023, rampage in Israel, marking the first effort by American law enforcement to formally call out the masterminds of the attack.

The seven-count criminal complaint filed in federal court in New York City includes charges such as conspiracy to provide material support to a foreign terrorist organization resulting in death, conspiracy to murder U.S. nationals and conspiracy to finance terrorism.

Im Juli 2023 klagten wir gegen die Schwärzungen. Die Anwälte des RKI beharrten im September gegenüber dem Gericht auf deren Angemessenheit, woraufhin unsere Anwälte im November antworteten. Die Gegenseite widersprach im Dezember erneut. Im Januar 2024 teilte das Gericht schließlich einen Termin zur mündlichen Verhandlung und Beweisaufnahme mit. Dieser ist anberaumt für Montag, den 6. Mai 2024 um 9:30 Uhr im Dienstgebäude des Verwaltungsgerichts Berlin, Kirchstraße 7. (Aktenzeichen VG 2 K 278/21)

Unsere Redaktion hatte ursprünglich geplant, mit der Veröffentlichung der Protokolle abzuwarten, bis ein Urteil des Gerichtes vorliegt. Nachdem Anfang dieses Jahres jedoch der Gerichtstermin bekannt gegeben wurde, entschieden wir, die Publikation vorzuziehen. Wir hoffen, das Gericht entscheidet im Sinne größtmöglicher Transparenz, so dass bestenfalls im Mai die weniger bis gar nicht mehr geschwärzten Protokolle vorliegen – was als wesentlicher Schritt zur weiteren, überfälligen, Aufarbeitung der Coronakrise zu werten wäre.

That case should not – and need not – have gone to the Court. To make sure the United States retains sovereign discretion to defend itself and its allies, any new American acceptance of the Court‘s compulsory jurisdiction should emulate the good sense of others like India and Kenya by excluding disputes involving armed conflict. America -acting alone or with its allies – still needs the freedom to protect freedom. The finger on the trigger cannot be that of the global judiciary.

Februar 2024 – Die Staatsanwaltschaft Berlin hat gegen Arne Semsrott, Chefredakteur von FragDenStaat, wegen der verbotenen Mitteilung über Gerichtsverhandlungen Anklage zum Landgericht Berlin erhoben. Die Gesellschaft für Freiheitsrechte (GFF) und Strafverteidiger Lukas Theune unterstützen Semsrott und FragDenStaat in dem gegen ihn geführten Strafverfahren. Kernpunkt der Verteidigung ist, dass die Strafnorm verfassungswidrig ist und gegen die Pressefreiheit verstößt.

Arne Semsrott hatte im August 2023 über die Ermittlungsmaßnahmen gegen die Letzte Generation und den unabhängigen Sender Radio Dreyeckland berichtet und im Zuge dessen mehrere relevante Gerichtsentscheidungen veröffentlicht. Er riskierte damit bewusst Strafanzeigen. Die Staatsanwaltschaft Berlin leitete ein Ermittlungsverfahren gegen ihn ein und erhob nun in dem Komplex zur Letzten Generation Anklage, wegen der besonderen Bedeutung des Falls sogar zum Landgericht. Die einschlägige Strafnorm (§ 353d Nr. 3 StGB) verbietet ohne Ausnahme jede Veröffentlichung des Wortlauts von Dokumenten eines laufenden Strafverfahrens vor der Hauptverhandlung. Das erschwert die Berichterstattung über Strafverfahren und schränkt damit die Pressefreiheit unverhältnismäßig ein.

1965 begannen die U.S.A. während des Krieges gegen Nordvietnam ein ebenso mörderisches, wie geheimes Bombardement gegen das neutrale Kambodscha, was bis 1954 Kolonie Frankreichs gewesen war. 2,7 Millionen Tonnen Bomben zwischen 1965 bis 1973 beförderten Kambodscha “zurück in die Steinzeit” und töteten 200.000 Menschen. Den U.S.-Bomberpiloten wurde vom Pentagon sogar verboten, die eigenen Vorgesetzten zu informieren. Die angeblichen Militärstützpunkte Nordvietnams in Kambodscha, wegen denen die Bombardements vermeintlich durchgeführt wurden, existierten nicht.

Was die Tat von Wahnsinnigen war, wurde nachher als “Wahnsinnigen-Theorie” (“Madman-Theory”) verkauft: die U.S.-Regierung unter Präsident Richard Nixon und Außenminister Henry Kissinger (der später den Friedensnobelpreis bekam) behauptete, sie habe sich wahnsinnig benommen, um der Sowjetunion Angst vor einem Atomkrieg zu machen, damit diese Druck auf Nordvietnam ausübe, damit das den Krieg gegen die U.S.A. beende, den die U.S.A. selbst begonnen hatten.

1970 stürzten die U.S.A. die Monarchie unter “Prinz” Sihanouk, installierten ein Proxy-Regime und marschierten in Kambodscha ein. Sihanouk, einst 1941 im Alter von achtzehn Jahren vom französischen Vichy-Regime unter deutscher Besatzung zum neuen König der damaligen französischen Kolonie Kambodscha ernannt, floh ins China Mao Tse Tungs und formierte dort eine kambodschanische “Freiheitsbewegung”. Deren Teil: die Roten Khmer.

1972 besuchte Richard Nixon als erster U.S.-Präsident China und Mao Tse Tung, im Versuch gegen das mit der Sowjetunion verbündete Nordvietnam einen Verbündeten zu finden und die Rivalitäten sowohl zwischen China und Vietnam, als auch zwischen China und der Sowjetunion zu schüren.

Als 1975 in Vietnam die Truppen des Vietkong und Nordvietnams in Saigon einmarschierten und den Krieg gegen die U.S.A. gewannen, marschierten in Kambodscha die Truppen der Roten Khmer – von China unterstützt und traditionell verfeindet mit den vietnamesischen Kommunisten – plötzlich in der Haupstadt Phnom Penh ein. Und setzten Prinz Sihanouk als offizielles Staatsoberhaupt ein.

Von der Schreckensherrschaft Pol Pots, auf dessen Killing Fields Millionen Leichen lagen und dessen Verbündeter Prinz Sihanouk nach wie vor im Land lebte, befreite Kambodscha 1979 nicht etwa die “negative Freiheit” der U.S.A., von Frankreich, oder der U.N.O., sondern die einrückenden Truppen des kommunistischen Vietnams.

Die Mörder der Roten Khmer, die gerade einen Genozid begangen hatten, flohen in Dschungel und begannen dort einen neuen Guerillakrieg – mit Unterstützung der U.S.A. und anderer ehrenwerter westlicher Länder. 1982 formierten die Massenmörder unter Führung Sihanouks eine Exilregierung, die von den U.S.A., der U.N.O und unwichtigen Ländereien Westeuropas anerkannt wurde.

Vizepräsident dieser kambodschanischen Exilregierung: das “Staatsoberhaupt” des Pol Pot Regimes von 1976-1979, Khieu Samphan. Er lebt heute noch. Er sagt, er hätte nichts gewusst.

Pol Pot wurde nie verfolgt. Dafür sorgten die U.S.A..

Neues altes Staatsoberhaupt Kambodschas wurde 1991 Sihanouk, nach dem Abzug der vietnamesischen Truppen. Er starb erst vor wenigen Tagen, am 15. Oktober 2012, in Peking.

A. Judge Lavergne, I would like to respond to your question based on my political view. Samdech Norodom Sihanouk was the Head of State of Cambodia. His position was the populist to preserve his throne. It was not Norodom Sihanouk. Lon Nol was

affiliated with the United States, and when he grasped or controlled the Assembly in 1966, he managed to — he really caused the dispute and the uprising in Samlaut at the Sihanoukist side, and the other side is the Communist side which are affiliated with Marxist and Leninist, and these things were mixed up.

I think through my understanding, if Richard Nixon did not be quick to allow Lon Nol to start the coup d‘etat and allowing Khmer Rouge to cooperate with Sihanouk, I think Khmer Rouge would be demolished or otherwise they would never be able to stand up again. But Mr. Kissinger and Richard Nixon weren‘t quick and the Khmer Rouge noted the golden opportunity and King Sihanouk declare from China that all Cambodian people go through the Marxist jungle and then the Khmer Rouge troop will build up from 1970 to 1975.

I think this is the political context and people tried to gain — to have political gain. Lon Nol tried to benefit from politics and then Sihanouk also tried to gain benefit for his side.

15-2 the judges ruled, that Israel must take all measures to stop acts that contravene Art 2 of the genocide convention.

What We Want

1. An Immediate and permanent ceasefire in Gaza.

We demand an immediate and permanent ceasefire in Gaza. Over 21,000+ Palestinians have been killed, 70% were women and children since October 7th. With 54,000+ injured, and approximately 1.8 million displaced in the last 3 months, the indiscriminate targeting of civilians by Israel must stop.

2. Stop the unconditional US funding of Israel’s genocide against Gaza and the occupation of Palestine.

It is abundantly clear that Israel’s genocide in Gaza is funded and supported by the United States. The hundreds of millions of dollars in ammunition transfers since October 7th, the back-and-forth shuttling of top-level US officials to Israel, the positioning of American aircraft carriers and the use of mercenaries has all been facilitated by the United States to bolster Israel’s murderous rampage in Gaza. We also firmly oppose current proposals in Congress to send an additional 14.3 billion dollars worth of weapons to Israel while it massacres Palestinian children daily. We demand an immediate and complete end to all US weapons transfers to Israel.

3. Hold Israel accountable for war crimes committed against the Palestinian people and their continuous violations of international law.

Israeli leaders have been very explicit in their intent to commit genocide in Gaza. Top ranked officials such as Netanyahu to lower rank government officials such as Galit Atbaryan have all called for the erasure of Gaza and the elimination of the Palestinian people. We call on the International Criminal Court to investigate and charge Israeli leaders with crimes against humanity for their intent and committal of well-documented atrocities against the people of Gaza and Gaza’s civilian infrastructure such as homes, schools, hospitals, mosques/churches, universities, roads, water and power infrastructure.

We also call on the US government to end their participation and complicity in Israel’s crimes against humanity and demand full and swift accountability for US and Israeli officials involved in this genocide.

The reasonableness law, an amendment to Basic Law: The Judiciary, prohibits courts, including the High Court, from reviewing government and ministerial decisions using the „reasonableness“ standard. High Court to strike down reasonableness law in ruling tonight, reports say

Hebrew media outlets report that the High Court of Justice will publish its ruling on the government’s “reasonableness law” this evening and that it will strike down the controversial legislation, which is an amendment to Basic Law: The Judiciary.

This would be the first time the court strikes down any aspect of one of Israel’s Basic Laws, which have quasi-constitutional status.

Shas set to push law allowing High Court to delay reasonableness ruling

Lawmakers from the Shas coalition party are reportedly seeking to advance a bill that would temporarily extend the time in which High Court justices can publish rulings on petitions, allowing the bench to postpone a decision that is widely expected to strike down a piece of the government’s judicial overhaul.
