Commissioner O’Flaherty also observes restrictions on events, symbols, or other forms of expression in this context. He recalls that member states have little scope to impose restrictions on political speech or on debate on matters of public interest, in line with the case-law of the European Court of Human Rights and the Council of Europe standards on freedom of expression, hate speech and hate crime. He urges the German authorities to be vigilant that the working definition of antisemitism of the International Holocaust Remembrance Alliance is not distorted, instrumentalised or misapplied to stifle freedom of expression and legitimate criticism, including of the state of Israel.

Recalling that member states have legal obligations to refrain from undue interference with human rights and to ensure the effective enjoyment of the rights to freedom of expression and peaceful assembly for all, the Commissioner asks the German authorities to avoid taking measures that discriminate against persons based on their political or other opinions, religion or belief, ethnic origin, nationality or migration status.

It is my understanding that since February 2025, the Berlin authorities have imposed restrictions on the use of the Arabic language and cultural symbols in the context of the protests. In some cases, such as an assembly in Berlin on 15 May 2025, marches have been restricted to stationary gatherings. Furthermore, protestors were allegedly subject to intrusive surveillance, online or in person, and arbitrary police checks. I am also concerned by reports of excessive use of force by police against protesters, including minors, sometimes leading to injuries.

I understand that restrictions have been justified on the basis that events, symbols, or other forms of expression “disrupt public order” or “disturb public peace”. The case-law of the European Court of Human Rights’ (the Court) establishes that freedom of expression “applies not only to ‘information’ and ‘ideas’ that are favourably received, regarded as inoffensive, or which leave one indifferent […] – it implies pluralism, tolerance and openness, without which there is no ‘democratic society’”. In assessing the necessity of the interference, member states have little scope to impose restrictions on political speech or on debate on matters of public interest, unless the views expressed comprise incitements to violence, and must always carry out such an assessment case by case.

I observe that other justifications invoked for the restrictions on rights include the prevention of antisemitism. I note with concern reports indicating that the working definition of antisemitism of the International Holocaust Remembrance Alliance (IHRA) has been interpreted by some German authorities in ways which lead to the blanket classification of criticism of Israel as antisemitic. In that regard, I urge you to be vigilant that the IHRA working definition is not distorted, instrumentalised or misapplied to stifle freedom of expression and legitimate criticism, including of the state of Israel

Department of Justice has argued Posse Comitatus does not apply to the military’s current actions in Southern California — and even if it did, the soldiers deployed there haven’t violated the law. It also claimed the 9th Circuit decision endorsing Trump’s authority to call up troops rendered the Posse Comitatus issue moot.

Some experts feel California’s case is strong.

“You literally have military roaming the streets of Los Angeles with civilian law enforcement,” said Shilpi Agarwal, legal director of the ACLU of Northern California, “That’s exactly what the [act] is designed to prevent.”

But Nevitt was more doubtful. Even if Breyer ultimately rules that Trump’s troops are violating the law and grants the injunction California is seeking, the 9th Circuit will almost certainly strike it down, he said.

“It’s going to be an uphill battle,” the attorney said. “And if they find a way to get to the Supreme Court, I see the Supreme Court siding with Trump as well.”

In it, more than 2.8 million people are described as having security clearance as of October 2017 – more than 1.6 million have access to either Confidential or Secret information and nearly 1.2 million are described as having access to Top Secret information.

Ich lebe in einem Land ohne Verteidigung. Weder verteidigt es einen einzigen seiner Menschen, noch sich selbst. Dieses Land ist ein Land der Opfer und der Untertanen. Und als Ausgleich wird ihm regelmäßig irgendetwas gegeben, woran es sich abreagieren kann. Irgendein Nächstschwächerer. Oder so ein Nörgler, wie ich zum Beispiel.

Vertun Sie sich nicht.

Es besteht für mich zwar keine Möglichkeit mich gegen alle diese Maßnahmen juristisch zur Wehr zu setzen, noch diese Maßnahmen überhaupt von den Behörden bestätigen oder dementieren zu lassen. Doch lebe ich nicht im rechtsfreien Raum. Ich lebe nur in einer Republik, in der das Recht dem Staat nichts mehr zählt. Aber auch gar nichts.

Doch nicht nur das. Ich lebe in einer Republik, in denen den Menschen ihr eigener Verstand fast nichts mehr zählt.

Netanyahu’s Iran gambit aimed to realign the world behind Israel. It may backfire

Netanyahu’s claim that the attack was about preventing an immediate threat to Israeli national security is not just facetious, it’s fictitious. I think it was really an attempt to realign the world behind Israel.

The reason Netanyahu felt he had to do that, even at the cost of starting a full-fledged war, was that Israel had exhausted pretty much all of its options in Gaza after a nearly two-year long genocidal campaign. From military action that has failed to return the hostages, to the new Gaza Humanitarian Foundation “aid centers” [that have so far failed to facilitate widespread ethnic cleansing] — nothing Israel was doing in Gaza seemed to catch on. So Netanyahu did what he has done throughout the past two years: open up another front.

Iran was much easier for him [than other fronts] because the idea that the Islamic Republic must be dealt with using military means is perhaps the broadest, most solid consensus in Israeli politics. I think Netanyahu wanted to make political gains and ensure his personal status and future — above all, postponing his trial — as well as try to drag the world into this conflict by forcing, at the very least, the United States to side with Israel.

Neues Berliner Verfassungsschutzgesetz: Mehr Überwachung, weniger Kontrolle, erschwerte Auskünfte

Beim aktuellen Gesetzentwurf geht es unter anderem um die Ausweitung der Wohnraumüberwachung. So sollen Wohnräume in Zukunft einfacher überwacht werden dürfen. So ist die Passage des alten Gesetzes, dass diese Form der Überwachung nur zur „Spionageabwehr und des gewaltbereiten politischen Extremismus“ erfolgen darf, gestrichen worden, genauso wie der Zusatz, dass diese Maßnahme nur „im Einzelfall“ erfolgen darf.

Zudem will Schwarz-Rot nun dem Verfassungsschutz die weitreichendste Form des Staatstrojaners, die „Online-Durchsuchung“, sogar ohne explizite Zustimmung der G10-Kommission ermöglichen.

Ohne gesetzliche, parlamentarische oder gerichtliche Grundlage und Kontrolle nimmt sich der Staat heraus, jedwede beliebige Zielperson nach eigenem Ermessen totaler Spionage zu unterziehen, sie zu beobachten, auszuspionieren und – auch und gerne in Kooperation mit dem verschmolzenen internationalen geheimdienstlichen Komplex – selbst über alle ihre Bekannten, Verwandten und ahnungslose „Kontaktpersonen“ jedwede „sonst nicht beschaffbare Information“ (Executive Order 12333, Ronald Reagan, aus 1981) zu beschaffen.

Und den Persilschein für dieses Konstrukt lieferte, wer auch sonst, das Bundesverfassungsgericht. Und zwar bereits vor bald zehn Jahren.

American Presidents have struck Yemen before, often pointing to the Authorization for the Use of Military Force, a joint resolution passed after 9/11, which gave the President the power to attack terrorist targets in foreign countries without a formal “declaration of war.” But Trump hasn’t invoked the A.U.M.F.; instead, he echoed aides who say that it is within the President’s constitutional power to launch attacks for defensive purposes. His predecessors, too, seemed to operate with that license: most recently, the Biden Administration continued to strike Houthi targets, without Congressional approval, even after taking the Houthis off the list of foreign terrorist organizations.
