Rule 134

If the Security Council does not recommend the applicant State for membership or postpones the consideration of the application, the General Assembly may, after full consideration of the special report of the Security Council, send the application back to the Council, together with a full record of the discussion in the Assembly, for further consideration and recommendation or report. Taking note of the resolutions of the Security Council and General Assembly, the Court is of the view that Member States are under an obligation not to recognize any changes in the physical character or demographic composition, institutional structure or status of the territory occupied by Israel on 5 June 1967, including East Jerusalem, except as agreed by the parties through negotiations and to distinguish in their dealings with Israel between the territory of the State of Israel and the Palestinian territory occupied since 1967. The Court considers that the duty of distinguishing dealings with Israel between its own territory and the Occupied Palestinian Territory encompasses, inter alia, the obligation to abstain from treaty relations with Israel in all cases in which it purports to act on behalf of the Occupied Palestinian Territory or a part thereof on matters concerning the Occupied Palestinian Territory or a part of its territory; to abstain from entering into economic or trade dealings with Israel concerning the Occupied Palestinian Territory or parts thereof which may entrench its unlawful presence in the territory; to abstain, in the establishment and maintenance of diplomatic missions in Israel, from any recognition of its illegal presence in the Occupied Palestinian Territory; and to take steps to prevent trade or investment relations that assist in the maintenance of the illegal situation created by Israel in the Occupied Palestinian Territory (see Legal Consequences for States of the Continued Presence of South Africa in Namibia (South West Africa) notwithstanding Security Council Resolution 276 (1970), Advisory Opinion, I.C.J. Reports 1971, pp. 55-56, paras. 122, 125-127).

281. Finally, the Court is of the view that the precise modalities to bring to an end Israel’s
unlawful presence in the Occupied Palestinian Territory is a matter to be dealt with by the General Assembly, which requested this opinion, as well as the Security Council. Therefore, it is for the General Assembly and the Security Council to consider what further action is required to put an end to the illegal presence of Israel, taking into account the present Advisory Opinion.

Group seeks enforcement of ICJ ruling on Israel/Palestine crisis

An Islamic organization, Aqsah Nigeria, has called on world leaders, especially African governments, to take decisive action in enforcing the July 19th, 2024 ruling of the International Court of Justice (ICJ), which declared Israel’s war on Palestinian territories unlawful.

The organization also urged mass mobilization and continuous public awareness to uphold this “landmark judgment” in hopes of ending the ongoing killing of women and children and the displacement of Palestinians by Israeli forces.

‘Assistance to Enemy in War’ – Israeli MK Requests Death Penalty for B’Tselem’s Director

The Israeli Likud Party Knesset Member Revital Gotliv requested the death sentence or life imprisonment for Yuli Novak, the executive director of the Israeli rights group B’Tselem, for what she labeled as “the suspected serious crime of assistance to the enemy in war,” the Anadolu news agency reported.

Gotliv reportedly made her request in a letter addressed to the Israeli Chief Police Commissioner Daniel Levy, in which she demanded the detention and interrogation of Novak.

The move followed a speech delivered by Novak on September 4 at the United Nations Security Council.

Palestinians seek UN General Assembly backing for full membership

The United Nations General Assembly could vote on Friday on a draft resolution that would recognize the Palestinians as qualified to become a full U.N. member and recommend that the U.N. Security Council „reconsider the matter favorably.“
It would effectively act as a global survey of how much support the Palestinians have for their bid, which was vetoed in the U.N. Security Council last month by the United States.

U.N. resolutions that are written without enforcement measures obviously cannot force Israel to stop what its leadership insists is a justified war necessary to remove Hamas and prevent another Oct. 7 massacre. But it’s just as obvious what entity can make Israel stop and isn’t doing so: the United States.

Whatever the Biden administration might have thought it was doing by permitting the resolution to pass and then undermining it, the maneuver exposed the continuing damage Israel’s war in Gaza is doing to the United States’ longstanding justification for being a superpower: guaranteeing what U.S. administrations like to call the international rules-based order.

President Abbas rejects Biden‘s request to halt UN vote on Palestinian membership

According to Axios, the US and Israeli officials said that the Biden administration was trying to prevent the Palestinians from getting nine votes so that the US would not have to veto the resolution.

Palestine currently has eight security council members expected to support them, including Russia, China, Algeria, Malta, Slovenia, Sierra Leone, Mozambique and Guyana, a senior Israeli official said.

Am 19.März, dem Tag des Angriffs von Frankreich, Großbritannien, Kanada, Italien und den USA auf Libyen, wurde in Moskau eine der erbärmlichsten Erklärungen in der russischen Geschichte veröffentlicht (Angriffskrieg gegen Libyen beginnt: Ticker). Das russische Außenministerium von Sergei Lawrow:

“In Moskau bedauern wir diese bewaffnete Intervention im Rahmen der UN Resolution 1973, die hastig beschlossen wurde.”

Die Weltöffentlichkeit konstatiert: Russlands Staatsführung ist ein Haufen Tölpel, dem – wenn er schon nicht lesen kann und deshalb nicht weiss was vor sich geht – selbst das Wort „Veto“ mit einem einfachen Armhochhalten schon zu viel ist. Das Gleiche gilt für die Atomschwachmacht China, deren leseunkundige kommunistische Staatspartei immerhin 1.3 Milliarden Menschen herumkommandiert. In der Parteizeitung „People´s Daily“ redete man sich heute nun selbst in ein Gewissen, was man nicht hat (1):

„Die blutgetränkten Gewitter, denen Irak seit acht Jahren unterzogen wurde und das unaussprechliche Leiden seines Volkes sind ein Spiegel und eine Warnung. Die militärischen Attacken auf Libyen, folgend den Kriegen in Afghanisten und Irak, sind das das dritte Mal, dass einige Länder bewaffnete Aktionen gegen souveräne Staaten gestartet haben. Es sollte augenscheinlich sein, dass jedes Mal, wenn militärische Mittel benutzt werden um Krisen zu begegnen, dies ein Schlag gegen die Charta der Vereinten Nationen und die Regeln der internationalen Beziehungen sind.“

Die Weltöffentlichkeit versteht: früher hiess es in China „Bombardiert das Hauptquartier“, letzten Freitag hiess es „Bombardiert Libyen“ und heute wieder anders herum. Mal sehen, zu was sich Chinas Staatsführung am Donnerstag entscheidet. Vielleicht der Einfachheit halber zu „Bombardiert irgendwas“.

Doctors Without Borders Slams US for Vetoing Gaza Ceasefire Resolution at UN

The head of the international medical charity Doctors Without Borders/Médecins Sans Frontières (MSF) slammed the US for vetoing a Gaza ceasefire resolution in testimony at the UN Security Council on Thursday and detailed the horrors Palestinian children are facing in the Gaza Strip due to the Israeli siege.

“We are appalled by the willingness of the United States to use its powers as a permanent Council member to obstruct efforts to adopt the most evident of resolutions: one demanding an immediate and sustained ceasefire,” said MSF Secretary-General Christopher Lockyear.

Also briefing the Council was Christopher Lockyear, Secretary General, Médecins Sans Frontières (MSF), or Doctors Without Borders.

Fearful of further deadly Israeli attacks, he said he was “appalled” by the United States’ repeated use of its veto power to obstruct efforts to adopt the most evident of resolutions: one demanding an immediate ceasefire.

“We live in fear of a ground invasion” in Rafah, he said.

Calling Washington’s new proposed draft resolution “misleading at best”, he said the Council should reject any resolution “that further hampers humanitarian efforts on the ground and leads this Council to tacitly endorse the continued violence and mass atrocities in Gaza”.

Kein Antrag auf U.N.-Vollmitgliedschaft: Abbas verrät Palästina erneut

In unserem Artikel vom 4. Februar warnten wir:

“Erfahrungsgemäß muss bis zum schriftlichen Einbringen der Vollmitgliedschaft in der Generalversammlung der Vereinten Nationen jede Sekunde damit gerechnet werden, dass P.L.O., Fatah, die “Autonomiebehörde”, ihr Chefdiplomat Saeb Erekat und Präsident Mahmud Abbas, entgegen all ihrer Beschlüsse, Ankündigungen, Versprechen, etc, die Sache Palästinas wieder verraten.”

Genau so kam es heute. Weder kündigte Abbas in seiner Rede den Antrag auf Vollmitgliedschaft im Sicherheitsrat an, noch einen Antrag in der entscheidenden Generalversammlung. In den Bedingungen für eine irgendwann Mitte 2018 vorgeschlagene “Friedenskonferenz” taucht die U.N. Vollmitgliedschaft Palästinas nicht auf. Stattdessen bot Abbas Israel, allen palästinensischen Beschlüssen zum Trotz, auch noch an, während irgendwelcher neuen “Verhandlungen” keinen internationalen Organisationen “beizuwohnen” (“joining”). Das bedeutet effektiv auch den Verzicht darauf, die Besatzungsmacht endlich wegen Bruch des Völkerrechts vor dem Internationalen Strafgerichtshof zu verklagen.

Im Gipfel der Erbärmlichkeit warf sich Abbas in seiner Rede am Ende auch noch dem Sicherheitsrat zu Füßen und bezeichnet den Sicherheitsrat mit seinen Atommächten als “höchstes Gremium..der Völker der Welt”:
