Court blocks Alabama congressional map, saying state intentionally discriminated by race
The panel of three judges instead ordered Alabama to continue using a court-selected map that includes two majority-Black districts. Those congressional district lines were used in the 2024 elections.
In their decision, the judges found that the redistricting plan adopted by Alabama‘s GOP-led legislature in 2023, which state officials sought to reimplement for this year‘s House contests, intentionally discriminated on the basis of race, in violation of the Constitution‘s 14th Amendment.

Supreme Court rules on key Voting Rights Act rule as Republicans and Democrats wage redistricting war
Republican National Committee (RNC) Chair Joe Gruters praised the ruling in a statement provided to Fox News Digital, describing it as a „win for fairness, the rule of law, and anyone who opposes racial gerrymandering.“
„The American people don’t want to see Americans segregated by race in their congressional maps, which is exactly what was happening in Louisiana,“ he added. „Today, the Supreme Court reaffirmed a basic constitutional principle: the government cannot discriminate on the basis of race when drawing congressional maps.
DNC Chair Ken Martin, meanwhile, lamented the ruling as a „dark day for America,“ adding that the „Supreme Court just rolled back the clock on the Civil Rights Movement.“

In major Voting Rights Act case, Supreme Court strikes down redistricting map challenged as racially discriminatory
The decision was the latest, and presumably final, chapter in a long-running dispute arising from Louisiana’s efforts to adopt a new congressional map in the wake of the 2020 census. The first map that the state adopted, in 2022, had one majority-Black district out of the six allotted to the state. A group of Black voters – who comprise roughly one-third of the state’s population – went to federal court, where they alleged that the map violated Section 2 of the VRA, which prohibits discrimination in voting.
A federal judge agreed that the 2022 map likely violated Section 2, and the U.S. Court of Appeals for the 5th Circuit upheld that ruling. It instructed Louisiana to draw a new map by January 2024 or risk having the court adopt one for it.
The map that Louisiana drew in 2024 created a second majority-Black district, leading to the election in November of that year of Cleo Fields, a former member of Congress who had represented another majority-Black district during the 1990s.
The map also prompted the lawsuit leading to Wednesday’s opinion. It was filed by a group of “non-African American” voters who contended that the 2024 map violated the Constitution’s equal protection clause by sorting voters based on race.

Electronic Voting Banned in Germany

Earlier this year, there was an important legal dispute in Germany, about whether electronic voting machines were legal for use in German government elections. The dispute was decided by the German Constitutional Court (similar to the U.S. Supreme Court), and the short answer was „no.“ Now, we have available an official English translation of the ruling. As I had been told before, the ruling really does seem to ban any kind of computing equipment from being used in German elections. The legal reasoning was interesting enough that I thought I‘d share one reflection on it. The basis for the ruling was the Basic Law for the Federal Republic of Germany (similar in function to the U.S. Constitution) and the principle that „all essential steps in the elections are subject to public examinability.“

The Court invalidated the Federal Voting Machine Regulation (Bundeswahlgeräteverordnung, Sept. 3, 1975, BUNDESGESETZBLATT I at 2459, as amended, available at http://bundesrecht.juris.de/bwahlgv/index.html). This Regulation failed to require transparent control mechanisms for ensuring an accurate vote count and thereby violated article 38 and article 20, paragraphs 1 and 2, of the Basic Law (the Federal Constitution) (Basic Law for the Federal Republic of Germany (Grundgesetz, GG) [in English translation], http://www.iuscomp.org/gla/statutes/GG.htm#20 (last visited Mar. 23, 2009)). Article 38 guarantees free and equal elections, whereas article 20, paragraph 1, requires that governmental power be based on elections and paragraph 2 guarantees that laws and regulations are in conformity with the Constitution.

Republicans under Trump’s leadership view voting as a privilege that should be zealously guarded against those who can’t affirmatively prove their eligibility on demand or who aren’t able or willing to stand in long lines on Election Day under the watchful eyes of professional intimidators. All the fatuous talk these days of the GOP being the party of the working class is hard to square with its determination to maintain a throwback system of voting that makes it hard for working people to cast ballots during restricted hours on a weekday.

Bei der Wahl des ersten Bundesparlamentes Westdeutschlands im Jahre 1949 gab es keine Erst- oder Zweitstimme. Es gab nur die Stimme eines Wählers. Auch gab es nur eine jeweils bundeslandbezogene Fünf-Prozent-Hürde, also zog eine Partei bereits dann entsprechend ihrer errungenen Stimmenzahl auf Bundesebene in den Bundestag ein, wenn sie in einem einzigen Bundesland mehr als fünf Prozent der gültigen Stimmen erhalten hatte. Auch wurde selbst diese bundesländliche Fünf-Prozent-Hürde ausser Kraft gesetzt, wenn man stärkste Partei in einem einzigen Wahlkreis geworden war und diesen gewonnen hatte. Dementsprechend demokratisch und repräsentativ setzte sich das westdeutsche Bundesparlament damals auch zusammen.
Doch die Regierung Konrad Adenauer, aus CDU, CSU, FDP und DP räumte nach 1949 schnell auf mit der Demokratie. Ohne Verfassungsänderung, durch einfache Gesetzgebung, verstümmelten die bürgerlichen Rechtskonservativen bis heute die Legislative der westdeutschen Republik, welche die Berliner Republik bis heute übernommen hat.
Durch einfache Änderung des Bundeswahlgesetzes am 25.Juni 1953 wurden Erst- und Zweitstimme eingeführt. Dadurch galt die 5-Prozent-Hürde nun bundesweit, rechtzeitig zur zweiten Bundeswahl am 6. September 1953.
Durch diese einfache Gesetzgebung, gekoppelt an weitere Maßnahmen, wurden mit einem Schlag drei Parteien Westdeutschlands ausgeschaltet.
Reform des Bundestagswahlrechts: Ampel-Pläne evident verfassungswidrig
SPD, Grüne und FDP wollen den Bundestag von 736 auf 598 Sitze verkleinern. Ihr Vorschlag kann dazu führen, dass in einem Wahlkreis nicht der Sieger, sondern ein Verlierer ins Parlament einzieht.
Berliner Senat sieht keine flächendeckende Wahlpanne
Geisel betonte: „Wahlen müssen selbstverständlich korrekt ablaufen. Alles andere schadet dem Vertrauen in die staatlichen Institutionen – und damit der Demokratie insgesamt.“ Bei der Ermittlung des amtlichen Endergebnisses müsse Sorgfalt vor Schnelligkeit gehen. Geisel will Senat und Abgeordnetenhaus eine unabhängige Expertenkommission vorschlagen, sie solle die organisatorischen Probleme aufarbeiten.
Sechs Verfassungsklagen gegen Bundestagswahl eingereicht
Es gebe überdies „insgesamt elf Verfassungsbeschwerden und drei Eilanträge, die sich gegen einzelne Vorschriften oder pauschal gegen das Wahlrecht richten“ würden.
Im sogenannten Allgemeinen Register gäbe es schließlich zudem „noch vier Verfahren zum Wahlrecht und drei Verfahren zur Bundestagswahl“.
