Delays in the Palestine investigation trace back to 2015 when former ICC Prosecutor Fatou Bensouda initiated a preliminary examination. Although the investigation met the necessary criteria in 2019, it was postponed due to jurisdiction debates over Palestinian territories. The formal investigation began in March 2021, yet no meaningful progress has been made, further delaying requests against Netanyahu and Gallant.

Thanks to their comprehensive access to Palestinian telecoms infrastructure, the sources said, intelligence operatives could capture the calls without installing spyware on the ICC official’s devices.
“If Fatou Bensouda spoke to any person in the West Bank or Gaza, then that phone call would enter [intercept] systems,” one source said. Another said there was no hesitation internally over spying on the prosecutor, adding: “With Bensouda, she’s black and African, so who cares?”
The surveillance system did not capture calls between ICC officials and anyone outside Palestine. However, multiple sources said the system required the active selection of the overseas phone numbers of ICC officials whose calls Israeli intelligence agencies decided to listen to.
According to one Israeli source, a large whiteboard in an Israeli intelligence department contained the names of about 60 people under surveillance – half of them Palestinians and half from other countries, including UN officials and ICC personnel.
In The Hague, Bensouda and her senior staff were alerted by security advisers and via diplomatic channels that Israel was monitoring their work.

The former head of the Mossad, Israel’s foreign intelligence agency, allegedly threatened a chief prosecutor of the international criminal court in a series of secret meetings in which he tried to pressure her into abandoning a war crimes investigation, the Guardian can reveal.
Yossi Cohen’s covert contacts with the ICC’s then prosecutor, Fatou Bensouda, took place in the years leading up to her decision to open a formal investigation into alleged war crimes and crimes against humanity in occupied Palestinian territories.
That investigation, launched in 2021, culminated last week when Bensouda’s successor, Karim Khan, announced that he was seeking an arrest warrant for the Israeli prime minister, Benjamin Netanyahu, over the country’s conduct in its war in Gaza.

After the surprise meeting with Kabila and Bensouda in New York, Cohen repeatedly phoned the chief prosecutor and sought meetings with her, three sources recalled. The Arab League request for a no-fly zone over Gaza may have been inspired by a UN-sanctioned aerial blockade for Libya to halt forces loyal to Moamer Kadhafi harming civilians.
Arab League backing for that no-fly zone was seen as crucially important by the United States when it pressed for a UN resolution that authorised it and other countries to keep Libyan planes grounded.
The International Criminal Court (ICC) faces an unprecedented moment in its history, one that could shape its legacy and impact the lives of thousands.
Prosecutor Karim Khan and his team have risen to their mandate, applying for arrest warrants in the face of enormous risk and pressure.
Yet, the ICC as a whole is faltering. The delay in the judges‘ decision-making is a catastrophic failure to uphold the court‘s own mission.
In May, ICC Prosecutor Karim Khan requested the court to issue warrants of arrest for Israeli Prime Minister Benjamin Netanyahu and his Defence Minister Yoav Gallant, along with three Hamas leaders. The ICC is yet to make a decision despite the mounting death toll in and destruction of Gaza amid Israel’s continuing genocidal violence.

If Bensouda was threatened and blackmailed for merely investigating allegations of war crimes perpetrated before the current genocidal war, one can only fathom the pressures and threats, real or assumed, that Khan faced or feared.
Now that he has done his duty, it is for the three sitting judges of the pre-trial chamber to decide whether to issue the warrants or not. Whether they face the same threats as Bensouda is unknown, but they must be acutely aware that the very credibility of the ICC also hangs in the balance if warrants of arrest for Netanyahu and Gallant are not issued without further delay.

In an announcement – watch below – Israeli Defense Minister Yoav Gallant told Channel 12 that starving the roughly two million people who live in the Gaza Strip is necessary to ensure Israel’s “existence in the region.”
“It will take many weeks,” Gallant said about the deprivation operation. “There will be steps here that have never been seen before.”
“There will be no electricity, no food, no fuel,” he further added. “We are fighting human animals and we will act accordingly.

A well-informed source in The Hague confirmed to Le Monde on Sunday that an „event is imminent,“ but did not specify the nature of the charges or the names of those involved.
Speaker Mike Johnson, R-La., is calling on President Biden to utilize the U.S.‘s influence on the world stage to block the International Criminal Court‘s (ICC) reported plan to issue arrest warrants for top Israeli officials, including Prime Minister Benjamin Netanyahu.
The Israeli officials did not disclose the nature of the information that led them to be concerned about potential I.C.C. action, and the court did not comment on the matter.
Arrest warrants from the court would probably be seen in much of the world as a humbling moral rebuke, particularly to Israel, which for months has faced international backlash over its conduct in Gaza, including from President Biden, who called it “over the top.”

According to reports in several Israeli media, the United States is part of a last-ditch diplomatic effort to prevent the International Criminal Court from issuing arrest warrants against Prime Minister Benjamin Netanyahu and other Israeli officials.
National Unity chairman Benny Gantz said during a press conference in Sderot on Wednesday that Hamas was militarily defeated following the IDF‘s operation in Gaza.

War cabinet minister Benny Gantz tells residents of the evacuated southern communities that the war against Hamas could last “a year, a decade, or even an entire generation,” and acknowledges the urgent need to ensure the release of the hostages still held in Gaza, Channel 12 reports.
This is being taken forward as a matter of the utmost urgency, with a view to bringing to justice those responsible for Rome Statute crimes.
All wars have rules and the laws applicable to armed conflict cannot be interpreted so as to render them hollow or devoid of meaning. This has been my consistent message, including from Ramallah last year. Since that time, I have not seen any discernible change in conduct by Israel. As I have repeatedly emphasised, those who do not comply with the law should not complain later when my Office takes action pursuant to its mandate.
To all those involved: my Office is actively investigating any crimes allegedly committed. Those who are in breach of the law will be held accountable.
I also continue to call for the immediate release of all hostages. This also represents an important focus of our investigations.

“Nothing happens by accident,” said another source. “When a 3-year-old girl is killed in a home in Gaza, it’s because someone in the army decided it wasn’t a big deal for her to be killed — that it was a price worth paying in order to hit [another] target. We are not Hamas. These are not random rockets. Everything is intentional. We know exactly how much collateral damage there is in every home.”
According to the investigation, another reason for the large number of targets, and the extensive harm to civilian life in Gaza, is the widespread use of a system called “Habsora” (“The Gospel”), which is largely built on artificial intelligence and can “generate” targets almost automatically at a rate that far exceeds what was previously possible. This AI system, as described by a former intelligence officer, essentially facilitates a “mass assassination factory.”
Allegations of war crimes by both Israel and by Palestinian militant groups in territories occupied by Israel in 1967 are already under investigation at the International Criminal Court, which is independent of the U.N. But the impact of that investigation is unclear because Israel is not a member nation of the I.C.C. and does not recognize its jurisdiction.
Israel is, however, a signatory of the Genocide Convention, along with South Africa, which paved the way for the case at the International Court of Justice, also known as the World Court.

Independent candidate for President of the United States, Dr. Cornel West today called on the International Criminal Court to launch an immediate investigation into likely war crimes committed by Israeli Prime Minister, Benjamin Netanyahu and the Israel Defense Force (IDF).
As more details and evidence emerge, Brother West believes the global community must intervene and administer comeuppance for clear violations of Articles 6 (Genocide), 7 (Crimes Against Humanity), and 8 (War Crimes) of the Rome Statutes of the International Criminal Court as part of a larger set of immediate actions to protect Palestinian civilians including, but not limited to, an immediate and enforced ceasefire.
In a recorded statement published on X, Netanyahu said he will not let Israel repeat the “mistake” of the Oslo Accords, and that Gaza will neither be “Hamastan nor Fatahstan”.
Earlier, he was quoted on the Israeli public broadcaster as saying that Israel was preparing for a possible war with the PA in the West Bank.
“It can’t be that after the enormous sacrifice of our citizens and fighters, we will let into Gaza those who teach terror, support terror, finance terror,” he said.
Hussein al-Sheikh, a senior PA and Fatah leader, said Netnayhu’s remarks “confirm his war against all Palestinians”.

Only when we put things on the level between states or between people, we will be able to create real deterrence or defeat the enemy when the next conflict erupts.
The hospital underwent a major Israeli renovation and expansion.[21][22] The project was designed by Israeli architects Gershon Tzapor and Benjamin Edelson in their Tel-Aviv office, both well experienced in the construction of high standard hospitals.[21] The project was done in the 1980s as part of a project to improve the living conditions of Gaza residents.[23]
This project came as part of the Israeli idea of mutual existence between Jews and Arabs. The project intended to house 900 beds in the entire campus, a 50 dunam area. The Israeli additions were considered to be in the same standard as those hospital wings in Israeli hospitals such as Tel HaShomer.[21] The architecture of the hospital came to reflect the modernist and post modernist trends in Israeli architecture.[21] In particular was the similarity of the project to existing Israeli hospitals such as the facades of the Bezalel building in Jerusalem.[22] Similarly to other Israeli projects, the building was built with sharpened diagonal staircases, akin to projects by Israeli architects Dan Eitan, Shlomit Nadler and others at the time.[22]

The Israelis are so sure about the location of the Hamas bunker, however, not because they are trying to score propaganda points, or because it has been repeatedly mentioned in passing by Western reporters—but because they built it. Back in 1983, when Israel still ruled Gaza, they built a secure underground operating room and tunnel network beneath Shifa hospital—which is one among several reasons why Israeli security sources are so sure that there is a main Hamas command bunker in or around the large cement basement beneath the area of Building 2 of the Hospital, which reporters are obviously prohibited from entering.
Women, children and newborns in Gaza are disproportionately bearing the burden of the escalation of hostilities in the occupied Palestinian territory, both as casualties and in reduced access to health services, warn the United Nations Children‘s Fund (UNICEF), the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), the United Nations sexual and reproductive health agency (UNFPA), and the World Health Organization (WHO).
As of 3 November, according to Ministry of Health data, 2326 women and 3760 children have been killed in the Gaza strip, representing 67% of all casualties, while thousands more have been injured.

OCHA stressed that as Israeli ground operations and bombardments in northern Gaza continued, “among the deadliest incidents” were heavy airstrikes hitting Jabalia Refugee Camp on Wednesday “for the second day in a row and within less than 24 hours”. The strikes reportedly destroyed multiple residential buildings and killed “dozens”, OCHA said.
The UN human rights office OHCHR noted on Wednesday that given the high number of civilian deaths and injuries in Gaza “and the scale of the destruction following Israeli airstrikes on Jabalia refugee camp, we have serious concerns that these are disproportionate attacks that could amount to war crimes.“
