The Guardian view on Israel’s death penalty: capital punishment is always wrong. This new law is doubly so

Execution will be the default for Palestinians found guilty of lethal attacks deemed as terrorist acts in the West Bank’s military courts – which have a conviction rate of around 96%. Amnesty International says that the system routinely relies on evidence extracted through torture and abuse. The death sentence will be imposed even if prosecutors do not seek it. Convictions need no longer be unanimous. There is no possibility of pardon. Executions must take place within 90 days. Within Israeli civilian courts, the new law imposes the death penalty for deliberately killing a person with the intention of “negating the existence of the State of Israel”. Life imprisonment can only substitute in unspecified “special” circumstances.

There could hardly be a more shocking contrast with the near-total impunity of Israelis killing Palestinians in the West Bank, amid increasing – and increasingly systematic – state-backed settler violence.

Israel’s Ben Gvir boasts of planned execution facility for Palestinian prisoners

“In this place, the terrorists will be executed,” Ben Gvir said in a video posted on Instagram, where he has around 150,000 followers.

In the video, Ben Gvir points towards what appears to be an active construction site and says the complex will include “viewing chambers where crime victims will be able to come and watch” Palestinians being hanged.

„We are fulfilling what we promised,“ the minister added.

Speaking with former Israeli captive Rom Braslavski, Ben-Gvir said that hanging would be the primary method of execution under the death penalty legislation he has been actively promoting.

Born into poverty and with little opportunity at home, Hiwot Mehari took the dangerous smuggling route out of Ethiopia and across the Red Sea to Yemen, from where he hoped to reach Saudi Arabia.

After two years in the deadly border region between Yemen and Saudi Arabia known as Rago, Mehari was caught by border security men and thrown into prison.

On 28 April 2025, he became one of dozens of Ethiopians killed in a US air strike on a migrant detention in Saada, northwest Yemen.

The next day, at noon, Mehari’s parents received the news at home from a neighbour in the Tsirae district of war-ravaged Tigray.

‘They were laughing’: Israel’s use of rape and sexual abuse in prisons

It was April 10, 2024, during the Eid al-Fitr holiday, at the end of the holy month of Ramadan. The Gaza civil servant had been beaten, tortured, bound and forced to soil himself since his arrest by Israeli soldiers a month earlier.

The soldiers and their guard dogs surrounded him that day. “There were six soldiers on the right and six on the left,” he recalled. “They would ask your name. If you said ‘Muhammad’, they would say, ‘No, say your name is b****.’”

Al-Bakri said he was held with seven other prisoners. They were all stripped, blindfolded and handcuffed.

“We were raped after being stripped of our clothes,” he said. “We were shouting, ‘Oh Lord, oh God’, but they were just laughing and filming us.” Al-Bakri then echoed what several rights agencies have also reported – that guards also used dogs during the sexual abuse of prisoners. “The dogs were following commands from the officers to [attack] us,” he said.

“There was no mercy. We stayed in that state of sexual abuse and beatings for about 20 minutes to half an hour. Then they told us to get dressed and took us back to the prison.”

‘Modern-day concentration camp’: Escalating violence reported at Delaney Hall ICE facility in Newark, New Jersey

The Department of Homeland Security said that about six demonstrators were arrested for assaulting law enforcement officers as activists clashed with armed federal immigration officers outside of the facility Wednesday, according to the Associated Press.

Sherrill, although serving as the leader of the Garden State, does not have the legal right to enter the facility.

That being said, no New Jersey official or congressional representative has the legal authority to shut down Delaney Hall.

I have seen the horrific conditions and spoken to those inside about the disgusting food, lack of medical care, and violent and unsanitary conditions as recently as this week. With demoted former USCBP Commander Greg Bovino’s announcement that he is coming to Newark today and his threats online to tear gas our community, I have even more concern that he will only escalate the chaos at Delaney,” said McIver. “More ICE violence has never made a situation safer. The only solution to stop the abuse at Delaney Hall and quell this terror nationwide is to shut down the facility and abolish ICE. We will keep standing up to this administration’s terror campaign and we will keep fighting for justice.”

On Monday, McIver made her fourth visit to Delaney Hall. The chaos created by Immigration and Customs Enforcement (ICE) and the Department of Homeland Security (DHS) during McIver’s first visit to Delaney Hall, led to the Trump administration bringing baseless charges against her for conducting oversight. Her second visit came on the heels of the death of Jean Wilson Brutus in ICE custody. Her third visit was following the release of the S.O.S. letter signed by 300 detainees.

“As I’ve said repeatedly, refusing to provide full access raises serious questions about what ICE is trying to hide from public view.

“New Jersey believes in the rule of law, will uphold the Constitution, and Delaney Hall should be closed down. I am calling for ICE to immediately de-escalate the situation as I continue working to keep New Jersey residents safe.”

After her visit, Sherrill said in a statement that her request to access the facility was formally denied earlier in the day “raising serious questions about what they are trying to hide from public view.” She added that she visited the site to hear from advocates and the families of those detained.

“What I heard from them was heartbreaking,” she said in the statement. “I will continue to hold ICE accountable, and I remain grateful for the work of our federal delegation.”

The governor expressed concerns about Delaney Hall in a previous statement issued Sunday, calling reports of “unsafe, inhumane, and unconstitutional living conditions…completely unacceptable.”

Newark migrant jail detainees launch hunger, labor strike over conditions behind bars

NEWARK — Roughly 300 people detained at migrant jail Delaney Hall began a hunger and labor strike to bring attention to what they call the detrimental conditions and treatment they say they face behind bars.

For two hours near a tent outside the Doremus Avenue detention center Friday morning, people shared their stories of loved ones who are detained inside. Gabriela Soto translated calls from prisoners, including one from her husband, Martin, who has been held there since February.

We feel vulnerable and, in a way, kidnapped —detained without justification— not to mention that we are being tortured physically and psychologically due to the poor food resources provided in these detention centers. We see with deep helplessness and frustration that our due process, rights, and defense have been violated, disregarding benefits granted under the 4th, 5th, and 6th Amendments of the UNITED STATES CONSTITUTION. Families are being destroyed and separated, where there are children, nieces, and minors who are suffering a very strong psychological impact because they do not understand the situation, and in some cases they have witnessed the arrests of their relatives, who have been struck by tragedy and the economic burden, since in most cases we are heads of household.

El Grito de Nosotros Our Cry: A letter from inside Delaney Hall

Through this letter, I would like to describe the situation that thousands of immigrants are currently living through:

First, we’d like to apologize for the way we entered the United States, but we were experiencing safety circumstances that endangered our lives and the lives of some members of our family.

Upon entering, we surrendered ourselves to border authorities who processed us. Some of us were given parole or a court date to continue our cases in accordance with the due process afforded to us by the Constitution and laws of the United States. We also attended periodic check-ins, obtained work permits and social security numbers, filed taxes, and were working legally and contributing to the economy. Therefore, we did not pose a threat to the country or the communities where we resided.

We know that ICE agents have orders to arrest immigrants. In our cases, we had already been processed and were complying with legal requirements. There was no judge‘s order for our detention or arrest, since we received a procedural benefit upon our entry, but the ICE officers did not take this into account, nor the fact that we had an immigration court date. They arrested us at scheduled appointments and at USCIS offices.

Detained immigrants issue “Our Cry,” a letter from inside Newark ICE facility pleading for due process

Kathy O’Leary of Pax Christi, an international Catholic peace organization, said she was blown away by the letter’s careful, measured phrasing, as well as the apology it led with.

“It’s heartbreaking,” she told The Jersey Vindicator. “I can’t imagine being in that situation and having the presence of mind to write a letter like that.”

The message also comes more than a month after the still-unexplained demise of Jean Wilson Brutus, a 41-year-old Haitian man who died at Delaney Hall, and months of complaints and criticism from immigration advocates, local officials, and federal lawmakers about the facility’s treacherous living conditions.

41-year-old detainee at Newark migrant jail died in custody, ICE says

This marks the first death of a Delaney Hall detainee since it opened earlier this year. Immigrant advocates are demanding more information from authorities on exactly what happened and why it took a week for ICE to announce Brutus’ death.

Kathy O’Leary, an activist who holds vigils at the detention center, said she was there last week when an ambulance pulled onto the jail’s property, and she heard discussions of someone having a medical emergency over guards’ walkie-talkies. That ambulance was held up leaving the jail by a van dropping off new detainees, she added.

It wasn’t until ICE put out the statement Thursday evening that she learned about Brutus’ death.

In a clip released by the Department of Homeland Security, McIver can be seen on the facility side of a chain-link fence before crossing through the gate and joining a crowd shouting „surround the mayor.“ Video shows McIver pressing forward in the crowd, with her elbows making contact with a federal officer.

Homeland Security said the charge followed a „thorough review“ of the footage and an investigation by Homeland Security Investigations.

The 428 abducted flotilla participants are currently unaccounted for. They have had no contact with legal counsel. They have been denied consular access. Their families have not been informed of their whereabouts.

We call on their governments and world leaders to demand their immediate and unconditional release and to ensure their right to consular and legal access without further delay.

Their detention is an extension of the same system that has kept nearly 10,000 Palestinian political prisoners and hostages held under an even more brutal architecture of confinement, coercion, and colonial violence. What has already been documented is not aberration. It is a pattern. Testimonies from flotilla participants released after the previous interception earlier this month, describe torture, physical assault, and sexual violence.

Independent rights organizations, including Save the Children, have documented that more than half of the Palestinian children detained by israel report sexual abuse, sexualized violence, and systematic torture. This pattern of sexual violence is systematically operating without interruption.

Gaza and the West Bank are where that structure is most illustrative. They are where weapons are tested, surveillance systems refined, and techniques of enclosure normalized before being exported into policing regimes, border infrastructures, prison systems, and governance models across the world.

I‘ve spent some time reporting on widespread rape and other sexual violence of Palestinian male and female prisoners by Israeli authorities, and the article is now published. The assault victims were warned not to give speak of what they endured — they were sometimes told they would be killed or raped if they gave interviews — but they found the courage to do so. One man described being raped three times in a single day in Israeli prison, the third time after he tried to protest. A young woman said the guards would come in at the beginning of each shift and strip her naked and abuse her. Another reported that she was shown photos of herself being raped and warned they would be released unless she cooperated with Israeli intelligence. Even three children who had been detained told me they had been sexually abused. Look, whatever our position on the Middle East, we should be able to agree on being anti-rape. Sexual assaults were horrific when Israeli women were targeted on Oct. 7, and they‘re equally horrific when Israeli authorities use them against Palestinians day after day after day. The article in question, “The Silence That Meets the Rape of Palestinians,” by Nicholas Kristof, recounts the stories of 14 Palestinians who experienced sexual violence at the hands of Israeli soldiers and settlers. A majority of the interviews discuss sexual violence inflicted by soldiers and interrogators on Palestinians in Israeli detention, but others speak of attacks by Israeli settlers in the occupied West Bank — attacks that are “increasingly protect[ed]” by the Israeli military, according to Kristof. The interviews are reinforced by testimony from Israeli and international human rights organizations, and demonstrate that sexual violence is systemic, used on a daily basis against Palestinians, and effectively Israeli state policy.

It’s a simple proposition: Whatever our views of the Middle East conflict, we should be able to unite in condemning rape.

Supporters of Israel made that point after the brutal sexual assaults against Israeli women during the Hamas-led attack on Israel on Oct. 7, 2023. Demands Met on 73rd Day as Three End Strike

With this victory it has never been clearer that Elbit’s days in Britain are numbered.

In addition to this key demand being met, we want to take this opportunity to celebrate the various victories achieved across the duration of the hunger strike:

– In the past few weeks alone, hundreds of people have signed up to take action against the genocidal military-industrial complex, more than the amount of people who took action with Palestine Action over its 5 year campaign. During that 5 year campaign, 4 Israeli weapons factories were shut down. Elbit Systems is living on stolen time – we will see it shut down for good, not because of the government, but because of the people.

– Heba Muraisi’s transfer to HMP Bronzefield has been accepted by HMP New Hall, where she is currently held in intentional isolation from her family and friends.

– T. Hoxha has been offered a meeting with the head of JEXU (Joint Extremism Unit) at her prison, the very same organisation that orchestrates the prisoners’ treatment as ‘terrorists’.

– Despite the cruel and constant medical neglect of the hunger strikers; including not logging food refusal, refusal of ambulances in life threatening emergencies, and degrading treatment in hospital; the national heads of prison healthcare have met with us at the behest of the Ministry of Justice.

– During the hunger strike, some of the prisoners started receiving bulk packages of witheld mail, and in one case received an apology from prison staff for a letter that was delayed by 6 months. Books on topics of Gaza and feminism have also been given after months of waiting.

– In pursuit of a fair trial, the hunger strikers demanded disclosure of export licenses for the last 5 years from Elbit Systems. After repeated requests, this information was disclosed to an independent researcher by the Department of Trade during the hunger strike.

Black-and-white photographs of its 8,500 prisoners from over the years line the walls. They include current Supreme Leader Ayatollah Ali Khamenei and the late President Akbar Hashemi Rafsanjani.

Sheikhi, then 19, spent about three months in the prison and 11 months in another after being detained for distributing anti-shah statements from Khomeini, then in exile.

Set in Tehran‘s former Ebrat Prison run by the anti-sabotage unit of Shah Reza Pahlavi‘s Savak intelligence services, the museum is filled with shockingly graphic exhibits featuring lifelike mannequins recreating the hideous torture tactics deployed to repress dissidents rebelling against Iran‘s monarchy.

Many mannequins on display represent notorious torturers who either fled or were executed after the Islamic revolution in 1979, while others are modeled after famous prisoners locked away in Ebrat like the current Leader of Iran, Ayatollah Khamanei.
