Hervorgegangen aus einem SPD-CDU-Kompromiss bei der Erarbeitung des Grundgesetzes 1948/49 im Parlamentarischen Rat, wurde er mit einer Ausnahme nie in einem Gesetz erwĂ€hnt. Zwar hat der Staat 2009 im Zuge der Bankenrettung die Drohung der Enteignung von bestimmten Banken in Gesetzesform gegossen, letztlich diese aber nicht umgesetzt, da die Ăbernahme der Bankaktien durch andere Mittel erfolgen konnte. Der Dornröschenschlaf von Artikel 15 ist aber zugleich ein Vorteil
fĂŒr uns. Da auf Bundesebene keine konkrete Gesetzgebung hierzu existiert, ist der Weg fĂŒr ein Landesgesetz frei. Die EntschĂ€digung, die laut Artikel 15 GG in diesem Zusammenhang erfolgen muss, darf allerdings nicht dem Marktwert entsprechen, da sonst der Sozialisierungsgedanke, der ja gerade auf das Durchbrechen wirtschaftlicher Machtstrukturen setzt, ad absurdum gefĂŒhrt werden wĂŒrde.
