Exclusive: ICC prosecutors shelved RSF arrest warrant as Sudan atrocities mounted

The International Criminal Court‘s prosecutor’s office has not applied for a single arrest warrant over crimes committed in Sudan‘s Darfur region since the country‘s devastating war began in April 2023, despite more than three years of investigation and repeated public assurances that charges were imminent, Middle East Eye can reveal.

(…)

For more than a year after Khan‘s leave of absence in May 2025, the prosecution did not provide any explanation to the pretrial chamber regarding the late application.

(…)

The deputy prosecutor, who is currently in charge of the Darfur investigation, has yet to provide a timeline for any other arrest warrants, MEE understands.

CITY UNDER SIEGE, CHILDREN UNDER FIRE: RAPID SUPPORT FORCES’ CRIMES AGAINST HUMANITY IN NORTH DARFUR

During nearly three years of brutal conflict, civilians in North Darfur have been unlawfully detained, tortured and killed on a massive scale. Women and girls have been raped and forced into sexual slavery. Children have not just been the collateral damage of this violence: very often, they are deliberate targets.

This report documents the Rapid Support Forces’ (RSF’s) slow and violent takeover of North Darfur and its capital, El Fasher, after it began fighting the Sudanese Armed Forces (SAF) in April 2023. The abuses, which amount to crimes against humanity under international law, displaced hundreds of thousands of children, exposing them to death and injury during attacks or while fleeing. Countless children have been orphaned.

Sudan’s current crisis erupted against the backdrop of decades of armed conflict. When major violence escalated in April 2023 between the SAF and the RSF (a former government force), fighting was first concentrated in the capital, Khartoum. But it soon spread to other parts of the country, including Darfur, a region on the western border with Chad that has been wracked by cycles of conflict since the early 2000s. By November 2023, the RSF controlled four of the five state capitals in Darfur.

El Fasher was the lone holdout and last major stronghold in Darfur for the SAF and the allied Joint Forces (a coalition of local armed groups that draws heavily from the Zaghawa ethnic group). The area is of particular strategic importance due to its sizeable gold reserves and its position as a geographical hub linking Darfur to Libya and Chad along trans-Saharan trade routes. It became a prize the RSF seemed willing to take at any price – something made possible by the steady flow of weapons and other equipment from its foreign backers, most notably the United Arab Emirates (UAE).

(…)

TO THE AFRICAN UNION PEACE AND SECURITY COUNCIL

– Apply sustained political pressure on the RSF, SAF and all other parties to the conflict in Sudan to immediately agree to and implement a nationwide ceasefire accompanied by a sustainable framework for longer-term security and stability, human rights protection, justice and accountability. Regardless of progress towards a ceasefire, use all available leverage to urge all parties to immediately end attacks on civilians and civilian infrastructure, ensure safe and unfettered humanitarian access into North Darfur, and urgently facilitate the scaling up of humanitarian funding and response commensurate with the scale of civilian need.

– In line with the recommendation of the ACHPR’s Joint Fact-Finding Mission on the Human Rights Situation in the Republic of the Sudan, and given the ongoing risk to civilians, urgently establish and deploy a protection force to Sudan with a mandate to protect and deter attacks against civilians, prevent atrocities, create the security conditions conducive to the delivery of humanitarian assistance, and monitor and publicly report on attacks against civilians and civilian infrastructure. Ensure the protection force is adequately resourced, equipped and supported to operate effectively, including through predictable and sustainable financing.

Sudan: RSF atrocities in El Fasher ‘a stain on the conscience of humanity’ – new report

The Rapid Support Forces (RSF) committed crimes against humanity and ethnic cleansing during its campaign to seize El Fasher in North Darfur state in Sudan, Amnesty International concluded in a major new report. The organization is now calling for an immediate ceasefire in Sudan, and for the urgent deployment of an international force to protect civilians.

“The essence of childhood has been destroyed”: Israel’s deliberate targeting of Palestinian children in the Occupied Palestinian Territory since 7 October 2023

56. On 24 January 2024, at around 08:30, a family was preparing to evacuate from their ground-floor apartment in a seven-storey building at al-Amal, west of Khan Younis, following receipt of an evacuation order by the Israeli security forces. The father noticed quadcopters hovering over the area and presence of the Israeli security forces about 100 meters east of their house, instructing people to head west to Al-Mawasi in Khan Younis. His 15-year-old son stepped out of the house holding a white cloth, when the father, who was inside the house, heard a gunshot from the eastern side where Israeli soldiers were located. The boy was hit in the left foot, and he fell on his face. As he attempted to stand, two more gunshots were fired within seconds from the same direction. One shot hit the boy on his back and another on the left side of his neck. Seeing this, the boy’s 20-year-old brother ran towards him and was also shot on the left side of his chest. He collapsed on top of his younger brother.

57. The victims’ mother waved her hands at the south side window to signal for an ambulance when the Israeli security forces fired bullets which hit her too, slightly injuring her in her left hand. The father tried several times to pull away the bodies of both his sons but, every time he tried to advance towards them, the Israeli security forces fired in his direction. He then left the neighbourhood with the rest of his family. In early March 2024, he learned that two days after the incident, an ambulance arrived to retrieve his sons’ bodies. To date, the family is unaware where the bodies are buried.

58. The Commission assesses that the 15-year-old boy holding the white flag was shot by Israeli soldiers using a DAN.338 calibre bolt-action sniper rifle, commonly used by Israeli snipers, from a position located around 200 metres away. Given that sniper rifles used by the Israeli security forces normally have a precision accuracy range of more than 1,200 metres, the Israeli shooter should have been able to see that the target was a child and that he was holding a white flag. The additional two shots fired after the boy was hit were likely meant to ensure that he was dead. The additional killing of the boy’s brother points to a deliberate effort by the Israeli security forces to target the boy as well as any person that came to retrieve him. The Commission could not find any indication of a threat towards members of the Israeli security forces from the family’s location. The Commission finds that the Israeli security forces’ 98th Division were operating in the area at the time of the incident.

Injuring of a 10-day-old baby by quadcopter inside the tent in Nuseirat camp

59. On 12 April 2024 at 13:00, a 10 day-old-baby boy was shot by a quadcopter while being breastfed by his mother inside their tent in Nuseirat camp. The mother was alone in the tent, breastfeeding her baby, when a single bullet from a quadcopter hit the baby in the head and exited through the back of his head, hitting the pillow behind her. The baby survived but sustained brain injuries and now suffers from seizures.

60. The Commission viewed and analysed images of the bullet that hit the baby. The Commission concluded on reasonable grounds that the bullet was fired from a sniper rifle mounted on a quadcopter. Considering that the shooting occurred in broad daylight, the
Commission concludes that the quadcopter controller would have been able to see inside the tent and assesses that the target was a mother and a baby.

Injuring of a four-year-old girl in Khan Younis displacement camp

61. On 24 August 2024, at around 08:00, a four-year-old girl was hit by a bullet to her head while she was eating with her family in her tent in Khan Younis, southern Gaza…………..

Israel continues to commit genocide, atrocity crimes by deliberately targeting Palestinian children, UN independent commission finds

Last year, the commission concluded that “Israel had committed genocide against the Palestinian group in the Gaza Strip, found that the intense scale and systematic nature of the Israeli military operations have continued, resulting in unprecedented death, injury and trauma of Palestinian children.”

Here are some findings in the commission’s latest report:

– Israel has killed 20,000 children and injured 44,000 more since 7 October 2023
– Severe physical and mental injuries, mass trauma, orphanhood, separation, disability, repeated displacements, starvation and the collapse of education and healthcare have erased childhood and will continue to affect children in Gaza throughout their lives
– Palestinian children have been arrested and subjected to torture and other severe forms of mistreatment in Israeli prisons and detention facilities, with no information on their whereabouts
– Israeli security forces have used sexual violence against children as part of the collective shaming and oppression, entrenched within a prolonged, ethnic, gendered and intergenerational pattern of occupation and hostilities

American Medical Association: Help Release Dr. Husam Abu Safiya!

In December 2024, Dr. Husam Abu Safiya was illegally abducted by the Israeli military after raiding his hospital, Kamal Adwan Hospital. This was one of the last functioning hospitals in Gaza, and Israel made sure to destroy it and kidnap its leadership so Palestinians could not be treated medically. Now, Dr. Husam Abu Safiya is locked away in one of Israel’s most dangerous prisons and is held with no charge.

What happened to Dr. Abu Safiya is a crime against humanity, and we must call on our institutions to speak out against the abuse of their own colleagues. The American Medical Association (AMA) has not done nearly enough to help in the release of their medical professional colleagues.

Send a letter to the AMA Board of Trustees to demand that they help in the release of Dr. Abu Safiya!

West Bank: Israel Emptying Refugee Camps a Crime Against Humanity

(November 20, 2025)

The Israeli government’s forced displacement of the populations of three West Bank refugee camps in January and February 2025 amount to war crimes and crimes against humanity.

The Geneva Conventions prohibit displacement of civilians from occupied territory except temporarily for imperative military reasons or the population’s security. Displaced civilians are entitled to protection, accommodation, and to return as soon as hostilities in the vicinity cease.

Senior Israeli officials, including Prime Minister Benjamin Netanyahu and Defense Minister Israel Katz, should be investigated for the refugee camp operations and appropriately prosecuted for war crimes and crimes against humanity. Governments should impose targeted sanctions and take other urgent action to press Israeli authorities to end their repressive policies.

Report of the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel

82. Successive Governments of Israel have implemented laws and policies to diminish Palestinian space in Israel, including confining Palestinian localities and hindering Palestinians with Israeli citizenship from moving and integrating into Jewish localities. In addition, informal barriers resulting from wider, primarily socioeconomic, inequalities between the two populations have grown and become entrenched over decades, further preventing integration.

83. Some policies and laws are explicitly discriminatory. Others have a discriminatory impact, resulting in segregation. This is evident from the “admissions committees” policy and law, as well as statements of Israeli officials’ supporting the development of exclusively non-Jewish localities to deter and prevent Palestinians with Israeli citizenship from moving into mixed cities.

84. Such discrimination in laws and policies is a violation of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. Specifically, Israel has violated article 11 of the International Covenant on Economic, Social and Cultural Rights, which obliges States to ensure adequate standards of living and housing and the continuous improvement of living conditions.

85. Land and housing policies impacting Palestinians in Israel are part of a broader policy towards the Palestinian population as a whole, aimed at striving towards a Jewish majority in all areas under Israeli control, reducing the possibility of geographical self-determination for the Palestinian people.

Individual criminal responsibility

86. The Commission has identified several Israeli ministers as likely bearing the most responsibility for the international crimes noted in the present report. The Ministers of Defence since October 2023, Yoav Gallant (until 7 November 2024) and subsequently Israel Katz, are responsible for actions of Israeli security forces in Gaza which amount to international crimes. The Minister of Finance, Bezalel Smotrich, and the Minister of Settlements and National Projects, Orit Strock, are jointly responsible for driving settlement construction and expansion in the West Bank, including East Jerusalem. The Minister of National Security, Itamar Ben-Gvir, is responsible for the actions of police and prison authorities noted by the Commission in its previous report to the General Assembly. The Prime Minister, Benjamin Netanyahu, is ultimately responsibility for the conduct of Israel in the whole of the Occupied Palestinian Territory. All six bear direct individual responsibility for establishing policies and taking actions noted in the present report that have killed and injured Palestinians, deliberately inflicted on Palestinians in Gaza conditions of life calculated to bring about the group’s physical destruction in whole or in part and deepened the unlawful presence of Israeli settlers in the occupied West Bank, including East Jerusalem, including through security operations and channelling funds for settlements, farm outposts and settlement expansion.

Israel seeks permanent Gaza control and Jewish majority in West Bank, UN inquiry says

The Commission also found that since October 2023, Israeli policies have demonstrated clear intent to forcibly transfer Palestinians, expand Jewish settlements, and annex the entire West Bank.
„Increasing violent attacks by settlers have resulted in the forcible displacement of communities and subsequent Judaization of areas of the West Bank,“ the report stated.
It also highlights military operations in Jenin, Tulkarem, and Nur Shams refugee camps, which resulted in destruction of homes and infrastructure and displacement of residents – actions the Commission deems unjustified militarily and tantamount to collective punishment.

Worse Than Tiananmen? 1st Anniversary of Egyptian Army Killings of 800+ Anti-Coup Protesters

(August 14, 2014)

One year ago today, Egyptian forces opened fire on a sit-in at Rabaa al-Adaweeya Square in Cairo. Tens of thousands of people had camped in the square to protest the ouster of democratically elected President Mohamed Morsi. Over the course of a single day, in what became known as the Rabaa massacre, Egyptian forces killed at least 817 people. Now, Human Rights Watch has unveiled a new report that concludes Egypt‘s actions likely constituted a crime against humanity, one of the worst violations of international law.

All According to Plan: The Rab’a Massacre and Mass Killings of Protesters in Egypt

(August 12, 2014)

In July and August 2013, many of Egypt’s public squares and streets were awash in blood. On July 3, 2013, the military deposed Mohamed Morsy, Egypt’s first elected civilian president and a high-ranking member of the Muslim Brotherhood, on the heels of massive popular protests against Morsy calling for early presidential elections.

Over the course of the following two months, Muslim Brotherhood supporters organized two large sit-ins in Cairo and smaller protests across Egypt to denounce the military takeover and demand the reinstatement of Morsy. In response, police and army forces repeatedly opened fire on demonstrators, killing over 1,150, most of them in five separate incidents of mass protester killings.

Human Rights Watch’s one-year investigation into the conduct of security forces in responding to these demonstrations indicates that police and army forces systematically and intentionally used excessive lethal force in their policing, resulting in killings of protesters on a scale unprecedented in Egypt. The evidence we examined includes on-site investigations at each of the protest sites during or immediately after the attacks were underway, interviews with over 200 witnesses, including protesters, doctors, journalists, and local residents, and review of physical evidence, hours of video footage, and statements by public officials. On this basis, Human Rights Watch concludes that the killings not only constituted serious violations of international human rights law, but likely amounted to crimes against humanity, given both their widespread and systematic nature and the evidence suggesting the killings were part of a policy to attack unarmed persons on political grounds. While there is also evidence that some protesters used firearms during several of these demonstrations, Human Rights Watch was able to confirm their use in only a few instances, which do not justify the grossly disproportionate and premeditated lethal attacks on overwhelmingly peaceful protesters.

Numerous government statements and accounts from government meetings indicate that high-ranking officials knew that the attacks would result in widespread killings of protesters; indeed, in the single largest incident, the Rab’a and al-Nahda dispersals, the government anticipated and planned for the deaths of several thousand protesters. One year later, security forces continue to deny any wrongdoing, and authorities have failed to hold a single police or army officer accountable for any of the unlawful killings.

August 14 Rab’a and al-Nahda Square Dispersals

The gravest incident of mass protester killings occurred on August 14, when security forces crushed the major pro-Morsy sit-in in Rab’a al-Adawiya Square in the Nasr City district of eastern Cairo. Using armored personnel carriers (APCs), bulldozers, ground forces, and snipers, police and army personnel attacked the makeshift protest encampment, where demonstrators, including women and children, had been camped out for over 45 days, and opened fire on the protesters, killing at least 817 and likely more than 1,000.

Israel’s “voluntary emigration” policy from the Gaza Strip constitutes the forced transfer of the civilian population – a war crime and crime against humanity

Israel-based human rights organizations – Gisha, Adalah, The Association for Civil Rights in Israel, and HaMoked: Center for the Defence of the Individual – addressed Israel’s Defense Minister Israel Katz, Attorney General Gali Baharav-Miara, and Military Advocate General Yifat Tomer-Yerushalmi, demanding the immediate cancellation of the Security Cabinet decision from March 23, 2025, concerning “preparation for the possibility of voluntary departure of Palestinians in the Gaza Strip to third countries.” Following this decision, a “Voluntary Emigration Administration” was established within the Defense Ministry. The organizations demand that Israeli authorities not interfere with the freedom of movement of Gaza residents and refrain from imposing restrictions on their right to return to the Strip at any time and without conditions. The letter was written by Attorney Suhad Bishara of Adalah and Attorney Osnat Cohen-Lifshitz of Gisha.

The letter noted that statements by Defense Minister Israel Katz and Prime Minister Benjamin Netanyahu reveal an intention to promote and implement transfer from the Gaza Strip under the guise of “voluntary emigration.” It was recently reported that Israel is using intelligence information to send messages to Gaza residents, calling on them to contact a representative to coordinate their departure.

Israel’s “voluntary emigration” policy from the Gaza Strip effectively constitutes the forced transfer of the civilian population – a war crime and crime against humanity

Four Israel-based human rights organizations warn Israel’s Defense Minister, Attorney General, and Military Advocate General that Israel‘s „voluntary emigration“ policy from the Gaza Strip effectively constitutes the forced transfer of the civilian population – a war crime and crime against humanity

Gaza: Latest Israeli Plan Inches Closer to Extermination

Israeli authorities, who have blocked the entry of aid, food, fuel, and medical supplies into Gaza for 75 days, have reportedly decided on a plan that would include “flatten[ing]” buildings and displacing Gaza’s entire population into a single “humanitarian area” if no “deal” with Hamas is reached by mid-May 2025. The dire humanitarian situation stemming from the unlawful blockade and plans to escalate forced displacement and widespread destruction demand a more robust response from other governments and institutions, especially the United States, France, Germany, the European Union, and the United Kingdom. Human Rights Watch called on all parties to the Genocide Convention to do more to prevent further atrocities, including ending weapons sales, military assistance, and diplomatic support to Israel, imposing targeted sanctions on Israeli officials, and reviewing and considering suspending bilateral agreements.

“Hearing Israeli officials flaunt plans to squeeze Gaza’s 2 million people into an even tinier area while making the rest of the land uninhabitable should be treated like a five-alarm fire in London, Brussels, Paris, and Washington,” said Federico Borello, interim executive director of Human Rights Watch. “Israel’s blockade has transcended military tactics to become a tool of extermination.”

“Hopeless, Starving, and Besieged”: Israel’s Forced Displacement of Palestinians in Gaza

To All Governments

– Publicly condemn Israel’s forced displacement of the civilian population in Gaza as a war crime and crime against humanity, as well as other violations of international humanitarian law, international human rights law, and international criminal law by Israeli authorities, and urge them to immediately halt those crimes and cooperate with international judicial bodies and investigative mechanisms.

– Increase public and private pressure on the Israeli government to stop violating international humanitarian law in the conduct of hostilities, to fully comply with its obligations and the binding orders and advisory opinion from the International Court of Justice, and to ensure the entry and safe distribution throughout Gaza of adequate aid and provision of basic services. Consider, in that regard, the review and possible suspension of bilateral agreements with Israel, such as the EU-Israel Association Agreement, as proposed by the governments of Spain and Ireland, and the US-Israel Free Trade Agreement.

– Suspend military assistance and arms sales to Israel so long as its forces commit violations of international humanitarian law with impunity.

– Enforce domestic legislation limiting the transfer of arms and military assistance for violations of international human rights and humanitarian law.

– Publicly support the International Criminal Court, uphold the court’s independence, and publicly condemn efforts to intimidate or interfere with its work, officials, and those cooperating with the institution.

– Urge the Government of Israel to grant access to independent, international monitors, including from the UN Special Procedures.

– Impose targeted sanctions, including travel bans and asset freezes, against Israeli officials credibly implicated in ongoing serious violations, for the purpose of ending these violations.

– Address long-standing impunity by Israeli authorities and Palestinian armed groups for serious crimes under international law, and support reparations for all victims of gross human rights abuses.

– Support the creation of a register of damages, caused by unlawful Israeli action to persons in the Occupied Palestinian Territory, for the purposes of calculating reparations.

Karim Khan urges ICC judges not to delay arrest warrant for Netanyahu

(August 24, 2024)

The prosecutor of the International Criminal Court (ICC), Karim Khan, stressed that the court has jurisdiction to investigate Israelis, urging judges to decide on arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Security Minister Yoav Gallant, which he had requested months ago.

Netanyahu said to ask AG to probe him and Gallant in bid to avert ICC arrest warrant

Channel 12 news said Netanyahu wanted a probe into the ongoing war and how the military campaign against Hamas has been handled to be opened and then closed, with an update filed to the ICC that the charges had been investigated by Israel and therefore do not require the court’s intervention.

According to the report, Baharav-Miara rejected the request on the grounds that it was a blatant ploy and would not satisfy the ICC.
