Die Beteiligung an der Kriegskoalition im Persischen Golf „scheint gefallen“. Bundestag, Bundesregierung und Bundesverfassungsgericht sind offensichtlich zur ausführenden Dienerschaft ausländischer Mächte verschmolzen. Etablierte Linke, Pazifismus oder Sozialdemokratie von Bedeutung existieren in Deutschland nicht.
Gestern kroch „A.F.D.“-Vorsitzender Gauland voran, Heute nun gab die Kriegslobby über ihren Medienkomplex eine Art Vorab-Mandat des Bundestages bekannt.

Bei dem Organstreit handelt es sich um eine kontradiktorische Parteistreitigkeit, er dient maßgeblich der gegenseitigen Abgrenzung der Kompetenzen von Verfassungsorganen oder ihren Teilen in einem Verfassungsrechtsverhältnis, nicht hingegen der Kontrolle der objektiven Verfassungsmäßigkeit eines bestimmten Organhandelns. Kern des Organstreitverfahrens ist auf Seiten des Antragstellers die Durchsetzung von Rechten. Der Organstreit eröffnet daher nicht die Möglichkeit einer objektiven Beanstandungsklage. Für eine allgemeine oder umfassende, von eigenen Rechten des Antragstellers losgelöste, abstrakte Kontrolle der Verfassungsmäßigkeit einer angegriffenen Maßnahme ist im Organstreit kein Raum. Eine Respektierung sonstigen (Verfassungs-)Rechts kann im Organstreit nicht erzwungen werden; er dient allein dem Schutz der Rechte der Staatsorgane im Verhältnis zueinander, nicht aber einer allgemeinen Verfassungsaufsicht. Aus dem Grundgesetz lässt sich kein eigenes Recht des Deutschen Bundestages dahingehend ableiten, dass jegliches materiell oder formell verfassungswidrige Handeln der Bundesregierung unterbleibe.

Eine Überschreitung der Integrationsgrenzen des Gesetzes zum Vertrag von Lissabon vom 13. Dezember 2007 ist ebenfalls ausgeschlossen. Die Rechtsprechung des Bundesverfassungsgerichts ist, anders als die Antragstellerin meint, nicht dahingehend zu verstehen, dass die Europäische Union grundsätzlich nicht als System im Sinne von Art. 24 Abs. 2 GG eingeordnet werden kann. Vielmehr ist es zumindest vertretbar, die Europäische Union als ein System gegenseitiger kollektiver Sicherheit anzusehen. Ein Streitkräfteeinsatz auf der Grundlage der Beistandsklausel des Art. 42 Abs. 7 EUV ist verfassungsrechtlich dem Grunde nach jedenfalls nicht ausgeschlossen. Diese verweist auf das in der VN-Charta angelegte Selbstverteidigungsrecht, so dass die Annahme der Tatbestandsvoraussetzungen des Art. 42 Abs. 7 EUV auch insoweit vertretbar erscheint. Zur Zeit der Verabschiedung des Zustimmungsgesetzes zum Vertrag über die Europäische Union im Jahr 2007, als das Bedrohungspotenzial, das von nichtstaatlichen Akteuren ausgehen kann, der internationalen Gemeinschaft infolge der Anschläge am 11. September 2001 in den Vereinigten Staaten von Amerika bereits sehr bewusst war, war vorhersehbar, dass zukünftig, wie im vorliegenden Fall, ein terroristischer Angriff gegen einen Mitgliedstaat tatbestandlich unter die Beistandsklausel des Art. 42 Abs. 7 EUV gefasst werden könnte.

In view of the heavy fighting, which was approaching close to the UNDOF headquarters at Camp Faouar and the mission’s positions in the central part of the area of separation, the Force Commander briefed both parties early in September on the Force’s plans to relocate its personnel and assets should the Nusra Front or other extremist fighters who posed a clear threat to the mission endanger the safety and security of the United Nations personnel. It should be noted here that from information posted on social media as well as in the course of its efforts to secure the release of the peacekeepers, the United Nations learned that its personnel had been taken and held by members of the Nusra Front. There were indications that the Nusra Front intended to detain additional UNDOF personnel and take from UNDOF more weapons and vehicles as opportunities arose. (…)
12. Crossing of the ceasefire line by civilians, primarily shepherds, was observed on an almost daily basis. On 24 October, United Nations observation post 73 observed 12 IDF soldiers who detained one civilian between the Alpha line and the Israeli technical fence south-east of the observation post and subsequently took him away. IDF informed UNDOF that they released the person within one hour at the same location. On 27 October, position 80 observed two IDF soldiers east of the technical fence returning from the direction of the Alpha line towards the technical fence. UNDOF observed IDF opening the technical fence gate and letting two individuals pass from the Bravo to the Alpha side. Following the evacuation of UNDOF personnel from position 85 on 28 August, UNDOF sporadically observed armed members of the opposition interacting with IDF across the ceasefire line in the vicinity of United Nations position 85.

UN troops monitoring the 1974 ceasefire between Israel and Syria have witnessed interactions between members of the Israeli Defence Forces and the Al Nusra Front who have taken over a large part of the Golan Heights.

Netanyahu‘s general, implied statement on the Golan Heights draws from political ideas developed by various right-wing figures over the past year, who argue that the situation in Syria and the takeover of ISIS and other Al-Qaida-affiliated groups of large portions of the country may allow Israel to receive international recognition of 1981 the annexation of the Golan Heights.

Syria used to exist, but soon will no longer exist. The validity of the arrangements that defined the borders and the countries in the Middle East after World War I has expired, and the region can now expect many years of instability. In such a situation, Israel must reformulate its geostrategic interests – not only on the Syrian front – by looking far into the future, rather than deep into the past.

Das heißt, nicht nur die NATO oder die UN sind Verbindungen, im Rahmen derer nach unserem Grundgesetz militärische Einsätze erlaubt sind. Auch die EU ist ein passender Rahmen.
