Dan Urman, director of the law and public policy minor at Northeastern University, who teaches courses on the Supreme Court, says the National Guard is often caught between state and federal authority. The guard generally reports to their respective state governors, “but if they get called into federal service, then the Posse Comitatus Act applies to them.”
“To work around this, presidents can ask governors to deploy their state’s National Guard members,” Urman says.
NEW YORK, NY — Congressman Dan Goldman (NY-10) was joined by Comptroller Brad Lander and Public Advocate Jumaane Williams today for a press conference calling on New York City Police Commissioner Jessica Tisch to strictly enforce state and local laws and hold federal immigration agents accountable for unlawful conduct, including potentially arresting federal officers who illegally assault or detain New York residents. Assemblymember Tony Simone and Councilmember Alexa Aviles were also in attendance.
The press conference followed Goldman’s letter to NYPD Commissioner Tisch, citing numerous instances of federal immigration officers abusing their authority and detaining, arresting, and deporting American citizens and law-abiding, non-violent New Yorkers.
At a press conference on Wednesday afternoon, Goldman, who was focused on the detention of citizens — rather than the noncitizens, who remain detained in New Jersey — suggested that the involvement of the NYPD would help prevent federal abuse. “We will continue to call on the NYPD to make sure that they are present for these raids,” he said. “Because it’s the NYPD’s job to protect New Yorkers.”
The Congressman also announced that his office would be starting a “Rapid Response Task Force” to coordinate a response to overreach by federal authorities.
“This is not immigration enforcement,” he said. “This is lawless terror to create a pretext for Donald Trump to send the military into New York City.”
An attorney handling things for the family, said his client was neither a dangerous nor an uncivil person. “What we know about Richard is that he‘s a very pacifist man, very calm. We find it very odd what‘s being said about him,” his family lawyer further told NBC Los Angeles. Los Angeles City Councilmember Curren Price’s office said the man who was shot has lived in the city for decades and is a well-known member of the community. Price’s deputy chief of staff Jose Ugarte awarded the man a certificate of recognition two months ago for his citizen reporting in the community, his office said.“
The shooting happened in the 400 block of East 20th Street near Trinity Street around 8:52 a.m. Federal officials said it began as a targeted enforcement traffic stop on an undocumented immigrant who had previously avoided capture.

Witnesses told Eyewitness News the man involved is a well-known TikToker who regularly follows ICE. He goes by Richard LA online.
No Kings organizers estimated that more than 5 million people turned out for the June protests. They speculate that Saturday‘s event could be even bigger.

Asked about the secretary’s meeting with the generals and comments about readiness for war, Pope Leo said: “This way of speaking is worrying, because it shows each time an increase in tensions — this vocabulary, even shifting from ‘Minister of Defense’ to ‘Minister of War.’ Let’s hope it is only a way of speaking. He made the announcement on social media, writing that he was directing the Department of Defense to „provide all necessary Troops to protect War ravaged Portland.“ Trump said the decision was necessary to protect U.S. Immigration and Customs Enforcement facilities, which he described as „under siege from attack by Antifa, and other domestic terrorists.“

In a brief post to his social media platform, Trump said he would have Defense Secretary Pete Hegseth order troops deployed to Oregon’s largest city.
Trump did not specify what legal justification he had to do so, what military branch would be used or other key details. The troops would be used to defend U.S. Immigration and Customs Enforcement facilities from “domestic terrorists,” he said.

SEOUL, Sept 5 (Reuters) – Hundreds of workers at a Hyundai Motor (005380.KS), opens new tab facility being built in Georgia have been detained in a major raid by U.S. authorities, forcing a pause in the construction of a car battery factory that is part of a major investment in the state by the Korean automaker.
SMN has reached out to officials at Hyundai Motor Group USA, HMGMA, and LG Solutions (which oversees construction at the HL-GA Battery Company joint venture between Hyundai and LG) for comment on the raid. Georgia Governor Brian Kemp‘s office has not responded to questions and a request for comment as of this publication.
Experts say the ensuing judicial dust-up it will clarify precedent in a murky corner of the law. But some warn it could also unearth a road map for future deployments in cities across the U.S.
“If Breyer sides with Newsom and the 9th Circuit sides with Trump, we now have a playbook to use the National Guard and maybe the military around the country,” said Mark P. Nevitt, a law professor at Emory University and one of the country’s foremost experts on the law at the heart of the case.
“He’d have a ruling from the most liberal circuit in America giving the legal go-ahead for this deployment,” Nevitt said. “That would make bad law for the country.”

The Senate‘s barely-there approval – fuck Shady Vance – of Trump‘s heinous 900-page bill represents the largest transfer of wealth to the rich in U.S. history along with the largest cut to Medicaid and food assistance, all in the obscene name of (partly) funding a $975 billion tax break for the already richest 1%. The bill, „a tipping point between normality and fascism,“ also pours over $170.7 billion into „a campaign of extermination against immigrants that evokes the greatest human rights atrocities of the past,“ funding the hiring of vastly more Nazi thugs to terrorize, humiliate and put in cages millions of brown people who do much of this country‘s work.
It will kick about 16 million people off health insurance by cutting over $1 trillion from Medicaid, because who needs health insurance. It will throw millions of poor families, veterans, the elderly and disabled off SNAP by cutting $285 billion in food assistance, because who needs food. It will cut funding to rural hospitals, nursing homes, student loans, wind and solar energy – electric bills will soar 30% – costing millions of jobs and adding almost $4 trillion to the national debt, to be paid by our children and grandchildren, one of many excellent reasons it‘s said to be the most unpopular legislation since passage of the economically disastrous Embargo Act of 1807.

Trump threatened to arrest Mamdani if as mayor he follows through on pledges not to assist federal officials enforcing immigration laws.
“Well then, we’ll have to arrest him,” Trump told reporters on July 1 while visiting a detention center in Florida. Trump said that he would “be watching over him very carefully on behalf of the nation.”
Trump also said „a lot of people are saying he‘s here illegally,“ which is false. Mamdani is a naturalized U.S. citizen born in Uganda, who immigrated to the United States with his parents − film director Mira Nair and Columbia University professor Mahmood Mamdani − at the age of seven.

Department of Justice has argued Posse Comitatus does not apply to the military’s current actions in Southern California — and even if it did, the soldiers deployed there haven’t violated the law. It also claimed the 9th Circuit decision endorsing Trump’s authority to call up troops rendered the Posse Comitatus issue moot.
Some experts feel California’s case is strong.
“You literally have military roaming the streets of Los Angeles with civilian law enforcement,” said Shilpi Agarwal, legal director of the ACLU of Northern California, “That’s exactly what the [act] is designed to prevent.”
But Nevitt was more doubtful. Even if Breyer ultimately rules that Trump’s troops are violating the law and grants the injunction California is seeking, the 9th Circuit will almost certainly strike it down, he said.
“It’s going to be an uphill battle,” the attorney said. “And if they find a way to get to the Supreme Court, I see the Supreme Court siding with Trump as well.”

On the streets of Los Angeles, protesters will continue to be met with platoons of armed soldiers. State and local officials remain in open conflict with the president. And in the courts, Trump administration lawyers are digging deep into case law in search of archaic statutes that can be cited to justify the ongoing federal crackdown — including constitutional maneuvers invented to enforce the Fugitive Slave Act of 1850.
Thousands of heavily armed Guard troops, as well as 700 U.S. Marines have been deployed in the city’s downtown core for over a week in response to protests over ongoing ICE raids and abductions of the undocumented (and in some cases, the documented).
Governor Newsom‘s office quickly condemned the announcement, saying the new activation is the second set of 2,000 federalized National Guard members under Trump‘s June 9 order.

California Sen. Alex Padilla delivered a speech on the Senate floor on Tuesday, recalling the incident and calling on lawmakers to speak out against the Trump administration.
Padilla, in a phone interview after his speech, said he was “sadly, not shocked in the least bit” to hear of Lander’s detention. He spoke to POLITICO about Lander, the backstory of his appearance at Noem’s news conference, the words that pushed him to interrupt her remarks and more.
Senate Minority Leader Chuck Schumer said it “sickened my stomach — the manhandling of a United States Senator.” Padilla’s California colleague Adam Schiff called for an immediate investigation.
Several other Democrats were dropping the word “fascism” in conversations as they made their way out of the Capitol.
Security guards wrestled Padilla out of the conference room as he explained he was a senator and wanted to ask the homeland security secretary a question.
Speaking to reporters after the incident, Padilla said: ‚If this is how this administration responds to a senator with a question, you can only imagine what they’re doing to farm workers, to cooks, to day labourers out in the Los Angeles community and throughout California and throughout the country‘
About five minutes into a press conference at the Westwood federal building, Noem told the media that the Trump administration planned to “liberate the city from the socialists and the burdensome leadership that the governor and the mayor have placed on this country.”

WASHINGTON — Immigration agents have arrested 330 immigrants in Los Angeles since Friday, the White House confirmed Wednesday.
Hundreds of people were arrested in downtown Los Angeles Tuesday, as protests continued over federal immigration sweeps and a curfew went into place for parts of downtown, police said.
The LAPD said there were 203 arrests for failing to disperse. There were also 17 arrests for violating the curfew;
In addition to protecting government buildings and personnel, the Pentagon has said the troops will safeguard Immigration and Customs Enforcement officers during raids.
ICE posted photos online on Tuesday of National Guard troops standing guard with weapons in hand as ICE officers handcuffed apparent migrants against the side of a car in Los Angeles.
An 1878 law, the Posse Comitatus Act, generally forbids the U.S. military, including the National Guard, from taking part in civilian law enforcement.
Protests over federal immigration enforcement raids and President Donald Trump’s move to mobilize the National Guard and Marines in Los Angeles are spreading nationwide and are expected to continue into the weekend.
Texas Gov. Greg Abbott has deployed National Guard troops across the state ahead of more anti-ICE protests.
Abbott announced the move early Wednesday in a post on X as protests sprang up in parts of Texas and across the U.S. this week.
