South Africa has begun proceedings at the International Court of Justice, alleging violations of the Genocide Convention in relation to Israeli attacks on Palestinians in the Gaza Strip, the court said in a statement on Friday.

(a) Tötung von Mitgliedern der Gruppe;

(c) vorsätzliche Auferlegung von Lebensbedingungen für die Gruppe, die geeignet sind, ihre körperliche Zerstörung ganz oder teilweise herbeizuführen;
(d) Verhängung von Maßnahmen, die auf die Geburtenverhinderung innerhalb der Gruppe
gerichtet sind;
(e) gewaltsame Überführung von Kindern der Gruppe in eine andere Gruppe.
Artikel III: Die folgenden Handlungen sind zu bestrafen:
(a) Völkermord,
(b) Verschwörung zur Begehung von Völkermord,
(c) unmittelbare und öffentliche Aufhetzung zur Begehung von Völkermord,
(d) Versuch, Völkermord zu begehen,
(e) Teilnahme am Völkermord.
Artikel IV: Personen, die Völkermord oder eine der sonstigen in Artikel II aufgeführtenvHandlungen begehen, sind zu bestrafen, gleichviel ob sie regierende Personen, öffentliche Beamte oder private Einzelpersonen sind.
Convention on the Prevention and Punishment of the Crime of Genocide
(Adopted by Resolution 260 (III) A of the United Nations General Assembly on 9 December 1948.)
Article I
The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish.
Article II
In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
Article III
The following acts shall be punishable:
(a) Genocide;
(b) Conspiracy to commit genocide;
(c) Direct and public incitement to commit genocide;
(d) Attempt to commit genocide;
(e) Complicity in genocide.
Article IV
Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.

Disputes between the Contracting Parties relating to the interpretation, application or fulfilment of the present Convention, including those relating to the responsibility of a State for genocide or any of the other acts enumerated in article III, shall be submitted to the International Court of Justice at the request of any of the parties to the dispute.
The Republic of South Africa institutes proceedings against the State of Israel and requests the Court to indicate provisional measures
THE HAGUE, 29 December 2023. South Africa today filed an application instituting proceedings against Israel before the International Court of Justice (ICJ), the principal judicial organ of the United Nations, concerning alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) in relation to Palestinians in the Gaza Strip.
According to the Application, “acts and omissions by Israel . . . are genocidal in character, as they are committed with the requisite specific intent . . . to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group” and that “the conduct of Israel — through its State organs, State agents, and other persons and entities acting on its instructions or under its direction, control or influence — in relation to Palestinians in Gaza, is in violation of its obligations under the Genocide Convention”.

Jarrar is a prominent figure in the Popular Front for the Liberation of Palestine, the second largest faction in the Palestine Liberation Organization, and was elected a member of the legislative council in the last parliamentary elections held in 2006.
Jarrar was born in the city of Nablus in the northern West Bank on February 9, 1963. She has a Bachelor’s degree in Business Administration and a Master’s degree in Democracy and Human Rights from Birzeit University. She served as a Director of Addameer Prisoners’ Support and Human Rights Association from 1994 to 2006, when she was elected to the Palestinian Legislative Council (PLC)—the Palestinian Parliament. She now heads the PLC’s Prisoners Commission, in addition to her role on the Palestinian National Committee for follow-up with the International Criminal Court.

Many speculated as to what caused such a severe deterioration in Farouq’s condition. Was it torture? Starvation? Medical neglect? All tactics that have been widely reported by human rights groups and Palestinians recently released from Israeli custody.

What Israel Lost Before October 7 – The worst year in the country’s history began with Netanyahu’s return to power.
Owing to the massive demonstrations that drew hundreds of thousands of Israelis into the streets, Netanyahu succeeded in passing only one law, aimed at neutering the highest court’s powers of judicial review. After a delay caused by the war, Israel’s supreme court is scheduled to hear petitions against this law in January. The protests “saved Israel,” Peled Nakash said. “We were the nation’s safety net.”
A lieutenant commander in the naval reserves, Peled Nakash was one of hundreds of senior officers who announced they would refuse to serve if Israel ceased to be a democracy — all of whom reported for duty when called after October 7. Her group, Brothers and Sisters in Arms, vociferously denounced Netanyahu for risking Israeli security by dividing society so deeply.
Israeli Court Decries ‘Leaks’ of Ruling on Netanyahu’s Legal Overhaul
“The judiciary views very severely the leak of parts of draft rulings that have not been completed,” acting Supreme Court President Uzi Vogelman said of the leak. “The attempt to influence pending proceedings and to harm public trust in the judiciary and its dedicated judges and employees will not succeed.” The final ruling is expected to arrive midway through January.
