A Presidential Proclamation to End the Iraq War: Unilateral Executive Action to Defang a Zombie AUMF

The current blockage in the House—particularly given its potential use for a war with Iran— should prompt the White House to consider alternative means to disarm the 2002 Iraq AUMF. One reported reason that repeal legislation has yet to receive an up-or-down vote in the House is that some members are concerned about losing a potential authority for war with Iran. (The House of Representatives already voted to repeal the 2002 authorization in a previous Congress.) To be clear, it does not do so (see here and here). Nevertheless, a desire to keep the 2002 Iraq AUMF on the books as authority to fight Iran was certainly expressed by a number of senators who opposed repeal.

Senate votes overwhelmingly to keep 2001 authorization for war on terror

Senators rejected the amendment 86-9 as they are debating a separate repeal of two authorizations of military force in Iraq. There is broad bipartisan support to withdraw that congressional approval granted in 1991 and 2002 for military strikes against Saddam Hussein‘s regime.

While those two authorizations are rarely used and focused on just one country, Iraq, the 2001 measure gave President George W. Bush broad authority for the invasion of Afghanistan and the fight against terrorism, approving force „against those nations, organizations, or persons“ that planned or aided the Sept. 11, 2001, attacks on the United States.

Congress voted to repeal the 1991 and 2002 AUMFs in March. Paul’s amendment to that legislation that would have also repealed the 2001 AUMF failed 9-86.

The Republican senator explained the difficulties he’s had with other Republicans in trying to rollback AUMF during a foreign policy conference hosted by The American Conservative on Thursday.

“I have good news and bad news,” Paul told the audience. “The good news is that Congress finally voted to end a war. The bad news is the war they voted to end had already been over for about 15 years.”

Senator Todd Young urging Congress to repeal Authorizations for Use of Military Force

An example is President Trump’s citing of the 2002 AUMF, as a “secondary authority” according to Young, in order to carry out an attack in Iraq that resulted in the death of Iranian military leader Qasem Soleimani in January of 2020.

Young believes these military attacks, though warranted, show that the 2002 AUMF is being abused in order to carry out acts of war without the consent of Congress.

Virginia Sen. Kaine’s proposal to repeal decades-old war authorization advances to the Senate floor

In a Senate Foreign Relations Committee meeting on Wednesday, U.S. Sens. Tim Kaine (D-Va.) and Todd Young (R-Ind.) advanced a proposal to repeal two Authorizations for Use of Military Force (AUMF) issued in 1991 and 2002.

Instead of the current default approval of arms sales barring a passage of a resolution of disapproval by veto-proof majorities of the House and Senate, the proposal directs Congress to proactively approve certain sales topping $14 million including those of air to ground munitions.

Why Congress is finally starting to claw back its war powers from the president

The 1991 measure was approved in the run-up to the first Gulf War, and the 1957 one was signed into law by President Dwight D. Eisenhower to prevent the spread of Soviet communism in the Middle East, but it was never formally invoked. Neither serves a practical purpose today; and most lawmakers view the 2002 AUMF the same way, since the Iraq War has been over for a decade now.
