5. Conclusion

110. Taken together, the facts and arguments presented above demonstrate that Israel‘s conduct satisfies three key acts enumerated in Article II of the Genocide Convention. In our area of expertise – the right to health – the legal and moral conclusion is unavoidable. The destruction of life-sustaining systems, the cumulative patterns of destruction, the bodily and mental trauma inflicted, and the direct killing of civilians, when understood in light of the implemented policy and the public rhetoric, make clear that Israel‘s campaign in Gaza constitutes genocide under international law.

111. We thus conclude that, based on the available evidence and
the applicable legal standards under the Genocide Convention:

● Israel is committing acts under Article II(a), (b), and (c), including killing, inflicting serious bodily and mental harm, and deliberately imposing conditions of life intended to destroy the Palestinian population in Gaza, in whole or in part;

● There is sufficient evidence to establish that these acts are carried out with the specific intent required by Article II.

OUR GENOCIDE

Since October 2023, Israel has fundamentally changed its policy toward the Palestinians. Following the Hamas-led attack on 7 October 2023, Israel launched an intensive military campaign in the Gaza Strip, which is still underway more than 20 months later. Israel‘s onslaught on Gaza includes mass killing, both in direct attacks and through creating catastrophic living conditions that continue to raise the massive death toll; serious bodily or mental harm to the entire population of the Strip; large-scale destruction of infrastructure; destruction of the social fabric, including educational institutions and Palestinian cultural sites; mass arrests and abuse of detainees in Israeli prisons, which have effectively become torture camps for thousands of Palestinians held without trial; mass forced displacement, including attempts at ethnic cleansing and making the latter an official war goal; and an assault on Palestinian identity through the deliberate destruction of refugee camps and attempts to undermine the United Nations Relief and Works Agency for Palestine Refugees (UNRWA). The outcome of this comprehensive assault on the Gaza Strip is severe, and at least in part, irreparable, harm to more than 2 million people living in the Gaza Strip, as part of the Palestinian people.

An examination of Israel‘s policy in the Gaza Strip and its horrific outcomes, together with statements by senior Israeli politicians and military commanders about the goals of the attack, leads to the unequivocal conclusion that Israel is taking coordinated action to intentionally destroy Palestinian society in the Gaza Strip. In other words: Israel is committing genocide against Palestinians in the Gaza Strip.

The attack took place outside the Sheikh Radwan clinic, a health centre established by the United Nations in 2024 to distribute polio vaccinations to Palestinian children.

At least 41 people have been killed in the besieged enclave since dawn, including eight civilians waiting for humanitarian aid.

Eleven people were also killed on Monday morning near aid distribution sites, two local hospitals that received the bodies told ABC News.

The leaders of Cambodia and Thailand agreed to a ceasefire on Monday effective at midnight, in a bid to bring an end to their deadliest conflict in more than a decade after five days of fierce fighting.

Amid an international effort to quell the conflict, the Thai and Cambodian leaders held talks in Malaysia hosted by its Prime Minister Anwar Ibrahim, the current chair of the ASEAN regional bloc, where both sides agreed to halt hostilities and resume direct communications.

Is this Gaza’s ‘bomb the tracks’ moment?

Starving at Bergen-Belsen alongside my mother, perhaps in the same barracks, was Hanna Levy-Hass, mother of Haaretz journalist Amira Hass. Hanna was one of the few people to keep a diary throughout her time at Bergen-Belsen, which survived and was later published.

In February 1945, she wrote: “Hunger crushes the spirit. I feel my physical and intellectual strength diminishing. Things escape me, I can’t think properly, can’t grasp events, can’t realize the full horror of the situation.

“Our hunger has only become fiercer,” the diary entry went on. “Our bodies have been demolished by it, we all drag ourselves around like rags; men literally drop to the ground from exhaustion and end up dying of hunger, simple as that.”

Eighty years later, in a dispatch this week from Khan Younis in southern Gaza, +972 Magazine journalist Ruwaida Amer wrote, “For about a month now, though, I’ve lost the ability to follow the news. My focus is slipping. My body is breaking down.”
