PM may have to account to the International Criminal Court, says Browne

“This represents the first time in our records that a prime minister of Trinidad and Tobago would have proudly and publicly associated this nation with violations of international human rights of the UN Charter and International law,” he said.

Browne said the Prime Minister of T&T has continued to double down and triple down, including very recently her public stance in support of these extra-judicial killings.

He said while the US is not one of the state parties to the ICC, Trinidad and Tobago is, having been one of the founders.

Joining the International Criminal Court

JOINING THE ROME STATUTE IS AN EXPRESSION OF SOLIDARITY WITH THE VICTIMS

Victims have the right to participate in the proceedings before the Court through
a legal representative. States Parties to the Rome Statute have established a Trust Fund for Victims, an independent institution through which victims and their families can receive assistance and reparations, including restitution, compensation and rehabilitation.

JOINING THE ROME STATUTE IS A POWERFUL FOREIGN POLICY STATEMENT

States Parties and the international community continue to reaffirm their commitment to the ICC. Ratifying or acceding to the Rome Statute shows commitment to international law and peace and security and strengthens the resolve of multilateral diplomacy.

JOINING THE ROME STATUTE CONTRIBUTES TO THE PREVENTION AND DETERRENCE OF FUTURE CRIMES

Through its preliminary examinations, investigations and judicial processes, the ICC’s work can help prevent future crimes from happening by putting potential perpetrators on notice that anyone may be held responsible if they commit core international crimes.

JOINING THE ROME STATUTE REINFORCES THE EQUALITY OF ALL BEFORE THE LAW

The Rome Statute sets one standard for all – no one is below or above the law.
As official capacity is irrelevant under the Rome Statute, all individuals can be
brought to justice for grave international crimes.

“More than a human can bear”: Israel‘s systematic use of sexual, reproductive and other forms of gender-based violence since October 2023

“The evidence collected by the Commission reveals a deplorable increase in sexual and gender-based violence,” said Navi Pillay, Chair of the Commission. “There is no escape from the conclusion that Israel has employed sexual and gender-based violence against Palestinians to terrorise them and perpetuate a system of oppression that undermines their right to self-determination.”

The release of the report was accompanied by two days of public hearings held in Geneva on 11-12 March, during which the Commission heard from victims and witnesses of sexual and reproductive violence and medical personnel who assisted them, as well as representatives from civil society, academics, lawyers and medical experts.

The report found that sexual and gender-based violence – which has risen in frequency and severity – is being perpetrated across the Occupied Palestinian Territory as a strategy of war for Israel to dominate and destroy the Palestinian people.

Specific forms of sexual and gender-based violence – such as forced public stripping and nudity, sexual harassment including threats of rape, as well as sexual assault – comprise part of the Israeli Security Forces’ standard operating procedures toward Palestinians.

Other forms of sexual and gender-based violence, including rape and violence to the genitals, were committed either under explicit orders or with implicit encouragement by Israel’s top civilian and military leadership, the report said.

U.N. report accuses Israel of sexual violence, ‘genocidal acts’ in Gaza

A U.N. report released Thursday accused Israel of carrying out “systematic” gender-based violence during its 17-month war in the Gaza Strip, including by shelling fertility clinics and hospital maternity wards, causing maternal deaths by blocking aid deliveries, and subjecting male and female detainees to sexual humiliation or abuse.

The 49-page report, by a U.N. Independent International Commission of Inquiry, said that “Israeli authorities have destroyed in part the reproductive capacity of the Palestinians in Gaza as a group, including by imposing measures intended to prevent births, one of the categories of genocidal acts in the Rome Statute and the Genocide Convention.”

Jordan: Press remarks by the High Representative/Vice-President Josep Borrell after meeting with Deputy Prime Minister and Minister for Foreign Affairs Ayman Safadi

Q. [Inaudible… on the ICC arrest warrant against Netanyahu and Galant] How do you look at this in Jordan? The same question also is addressed to Mister Borrell, how do you view this International Criminal Court (ICC) resolution? Do you believe that the European Union and the international community can implement this decision or resolution or not?

Thank you. As I said before, the tragedy in Gaza has to stop. Now, I will be very sober in my comment. It is not a political decision. It is a decision of a Court, of a Court of Justice, of the International Criminal Court. The decisions of the courts have to be respected and implemented. So, I take note of the decision of the International Criminal Court to issue arrest warrants for Prime Minister [Benjamin] Netanyahu, the former Minister of Defence Mister [Yoav] Gallant, and the Hamas’ leaders. This decision is a binding decision and all States, all States parties of the [Rome Statute of] Court, which include all members of the European Union, are bound to implement this court decision.

GAZA STRIP: Hostilities leave the entire population highly food insecure and at risk of Famine

Between 24 November and 7 December, over 90 percent of the population in the Gaza Strip (about 2.08 million people) was estimated to face high levels of acute food insecurity, classified in IPC Phase 3 or above (Crisis or worse). Among these, over 40 percent of the population (939,000 people) were in Emergency (IPC Phase 4) and over 15 percent (378,000 people) were in Catastrophe (IPC Phase 5).

Between 8 December 2023 and 7 February 2024, the entire population in the Gaza Strip (about 2.2 million people) is classified in IPC Phase 3 or above (Crisis or worse). This is the highest share of people facing high levels of acute food insecurity that the IPC initiative has ever classified for any given area or country

The UN says more than 1 in 4 people in Gaza are starving because of war

“It doesn’t get any worse,’’ said Arif Husain, chief economist for the U.N.’s World Food Program. “I have never seen something at the scale that is happening in Gaza. And at this speed.”

Israel says it is in the final stages of clearing out Hamas militants from northern Gaza, but that months of fighting lie ahead in the south.

20.12.2023 - 16:44 [ Human RIghts Watch ]

Israel: Starvation Used as Weapon of War in Gaza

International humanitarian law, or the laws of war, prohibits the starvation of civilians as a method of warfare. The Rome Statute of the International Criminal Court provides that intentionally starving civilians by “depriving them of objects indispensable to their survival, including willfully impeding relief supplies” is a war crime. Criminal intent does not require the attacker’s admission but can also be inferred from the totality of the circumstances of the military campaign.

In addition, Israel’s continuing blockade of Gaza, as well as its more than 16-year closure, amounts to collective punishment of the civilian population, a war crime. As the occupying power in Gaza under the Fourth Geneva Convention, Israel has the duty to ensure that the civilian population gets food and medical supplies.

Dr. Cornel West Calls on International Criminal Court to Investigate Likely War Crimes and Other Violations Committed by Benjamin Netanyahu and the Israel Defense Force

Independent candidate for President of the United States, Dr. Cornel West today called on the International Criminal Court to launch an immediate investigation into likely war crimes committed by Israeli Prime Minister, Benjamin Netanyahu and the Israel Defense Force (IDF).

As more details and evidence emerge, Brother West believes the global community must intervene and administer comeuppance for clear violations of Articles 6 (Genocide), 7 (Crimes Against Humanity), and 8 (War Crimes) of the Rome Statutes of the International Criminal Court as part of a larger set of immediate actions to protect Palestinian civilians including, but not limited to, an immediate and enforced ceasefire.

B‘Tselem welcomes Amnesty International‘s new report, calling the Israeli regime what it is: apartheid.

This is an essential step in the struggle to change this reality, towards a future where all people living here will enjoy justice, equality and respect for their human rights.

The panic sounded by Israeli Minister of Foreign Affairs Yair Lapid, as well as the false claims made by various Israeli “Hasbara” organizations, as if the report is an attempt to deny the State of Israel’s right to exist, reveal their stance – that a regime of Jewish supremacy is justifiable, and should be perpetuated. Yet, the demand for equality and for the protection of human rights for all, threatens only those opposed to these values. The claim that this demand causes them harm makes it abundantly clear which side they have chosen.

Israel’s apartheid against Palestinians: a cruel system of domination and a crime against humanity

(February 1, 2022)

Israeli authorities must be held accountable for committing the crime of apartheid against Palestinians, Amnesty International said today in a damning new report. The investigation details how Israel enforces a system of oppression and domination against the Palestinian people wherever it has control over their rights. This includes Palestinians living in Israel and the Occupied Palestinian Territories (OPT), as well as displaced refugees in other countries.

The comprehensive report, Israel’s Apartheid against Palestinians: Cruel System of Domination and Crime against Humanity, sets out how massive seizures of Palestinian land and property, unlawful killings, forcible transfer, drastic movement restrictions, and the denial of nationality and citizenship to Palestinians are all components of a system which amounts to apartheid under international law. This system is maintained by violations which Amnesty International found to constitute apartheid as a crime against humanity, as defined in the Rome Statute and Apartheid Convention.
