UN Court Orders Israel To Open More Land-Based Aid Routes Into Gaza Strip

In its legally binding order, the court told Israel to take measures “without delay” to ensure “the unhindered provision” of basic services and humanitarian assistance, including food, water, fuel and medical supplies.

It also ordered Israel to immediately ensure that its military does not take action that could that could harm Palestinians’ rights under the Genocide Convention, including by preventing the delivery of humanitarian assistance.

„If any Israeli leader really wants an end for this and peace for the region on the long term, they would see that my father is someone that would bring that, who still believes in the tiny chance left for the two-state solution.“

That would be a hard ask for Israelis who see Barghouti as a terrorist with blood on his hands. He was convicted by an Israeli court for his role in the second intifada violence and sentenced to five life terms in 2004.

Barghouti refused to present a defence to a court whose authority he doesn‘t recognize but has denied the allegations.

U.S. raises treatment of imprisoned Palestinian leader Barghouti with Israel

The State Department has not named Barghouti in public statements, but U.S. officials said they are aware of allegations of abuse. The department said in a statement to The Post that it has informed Israel that it must “thoroughly and transparently investigate credible allegations of and ensure accountability for any abuses or violations.”

Yesterday marked the fourth consecutive day that thousands of protesters have come out on to the streets of the Jordanian capital to surround the Israeli embassy, demanding its closure. Young demonstrators tried to breach the security cordon established around the complex by Jordanian security forces, resulting in the arrest of approximately 200 protesters.

Trump, the presumptive Republican nominee for president in 2024, sat down for an interview with Israeli newspaper Israel Hayom about the ongoing military invasion — and warned that the world was growing tired of the conflict.

„You have to finish up your war. You have to finish it up. You’ve got to get it done,“ he told the newspaper.

He continued, „We’ve got to get to peace. You can’t have this going on, and I will say Israel has to be very careful because you are losing a lot of the world. You are losing a lot of support.“

„The Israelis seemed oblivious to the fact that they are facing major, possibly generational damage to their reputation not just in the region but elsewhere in the world,“ the memo says. „We are concerned that the Israelis are missing the forest for the trees and are making a major strategic error in writing off their reputation damage.“

The State Department memo recommended pressing Israeli officials on the matter „at the highest levels.“

Angesichts der sich verschlimmernden Lage in dem Kriegsgebiet und einer drohenden Hungersnot hatte Südafrika zusätzliche Maßnahmen verlangt. Dem entsprach das Gericht. Entscheidungen des UN-Gerichtshofes sind bindend.

51. For these reasons,

THE COURT ,

(1) By fourteen votes to two,

Reaffirms the provisional measures indicated in its Order of 26 January 2024;

IN FAVOUR : President Salam; Judges Tomka, Abraham, Yusuf, Xue, Bhandari, Iwasawa, Nolte, Charlesworth, Brant, Gómez Robledo, Cleveland, Aurescu, Tladi;

AGAINST : Vice-President Sebutinde; Judge ad hoc Barak;

(2) Indicates the following provisional measures:

The State of Israel shall, in conformity with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, and in view of the worsening conditions of life faced by Palestinians in Gaza, in particular the spread of famine and starvation:

(a) Unanimously,

Take all necessary and effective measures to ensure, without delay, in full co-operation with the United Nations, the unhindered provision at scale by all concerned of urgently needed basic services and humanitarian assistance, including food, water, electricity, fuel, shelter, clothing, hygiene and sanitation requirements, as well as medical supplies and medical care to Palestinians throughout Gaza, including by increasing the capacity and number of land crossing points and maintaining them open for as long as necessary;

(b) By fifteen votes to one,

Ensure with immediate effect that its military does not commit acts which constitute a violation of any of the rights of the Palestinians in Gaza as a protected group under the Convention on the Prevention and Punishment of the Crime of Genocide, including by preventing, through any action, the delivery of urgently needed humanitarian assistance;

IN FAVOUR : President Salam; Vice-President Sebutinde; Judges Tomka, Abraham, Yusuf, Xue, Bhandari, Iwasawa, Nolte, Charlesworth, Brant, Gómez Robledo, Cleveland, Aurescu, Tladi;

AGAINST : Judge ad hoc Barak;

(3) By fifteen votes to one,

Decides that the State of Israel shall submit a report to the Court on all measures taken to give effect to this Order, within one month as from the date of this Order.

World court orders Israel to take action to address Gaza famine

„The court observes that Palestinians in Gaza are no longer facing only a risk of famine (…) but that famine is setting in,“ the judges said in their order.

The new measures were requested by South Africa as part of its ongoing case that accuses Israel of state-led genocide in Gaza.

In January the ICJ, also known as the World Court, ordered Israel to refrain from any acts that could fall under the Genocide Convention and to ensure its troops commit no genocidal acts against Palestinians in Gaza.
