In den Abschnitten (5) und (6) dieses Paragrafen drohen auch ausdrücklich im Fall von fahrlässigem Handeln erhebliche Strafen. Der in Rastatt entstandene Schaden muss am Ende überwiegend vom Steuerzahler beglichen werden; es geht um hunderte Millionen Euro. Trotz der dramatischen Umstände und der hohen Schadenssummen wurde keine Bundespolizei eingeschaltet. Keine Staatsanwaltschaft nahm sich der Sache an. Die offiziellen Sicherheitsbehörden, das Eisenbahn-Bundesamt und die Bundesstelle für Eisenbahn-Unfalluntersuchung (BEU) erklärten sich für nicht zuständig (da es keinen Personenschaden gegeben habe).
