Congressman Criticizes ‘Selective Prosecution’ of CIA Whistleblower John Kiriakou, Calls for Pardon
(20.11.2014) On the floor of House of Representatives on November 17, Virginia Democratic Representative Jim Moran put forward a stinging rebuke of the “selective prosecution” of former CIA officer and whistleblower John Kiriakou. He asked President Barack Obama to pardon Kiriakou and called the fifteen-year CIA veteran “an American hero.”
Kiriakou was the first member of the CIA to publicly acknowledge that torture was official US policy under President George W. Bush’s administration. He was convicted in October 2012 after he pled guilty to violating the Intelligence Identities Protection Act (IIPA). He was sentenced to two and a half years in jail in January 2013, and reported to Federal Correctional Institution Loretto in Pennsylvania on February 28, 2013, where he has been serving his sentence. (Firedoglake has been publishing Kiriakou’s letters from prison written as “Letters from Loretto”.)

Ex-CIA Operative Says Prison Was Punishment for Whistleblowing on Torture
Kiriakou was the first person with direct knowledge of the CIA interrogation program to publicly reveal its existence, in an interview with ABC News in 2007. He is now serving a nearly-three-year prison sentence for violating the Intelligence Identities Protection Act, but he says that’s only what the government wants people to believe.
“In truth, this is my punishment for blowing the whistle on the CIA’s illegal torture program and for telling the public that torture was official U.S. government policy,” Kiriakou said in a letter last May from a prison in Loretto, Penn. “But that’s a different story.”

Secretive UK Court That Approves Of GCHQ Surveillance Says That GCHQ Surveillance Doesn‘t Violate Human Rights
For a while now, we‘ve been covering various legal challenges in Europe related to the GCHQ‘s surveillance activities. One of the main cases, brought by Amnesty International and Privacy International, argued that the surveillance violated the European Convention on Human Rights (specifically article 8, on right to privacy, and article 10, on freedom of expression). While it was always expected that the case would eventually go to the European Court of Human Rights, the first step was the Investigatory Powers Tribunal in the UK — a secretive court that reviews complaints about surveillance, but (as with nearly all „secretive courts“ charged with „oversight“ on the intelligence community) almost always sides with the intelligence community. Between 2000 and 2012 the IPT only sided against the intelligence community 10 times out of 1468 cases brought (about half of one percent of all cases). In other words, this is a court that (in secret) regularly okays GCHQ‘s surveillance efforts on UK citizens.
So take a wild guess what happened when it was asked to determine if such surveillance violated human rights? It said of course no human rights were violated when the GCHQ spied on people.

Das Internet ist kein rechtsfreier Raum. Eigentlich ist das Internet gar kein Raum. Es ist ein Netzwerk von Computern die von Menschen rund um die Welt benutzt und betrieben werden. Auf diesen Rechnern werden Daten gespeichert und verarbeitet, zwischen den Menschen findet Kommunikation statt. Bei den Vorgängen die mit dem Internet bewerkstelligt werden können gibt es auch solche die gegen die Gesetze verschiedener Länder verstoßen. Straftaten wie Betrug, Verleumdung, Stalking, Urheberrechtsverstöße, Spionage, illegale Pornographie und die Vernetzung krimineller Vereinigungen sind in fast allen Ländern der Erde in ähnlicher Weise strafbar. Andere Vorgänge wie die positive Darstellung von Homosexualität ist nur in wenigen Ländern strafbar (z.B. Russland, nicht jedoch Deutschland oder die USA). Da in der Antarktis, im Weltraum und in internationalen Gewässern keine Rechner stehen, die für die Struktur des Internets eine große Rolle spielen, fallen alle Vorgänge die im Internet passieren unter die Gesetzgebung eines oder manchmal sogar mehrerer Länder.
