“Hauptausschuss” des Bundestages: Institutionalisierung des abrufbaren Ausnahmezustands

Am Donnerstag, dem 28. November, kommt nach einem Antrag von Bündnis 90/Die Grünen der Bundestag zu einer weiteren Sondersitzung zusammen. Das Parlament, dessen letzte reguläre Sitzung auf Juni datiert, plant – angeblich für eine “Übergangsphase” – die Installation eines präzedenzlosen und von der Verfassung nicht vorgesehenen “Hauptaussschusses” aus jeweils 40 Mitgliedern und Stellvertretern aus allen Parteien. Als faktisches Notstandsparlament in einem vom Parlament selbst erklärten Ausnahmezustand, da nur mit geschäftsführender Regierung, soll es u.a. mindestens zwei Militäreinsätze der Bundeswehr in Afrika beschließen, sowie “Beschlüsse des Euro-Rettungsmechanismus ESM” vorbereiten. Dabei ist unklar, ob der Einsatz der deutschen Marinestreitkräfte im Rahmen einer “Präsenz- und Überwachungsoperation” im gesamten Mittelmeerraum (und damit auch vor der Küste Syriens) unter dem Mandat “Operation Active Endeavour” bereits wie geplant am gestrigen Mittwoch durch die geschäftsführende Merkel-Regierung verfassungswidrig und mit Billigung der S.P.D. ohne Parlamentsbeschluss verlängert wurde.

Pläne von SPD und Union: Unbehagen am Super-Ausschuss

Verfassungsrechtlich ist das nicht unbedenklich. Der Hauptausschuss tritt dann nämlich quasi an die Stelle des gesamten Parlaments. Er ist ein geschrumpftes Arbeitsparlament für eine Übergangszeit – und ein Gremium „praeter constitutionem“, neben der Verfassung also, wie der Staatsrechtler Max-Emanuel Geis von der Universität Erlangen meint. In der gesamten rechtswissenschaftlichen Literatur sei so etwas nicht behandelt.

We‘re TPP Activists: Reddit Asked Us Everything

As another of round of secret Trans-Pacific Partnership (TPP) meetings began in Salt Lake City this week, EFF joined Knowledge Ecology International, Public Citizen, Techdirt, and Open Media, in a Reddit AMA (“Ask Me Anything”) to answer users‘ questions about the leaked TPP “Intellectual Property” chapter.

We answered questions, because representatives of the governments negotiating the text certainly weren‘t going to. Internet users expect to be able to engage and participate in deciding our policy priorities. We do not want regulations to be decided through back room deals with corporate interests—and the growing opposition against TPP reflects this. When a user asked how we plan on stopping this agreement, Peter Maybarduk of Public Citizen said it best: “Our plan to stop the TPP is simple: tell people what‘s in it.”

November Days of Drums

Friday afternoon in my upstate New York hometown, around 2 p.m. I was a drummer in the junior high school band and after lunch in the cafeteria went to a rehearsal of the entire percussion section. A couple of bare light bulbs illuminated the stage; the rest of the auditorium was pitch black. Our teacher tapped his baton in time against the top of a music stand as we loudly banged away, reading the sheet music in front of us, the loud noise bouncing around the empty hall.
