In the final days before the presidential election, the Supreme Court has been pelted with requests from parties in battleground states seeking last minute approval to change election rules, especially regarding whether mail-in votes can arrive after Election Day and still be counted.
More than 9 million Americans have been infected with the coronavirus and more than 229,000 have tragically died. No, Mr. President, we haven’t turned the corner on this virus. The pandemic is getting worse, and the White House has been absolutely nonresponsive.

Most pollsters show Democratic presidential nominee Joe Biden with a sturdy and stable lead over President Trump at a time when tens of millions of people have already voted and there is almost no time to change the course of the race.
But a handful of contrarian pollsters believe Trump’s support is underrepresented and that election analysts could be headed for another embarrassing miss on Election Day.
Democrats are sounding the alarm about weak voter turnout rates in Florida’s biggest county, Miami-Dade, where a strong Republican showing is endangering Joe Biden’s chances in the nation’s biggest swing state.
No Democrat can win Florida without a huge turnout and big winning margins here to offset losses elsewhere in the state. But Democrats are turning out at lower rates than Republicans and at lower rates than at this point in 2016, when Hillary Clinton won by 29 percentage points here and still lost the state to Donald Trump.
Still, Trump may indeed be defeated. If that happens, he and his supporters must honor the outcome. But a question repeatedly asked of Trump should be more often asked of his foes: If Trump wins, will they accept the results?
The Interregnum comprises 79 days, carefully bounded by law. Among them are “the first Monday after the second Wednesday in December,” this year December 14, when the electors meet in all 50 states and the District of Columbia to cast their ballots for president; “the 3d day of January,” when the newly elected Congress is seated; and “the sixth day of January,” when the House and Senate meet jointly for a formal count of the electoral vote. In most modern elections these have been pro forma milestones, irrelevant to the outcome. This year, they may not be.
“Our Constitution does not secure the peaceful transition of power, but rather presupposes it,” the legal scholar Lawrence Douglas wrote in a recent book titled simply Will He Go?

There does seem to be general agreement on one provision of the 1887 act: the “safe harbor” clause. It provides that, if a state submits its final tally in the Presidential contest by six days before the meeting of the Electoral College, that decision is “conclusive” and thus free from legal challenge. This year, the safe-harbor deadline is December 8th; the Electoral College meets in each state capitol on December 14th.
It is unclear, however, what will happen if a slow vote count puts a state in jeopardy of missing the deadline.

More than at any time since 2000, the possibility that states could have problems meeting crucial December deadlines for their electoral totals hangs in the air. The sheer challenge of tallying mail-in ballots during a pandemic could delay final results, as could litigation in swing states with narrow margins between candidates.
Tuesday is shaping up as a busy day on the campaign trail, as President Trump plans to stage rallies in three states — Michigan, Wisconsin and Nebraska — and Democratic nominee Joe Biden is scheduled to hold a pair of events in Georgia, a state that Republicans have carried in every White House contest since 1996.

Is Pennsylvania a must-win for Biden?
No, not quite. It is close to being a must-win for Trump, who has only a 2 percent chance of winning the Electoral College if he loses Pennsylvania. Biden, however, has a bit more margin for error. He’d have a 30 percent chance if he lost Pennsylvania, which isn’t great but is also higher than, say, Trump’s overall chances on Election Day 2016.
In the survey, we asked voters who have missed at least one national election — which included some people who almost always vote — why they didn’t cast a ballot. Nearly a quarter cited some of the structural barriers we mentioned above. But another 31 percent said that they decided not to vote because they disliked the candidates or they thought nothing would change as a result of the election (26 percent).
That sense that the candidates are too flawed to be worth voting for — or that the system is rigged, or can’t be fixed by voting — came up in many of our conversations with survey respondents.

If President Trump wins re-election, he’ll move to immediately fire FBI Director Christopher Wray and also expects to replace CIA Director Gina Haspel and Defense Secretary Mark Esper, two people who’ve discussed these officials‘ fates with the president tell Axios.
The big picture: The list of planned replacements is much longer, but these are Trump’s priorities, starting with Wray.
President Trump plans to fire several top officials in the national security sphere should he win reelection in November, Axios reported Sunday.
The president plans to fire Defense Secretary Mark Esper, CIA Director Gina Haspel and FBI Director Christopher Wray, two people familiar with his decisionmaking told the news outlet. White House officials declined to comment on personnel matters.
According to the police, the pro-Trump caravan passed through Times Square, where it converged with a group of anti-Trump protesters who had marched from Brooklyn. The cars in the convoy were then blocked by counterprotesters, and some drivers got out of their cars to confront the anti-Trump demonstrators.
A member of the family told Fox News that the unprovoked attack happened while the family was driving down 5th Ave with the car windows down and Trump flags displayed.
The man, who wished to remain anonymous fearing his family could be targeted, said a car pulled up next to them and unleashed pepper spray into their vehicle.
“From what I’ve read and know the intelligence community warned the president that Giuliani was being fed disinformation from the Russians,” Biden said. „We also know that– Putin is trying very hard to spread disinformation about Joe Biden… And so when you put the combination of Russia, Giuliani– the president, together– it’s just what it is.
Biden added: “It’s a smear campaign because he has nothing he wants to talk about.”
The Biden campaign’s decision to lean into accusations of Russian involvement in the episode, despite lacking specific proof, risks eroding public trust in U.S. allegations of foreign election interference if the suspicions in this case turn out to be unfounded, according to intelligence and foreign policy experts. Trump already has undermined such trust by casting doubt on proved Russian interference on his behalf during the 2016 campaign and denigrating U.S. intelligence officials.

In an era of increasing partisanship, split-ticket voting continues to be rare in U.S. politics. With control of the Senate at stake on Nov. 3, just 4% of registered voters in states with a Senate contest say they will support Donald Trump or Joe Biden and a Senate candidate from the opposing party.

Biden returned to his native Pennsylvania for socially distanced drive-in rallies in Bucks County and Luzerne County, two areas crucial to winning the important state, where he hammered Trump for his irresponsible handling of the coronavirus pandemic. Meanwhile, Trump visited North Carolina, Ohio and Wisconsin, holding large in-person rallies where thousands of people crowded together without masks.
As of Sept. 18, only 10% of Manhattan office workers had returned to their buildings, the Wall Street Journal reported late last month.
De Blasio confirmed that City Hall had indeed been considering bringing back more of its workforce, but new developments were put on hold due to the recent COVID clusters in Brooklyn and Queens.
Both 2020 candidates have lavished attention to the natural gas industry in Pennsylvania, the likely tipping-point state in the Electoral College.
Campaign manager Bill Stepien told reporters they would “put the nail in the coffin” for Biden in Pennsylvania, and possibly Ohio and Minnesota.
Biden and Trump are also locked in a tight race in Texas, a state Democrats have long dreamed of taking but one in which the comments could prove damaging.

When the poll only included those who were certain, Trump had a slight lead of 46 percent to 44 percent. The poll was conducted between October 15 and October 18 among 933 likely Texas voters.
The poll included 180 respondents who said they had already cast ballots in early voting, which began in Texas on October 13. Among those who already voted, 57 percent said they had voted for Biden, compared to 41 percent for the president.
This week’s Reuters/Ipsos opinion poll found 49 percent of likely voters in Pennsylvania backed Biden, while 45 percent in the state supported the president. Biden’s 4 percentage point lead falls right on the edge of the poll’s margin of error.
Last week’s poll showed the former vice president leading Trump by 7 percentage points, with Biden getting 51 percent compared to the president’s 44 percent.
The Pennsylvania average shows Biden’s largest lead. The Democratic nominee averages 52% support to Trump’s 43% in polling conducted between September 20 and October 5. In both Wisconsin and Michigan, the averages show Biden with 51% support to 43% for Trump.
The 291 new signatures announced Tuesday join 489 national security leaders who previously endorsed former Vice President Biden as having “the character, principles, wisdom and leadership necessary to address a world on fire.”
„As is the long-standing custom, and as has been promised by the Commission on Presidential Debates, we had expected that foreign policy would be the central focus of the October 22 debate,“ Trump campaign manager Bill Stepien said in a letter to the commission on Monday.

Democrats went to the polls last time certain they would elect the first woman ever to become president, and were punched in the face with a Trump upset. This time they feel the punch coming from a thousand miles away. The worry is visceral and widespread, unassuaged by Biden’s lead in the polls.

According to a new Quinnipiac University poll, Biden and Trump are essentially tied in the Buckeye State. The survey of more than 1,100 likely voters in Ohio shows Biden at 48% and Trump at 47%. Four percent are undecided.

Obama, after speaking at the Democratic National Convention and headlining a number of fundraisers for the party, is expected to hit the campaign trail next week, according to Democratic Party officials, as he looks to support Biden in the final weeks of the election.

Multiple officials told the Associated Press they had not been informed of any such deadline and military experts said it would be impossible to withdraw all 5,000 US troops in Afghanistan and dismantle the US military headquarters by the end of the year.
They suggested the president’s claim was aimed at shifting the news cycle away from coronavirus coverage and that the Pentagon would not act on the order before the 3 November US election.

“I’d like to make it clear that [Defense Secretary Mark Esper] has not issued orders to reduce military personnel below this 4,000 to 5,000 level in Afghanistan, although we are conducting prudent planning to withdraw to zero service members by May 2021 if conditions warrant, per the U.S.-Taliban agreement,” David Helvey, the official performing the duties of assistant secretary of Defense for Indo-Pacific security affairs, told the House Oversight and Reform Subcommittee on National Security at a hearing.
Most states use a “winner-take-all” method when it comes to electoral votes, meaning the candidate who wins the popular vote in the state gets all of its electoral votes as well. But Nebraska and Maine use a different method, in which two electoral votes are distributed to the popular-vote winner in the state, in addition to one electoral vote to whoever wins the popular vote in each of the state’s congressional districts.
With about 240,000 ballots mailed, that meant one in five voters received a wrong ballot. The error happened Saturday afternoon when someone changed a setting on a machine that places absentee ballots into mailing envelopes, Franklin County elections officials said Thursday.

Neither Biden or Democratic vice presidential nominee Sen. Kamala Harris have campaigned in person in Ohio during the general election. That’s a factor the president zeroed in on as he also slammed the latest polling in the state.
“I just saw that we’re tied in Ohio. I don’t think so,” Trump said Monday at a rally in the Toledo suburb of Swanton. “They’re not even campaigning in Ohio, come to think of it. Now, they’re fake polls. They’re almost as fake as the writers themselves. They’re all fake.”
Trump has ramped up his criticism of Barr in recent days as he seeks to make the origins of the Russia probe a major election issue. The president has long cast the Russia investigation as a political hoax meant to undermine him and has called for the indictment of his political enemies, including former President Barack Obama and former vice president and Democratic presidential nominee Joe Biden.
„She said she had 33,000 e-mails,“ Trump told Fox News on Thursday. „They’re in the State Department, but Mike Pompeo is unable to get them out, which is very sad actually. I’m — I’m not happy about him for that, that reason. He was unable to get — I don’t know why. You’re running the State Department and you get them out. But they’re in the State Department.“
Yet the original design of the party-controlled general-election debate has slowly morphed from Republican Party-Democratic Party negotiation into something wholly different: a free-standing group of self-anointed, self-important Beltway Brahmins. Slowly but surely, the organization added staff, raised funds, expanded its “mission” and deepened its own sense of entitlement.
Joe Lieberman, former democrat vice presidential candidate and senator, spoke with Brian Kilmeade and criticized the Commission on Presidential Debate’s decision to make the next debate virtual. Lieberman agrees with President Trump being upset over the decision and says he didn’t think „to just decide“ was the way to make the announcement and that the people on the commission „have become very powerful and a little autocratic.“

The Senate passed a resolution on Thursday reaffirming its support for a peaceful transition of power, one day after President Trump refused to commit to such a transition next year if he loses in the November election.

In a surreal year that has spiraled from surging hopes for a Bernie Sanders presidency to today’s pandemic-hemmed fear and a tight election between centrist Democrats and fascistic Republicans, now may be just the right time for a new political party.
As voters face a dismal “lesser of two evils” election in which a Biden/Harris ticket represents the only alternative to four more years of Trumpian fascism and racism, the Movement for a People’s Party aims to prevent such dreary and sparse choices in the future.

As Barbara Lee presciently warned her colleagues before she cast her lone dissenting vote in 2001, we have “become the evil we deplore.” But these wars have not been accompanied by fearsome military parades (not yet) or speeches about conquering the world. Instead they have been politically justified by “information warfare” to demonize enemies and fabricate crises, and then waged in a “disguised, quiet, media free” way, to hide their cost in human blood from the American public and the world.
After 16 years of war, about 6 million violent deaths, 6 countries utterly destroyed and many more destabilized, it is urgent that the American public come to terms with the true human cost of our country’s wars and how we have been manipulated and misled into turning a blind eye to them – before they go on even longer, destroy more countries, further undermine the rule of international law and kill millions more of our fellow human beings.
There is not much to gain by dwelling forever on the wounds of the past. But in order to take seriously Biden’s claim to moral leadership in foreign policy, there is a minimum debt that he — and other U.S. political leaders responsible for the post-9/11 wars — owes to those who have paid the price for their destructive fantasies: an apology.

If it isn’t tabulated, they won’t be able to vote. So that’s the way it is. And that’s what they should do.“
In a new East Carolina University poll released Tuesday, President Trump garners the support of 49 percent of likely voters in the state compared with 47 percent for Biden, a difference that falls within the survey’s margin of error.
The President isn’t expected to meet with the family of Jacob Blake, the man was shot in the back seven times by a police officer. Trump claimed that he’s not meeting with Blake’s family during his Wisconsin visit because they wanted to involve lawyers.
According to Trump’s public schedule, the President is expected to begin his trip Tuesday afternoon with a visit to a „property affected by recent riots.“

If Trump has a path forward in Minnesota, it will likely rely on an improvement in the Twin Cities suburbs, combined with spiking turnout in rural areas of the state. It’s a tall task, but there is reason for Democrats to be concerned. By the party’s own estimates, there are 250,000 white, non-college-educated men in Minnesota who are eligible to vote but aren’t registered, a rich target for Trump.
