The goal of this paper is to address the question whether SARS-CoV-2 originated from an animal-to-human spillover or from experiments performed in a laboratory. In the latter scenario, it is possible that evidence exists for manipulation of the viral genome by common laboratory techniques. SARS-CoV-2 is a large RNA virus. To create infectious versions of CoVs, the entire 30kb RNA genome is reconstructed in DNA by in vitro genome assembly (IVGA). IVGA has been used to create reverse genetic systems for modified and chimeric RNA viruses for more than 20 years (Yount et al, 2000). Most importantly, IVGA methods can leave genetic fingerprints, and we find those fingerprints in the genome of SARS-CoV-2.

So whoever wrote the minutes for the Sage meetings – condensing its discussions into guidance for government – would set the policy of the nation. No one, not even cabinet members, would know how these decisions were reached.

For some time, I’ve been trying to persuade Rishi Sunak to go on the record about what really happened in lockdown. Only a handful of people really know what took place then, because most ministers – including members of the Cabinet – were kept in the dark. Government was often reduced to a “quad” of ministers deciding on Britain’s future and the then chancellor of the exchequer was one of them. His speaking out now confirms much of what many suspected. That the culture of fear, seen in the Orwellian advertising campaign that sought to terrify the country, applied inside Government.

(a) Ensure that any interference with the right to privacy, including hacking, restrictions to access and use of encryption technology and surveillance of the public, complies with international human rights law, including the principles of legality, legitimate aim, necessity and proportionality and non-discrimination, and does not impair the essence of that right;

(b) Conduct human rights due diligencesystematically, including regular
comprehensive human rights impact assessments, when designing, developing, purchasing, deploying and operating surveillance systems;

(c) Take into account, when conducting human rights due diligence and
assessing the necessity and proportionality of new surveillance systems and powers, the entire legal and technological environment in which those systems or powers are or would be embedded; States should also consider risks of abuse, function creep and repurposing, including risks as a result of future political changes;

(d) Adopt and effectively enforce, through independent, impartial and well-resourced authorities, data privacy legislation for the public and private sectors that complies with international human rights law, including safeguards, oversight and remedies to effectively protect the right to privacy;

(e) Take immediate measures to effectively increase the transparency of the use of surveillance technologies, including by appropriately informing the public and affected individuals and communities and regularly providing data relevant for the public to assess their efficacy and impact on human rights;

(f) Promote public debate of the use of surveillance technologies and ensure meaningful participation of all stakeholders in decisions on the acquisition, transfer, sale, development, deployment and use of surveillance technologies, including the elaboration of public policies and their implementation;

(g) Implement moratoriums on the domestic and transnational sale and use of surveillance systems, such as hacking tools and biometric systems that can be used for the identification or classification of individuals in public places, until adequate safeguards to protect human rights are in place; such safeguards should include domestic and export control measures, in line with the recommendations made herein
and in previous reports to the Human Rights Council;

(h) Ensure that victims of human rights violations and abuses linked to the use of surveillance systems have access to effective remedies. In relation to the specific issues raised in the present report, OHCHR
recommends that States:

Hacking

(a) Ensure that the hacking of personal devices is employed by authorities only as a last resort, used only to prevent or investigate a specific act amounting to a serious threat to national security or a specific serious crime, and narrowly targeted at the person suspected of committing those acts; such measures should be subject to strict independent oversight and should require prior approval by a judicial body;

Encryption

(b) Promote and protect strong encryption and avoid all direct, or indirect, general and indiscriminate restrictions on the use of encryption, such as prohibitions, criminalization, the imposition of weak encryption standards or requirements for mandatory general client-side scanning; interference with the encryption of private communications of individuals should only be carried out when authorized by an independent judiciary body and on a case-by-case basis, targeting individuals if strictly necessary for the investigation of serious crimes or the prevention of serious crimes or
serious threats to public safety or national security;

Surveillance of public spaces and export control of surveillance technology

(c) Adopt adequate legal frameworks to govern the collection, analysis and sharing of social media intelligence that clearly define permissible grounds, prerequisites, authorization procedures and adequate oversight mechanisms;

(d) Avoid general privacy-intrusive monitoring of public spaces and ensure that all public surveillance measures are strictly necessary and proportionate for achieving important legitimate objectives, including by strictly limiting their location and time, as well as the duration of data storage, the purpose of data use and access to data; biometric recognition systems should only be used in public spaces to prevent or
investigate serious crimes or serious public safety threats and if all requirements under international human rights law are implemented with regard to public spaces;

(e) Establish robust well-tailored export control regimes applicable to surveillance technologies, the use of which carries high risks for the enjoyment of human rights; States should require transparent human rights impact assessments that take into account the capacities of the technologies at issue as well as the situation in the recipient State, including compliance with human rights, adherence to the rule of law,
the existence and effective enforcement of applicable laws regulating surveillance activities and the existence of independent oversight mechanisms;

(f) Ensure that, in the provision and use of surveillance technologies, public-private partnerships uphold and expressly incorporate human rights standards and do not result in an abdication of governmental accountability for human rights.

It is instead a significant encroachment into the lives—and health—of a vast number of employees. “We expect Congress to speak clearly when authorizing an agency to exercise powers of vast economic and political significance.” Alabama Assn. of Realtors v. quotation marks omitted). There can be little doubt that
OSHA’s mandate qualifies as an exercise of such authority.
The question, then, is whether the Act plainly authorizes
the Secretary’s mandate. It does not. The Act empowers
the Secretary to set workplace safety standards, not broad public health measures.

The Solicitor General does not dispute that OSHA is lim-
ited to regulating “work-related dangers.” Response Brief
for OSHA in No. 21A244 etc., p. 45 (OSHA Response). She
instead argues that the risk of contracting COVID–19 qual-
ifies as such a danger. We cannot agree. Although COVID–
19 is a risk that occurs in many workplaces, it is not an occupational hazard in most. COVID–19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from
crime, air pollution, or any number of communicable diseases. Permitting OSHA to regulate the hazards of daily life—simply because most Americans have jobs and face those same risks while on the clock—would significantly expand OSHA’s regulatory authority without clear congressional authorization.

“Osha has never before imposed such a mandate. Nor has Congress. Indeed, although Congress has enacted significant legislation addressing the Covid-19 pandemic, it has declined to enact any measure similar to what Osha has promulgated here,” the conservatives wrote in an unsigned opinion.

In dissent, the court’s three liberals argued that it was the court that was overreaching by substituting its judgment for that of health experts.

The original investigation was supposed to last about a week, but because it had not arrived at the predetermined conclusion sought by the hostile board members, they prolonged it week after week for two months, pressuring committee members to alter their conclusions, attempting to censor and expel committee members who objected to the political motives behind the allegations, fabricating new charges of “retaliation” for supporting a party-wide vote on vaccine mandates, and most seriously, engaging in a sustained campaign to replace the legal board of the organization with a partial one that subtracted Rodrigo and me, an attempt that our General Council affirmed was illegal.

Had there been any actual evidence, the investigation would have concluded quickly. Because there was none, they resorted to manufacturing the new charges, further revealing their political motives. But the more her allegations fell apart, the more brazen the hostile faction on the board became. They abandoned their responsibilities in other areas of the party, including organizing, tech, and finance, and focused obsessively on attempting to remove me.

Meanwhile, they were also trying to enact their liberal agenda on the National Organizing Committee. They inserted a provision into the draft charter of the People’s National Committee which would have allowed registered Democrats to control every seat on about forty People’s Party state committees and a supermajority on our national committee, effectively inviting Democratic Party infiltrators. When populist delegates overwhelmingly struck down their provision, they were furious.

Israeli Ministry Seeks Extention of Controversial Fingerprint Collection Order

Despite its statements, the Interior Ministry plans to continue collecting fingerprints for its biometric ID database until 2025, at the earliest. Interior Minister Ayelet Shaked has proposed a three-year extension of the emergency order that provides for gathering fingerprints from citizens. The Knesset must vote on the measure.

The ministry’s Population and Immigration Authority says it needs about two years to buy and introduce facial recognition technology that will obviate the need for fingerprints. The agency is considering retaining the fingerprint database for victim identification in the event of a national disaster.

At current pace, sometime in late April we will pass a grim milestone: 1 million Americans dead from covid-19. If we get lucky and the omicron wave abates, that millionth death may not come until later in the spring, or the summer. But it will come, and soon.

Keep that in mind as you consider the latest news from the Supreme Court. On Thursday, by a 6-to-3 vote along party lines (and no, I won’t pretend the justices have no relevant party affiliations), they struck down the Biden administration’s mandate that large employers were supposed to require that their employees either be vaccinated or receive regular tests for covid-19.
